Legislation under Environment Protection Act (CAP 549)

The main piece of legislation that tackles the environment in Malta is the Environment Protection Act (Chapter 54
the Laws of Malta). Prior to the demerger of MEPA, the relevant piece of legislation was Chapter 504, the Environm
and Development Planning Act, however the latter has since been repealed.

The main aim of Cap. 549 is to protect, preserve and improve the environment, and ensure that the well-being of
environment is maintained. Through this Act, the Minister responsible for the environment is given the power to
publish regulations which will fall under the Act – these are referred to as Subsidiary Legislation (SL). This body of
legislation covers all of the thematic environmental areas including waste, water, air quality, biodiversity and natu
protection, environmental noise, radiation, marine, genetically modified organisms and biosafety, environmental
assessment, ozone protection and industry, amongst others. The competent authority for each piece of legislation
outlined and defined within the SL itself. ERA is the competent authority for most, but not all, of the SLs under Ca
549.
