UTILIZATION

1. The utilization of subterranean or ground water shall be coordinated with that of


surface waters such as rivers, streams, springs and lakes so that a superior right in
one is not adversely affected by an inferior right in the other (UTILIZATION OF
SUBTERRANEAN WATER IN COORDINATION WITH SURFACE WATERS)

2. Water in open canals, aqueduct or reservoir of private persons may be used by any
person for domestic purpose or for watering of plants (WATER IN OPEN CANALS,
AQUEDUCT OR RESERVOIR FOR DOMESTIC PURPOSES)

3. Works for storage, diversion, distribution and utilization of water resources shall
contain adequate provision for prevention and control of diseases (PROVISION FOR
THE PREVENTION & CONTROL OF DISEASES FOR STORAGE, DIVERSION &
UTILIZATION)

4. When reuse of water is feasible, it shall be limited as much as possible to such uses
other than direct human consumption (REUSABLE WATERS LIMITED TO SUCH USE
ONLY)

5. Drainage system shall be constructed that their outlets are rivers, lakes, sea, natural
bodies such other water course as many be approved by proper government agency
( DRAINAGE SYSTEM OUTLETS MUST BE THRU NATURAL BODIES)

6. Lower estates are obliged to receive the waters which naturally & without
intervention of man flow the higher estates as well as the stones or earth which they
carry with them (LOWER ESTATES OBLIGED TO RECEIVE NATURAL FLOW OF WATERS)

7. Banks of rivers and streams and the shores of the seas and lakes throughout their
entire length and within a zone of three (3) meters in urban areas, twenty (20)
meters in agricultural areas and forty (40) meters in forest areas, along their margins
are subject to the easement of public use in the interest of recreation, navigation,
floatage, fishing and salvage. (NATURAL BODIES OF WATER SUBJECT TO EASEMENT
OF PUBLIC USE)

8. Development of water resources shall consider security of the state, multiple use,
beneficial effects, adverse effects and cost of development (WATER REOURCES
DEVELOPMENT CONSIDER STATE SECURITY, MULTIPLE USE, BENEFICIAL EFFECTS,
ADVERSE EFFECTS AND COST)
