Subject: Application for registration under section 12AA of the Income Tax Act, 1961

With reference to your application in Form 10A for registration u/s 12AA of the Income
Tax Act, 1961 filed, vide this office letter issued earlier, you were required to furnish the
following documents/ clarification/ information on or before 07/01/2020 through system(e-
filing portal) to this office:

1. Self Certified copy of Certificate of Registration of Trust.

2. Copy of Trust deed / M.O.A. duly verified / Self certified and stamped by the trustee /
trustees verifying the Form 10A. If it is not in English, then certified English translation
also.

3. Please specify the clause in Trust deed regarding revocability or irrevocability.

4. Details of donations received since inception/during last three years attached.

5. Details of donations paid since inception/during last three years attached.

6. Please give details of premises of Trust whether premises owned by the Trust or Rented.
Whether NOC from the premises owner is obtained or rental agreement is enclosed.

7. Whether registration u/s.- 80G/12AA has been refused/rejected earlier? If so, state
briefly the reasons for such refusal/rejection.

8. Please submit certified copy of Audited Accounts like copy of receipt and payment A/c.,
Income & Expenditure A/c, Balance Sheet, since inception/during last three years,

whichever is less.

9. Please submit a note specifying the main area of charitable /religious activities and
projection/plan of action for the main charitable activities to be undertaken in the next two
years.

10. Please specify the category of charitable purpose provided in the section 2(15) of the I.
T. Act. 1961 in which its case falls, i.e. whether your objectives is relief of the
poor/education/yoga/medical relief/preservation of monuments or places of
artistic/historic interest/advancement of any other object of general public utility/religious
activities

11. Please state whether the Trust Deed/Memorandum of Association includes a clause
providing that the funds/property of the Trust/Society /Non Profit Company will be used
for the objectives of the Trust/Society/Non Profit Company?

12. Please state whether the Trust Deed/Memorandum of Association includes a clause that
in the event of dissolution of Trust/ Society/Non Profit Company, the funds/assets of the
Trust/Society/Non Profit Company will be transferred only to some other
Trust/Society/Non Profit Company having similar objectives.

13. Whether the Trust Deed/Memorandum of Association contains Beneficiary Clause (a


Clause that the beneficiaries are a section of the public and not specific individuals.

14. Please state whether any part of the income of the Trust/Society/Non Profit Company
enures, directly or indirectly, for the benefit of a person specified u/s. 13(3) of the Income
Tax Act, 1961.

15. Please furnish note on activities conducted since inception/during last Three years with
documentary evidence.

16. Please file an undertaking that there will be no infringement to the 1st proviso to section
2(15) of the Income Tax Act, 1961.

17. Please submit proof of identity of the main Trustee/ President of Secretary of the
Trust/Society/Non Profit Company.

18. Please state Whether Trust/Society/Non Profit Company registered under the FCRA,
2010.

19. Please furnish details of bank accounts.

20. Undertaking u/s. 11(5) of the IT Act 1961.

21. Please furnish an affidavit/undertaking to the effect that the trust/institution is complying
all the requirements of law as are material for the purpose of its objects as enumerated in
the trust deed.

Now you are required to submit on or before 07.01.2020 only those


details/documents which have not been submitted earlier along with your application
in Form No. 10A or in compliance to this office letter issued earlier as referred above.

Please also note that failing to comply with this letter will result into rejection of your
above application.
