FIRST CALL:
On 06/29/14 at 1158 hrs, I was dispatched to the corner of S. Washington Ave and W. South St. in reference to a
missing person.
VENUE:
I spoke with Leven near on 06/29/2014 at approximately 12:00. Carlos stated he called police
because he cannot find his friend Brandon Mitchner. I asked Leven if he called the hospitals and jails. Leven
stated he call the local hospitals and jails. He said they all told him they have no record of a Brandon Mitchner.
Leven stated that he had attempted to contact Brandon several times over the phone, but was unable to make
contact. Leven advised that Brandon's phone was dying when they were together the night before.
Leven said that on 06/28/2014 he and Mitchner were on a party bus. Leven said around 19:00 the party bus was
in downtown Lansing. Leven stated that they were at the Suits Tavern. Leven stated that he was very intoxicated.
He also told me that Mitchner was very intoxicated to the point he had trouble standing. Leven told me he saw
Mitchner exit the bar so he followed him. Leven stated Mitchner began walking around outside. Leven advised
me that Mitchner often passes out at parties from drinking too much. Leven said they were walking and he saw
Mitchner start running. Leven said he has no idea how they ended up near . At this time Leven
was standing near the edge of the side walk just to the south of the apartments at . Leven told me
he thinks Mitchner fell over because he heard a thud. Leven indicated the flat area near the sidewalk as the
location where Mitchner had fallen. Leven made no indication that Mitchner would have made it to the adjacent
riverbank area. Leven stated he thought Mitchner was puking so he ran back to the nearest intersection to call a
friend. Leven pointed at the intersection of S. Washington and W. South St. Leven stated that his friends could
not find him there so he once again began running. Leven said he ended up at the Admiral Gas Station on S.
Cedar St.
Leven said " the whole night was very blurry and I didn't know where I was at". Leven said he remembers getting
in a taxi at the Admiral Gas station. Leven told me that he was so drunk he didn't remember how he got to bed.
He said when he woke he remembered that Mitchner had fallen over. He said he drove back to S. Washington
and W. South St. to look for Mitchner.

OFFICERS ACTION:
I gathered a description of Brandon Mitchner and had dispatch create a BOL. I told Leven to keep contacting
friends and family to try and locate him. I also advised Leven to gather information on Mitchner's family for me.
Dispatch advised that Bianca Mitchner is waiting in the 200 block of S. Washington in reference to her brother
missing. 06/24/2014 18:51
I spoke with Bianca in the 200 block of S. Washington. Bianca was waiting near Brandon's vehicle that had been
parked on S. Washington overnight. Carlos Leven showed up shortly after making contact with Bianca. Carlos
asked if we could go down to S. Washington and W. South St. where he last saw Brandon. I led Leven and
Bianca to the intersection. I spoke with Bianca and Leven near Carlos began telling the story of
what happened to me and Bianca. Leven stated that he thinks Mitchner might have gone over the edge.
Originally Leven pointed to the area near the side walk near . Leven was now near the tree line
pointing down the riverbank as a possible location where Mitchner could have fallen.
Leven checked his phone and saw that he began calling friends at 0056 hrs, on 06/29/14. Leven advised that he
made the first call to friends after Brandon Mitchner fell.
PHOTOGRAPHS:
I took pictures with my duty issued camera. I took pictures of the scene and location where a shoe and hat was
found.
EVIDENCE:
Sgt. Osborn located a black and blue hat on the riverbank. The hat was located to the southeast of
Sgt. Osborn also located a black tennis shoe near the same area where the hat was located.
Carlos stated Mitchner was wearing a pair of "Jordan" shoes. The shoe found at the scene were the brand
"Jordon". Mitchner saw the black and blue hat and stated that it was the one Mitchner was wearing.
TAGGED EVIDENCE:
Wilson lives at in has a south facing window that is the closest to the
sidewalk where Mitchner was last scene. Wilson stated he did not hear anything during the hours of 01:00 and
02:00 in the morning on 06/29/2014. He stated he was asleep. Wilson has a video camera system. The camera
is located on the southwest side of the building. The camera faces east towards the intersection of S.
Washington and W. South St. Wilson was able to show me the video of what appeared to be Mitchner and
Leven. The video shows Mitchner and Leven walking on the sidewalk. Both Mitchner and Leven were then out of
the view of the camera. Moments later a person who appears to be Leven went running back towards S.
Washington and W. South St. The subject believed to be Leven that ran back towards the area outside of the
camera view. The subject then again ran back East towards S. Washington. Wilson stated he is willing to help
police. Wilson stated he will save a copy and will produce it to police when requested.
Gina lives at . in has a west facing window toward the river. Gina stated
she is a light sleeper. She said she heard nothing between the hours of 01:00 and 02:00 on 06/29/2014. Gina
stated she talked to two males at 10:00 on 06/29/2014 that were running up and down the riverbank. Gina stated
the males said they were looking for a friend.
Mandley called police on 06/29/2014 at approximately 22:30 in reference to information regarding Brandon
Mitchner and Carlos Leven. Mandley told me that Mitchner and Leven are some sort of buisness partners.
Mandley advised they make there own clothing line of tshirts. Mandley stated he has been very good friends
with Mitchner for over 15 years. Mandley told me that Leven and Mitchner had only been good friends since they
started making shirts together. Mandley stated that Mitchner often complained about Leven. Mandley said
Mitchner and Leven have had arguments over money and tshirt productions. Mandley stated he saw Twitter
Posts from Leven that struck him as odd. Mandley emailed the Twitter posts. The twitter posts will forwared to
DB to be entered into the report.

OFFICER ACTION:
I responded to the dead end of South St. West of S. Washington Ave. in reference to a missing person. I was
advised that Brandon Mitchner was last seen near the Grand River by Carlos Leven at approximately 0056 hrs,
on 06/29/14. Leven had advised that both he and Brandon were both highly intoxicated.
Bianca Mitchner advised Officer Murlick that she and other family members were unable to locate Brandon.
Officer Murlick as well as family members attempted to contact Brandon by phone. Officer Murlick advised that
Brandon's phone did not ring and that it went directly to a message that indicated the owner of the phone had not
set up their voicemail. Due to the fact that the phone was believed to be off, no phone ping was attempted.
Family members also went to Brandon's home and checked the interior of the residence. Brandon was not
located at his residence. I contacted the Menards in Delta Township. I spoke with the manager who advised that
Brandon was not scheduled to work until Sunday at 0500 hrs.
I contacted Sgt. Joe Brown reference a possible dive call out. Due to the time lapse in the incident being
reported and the fact that it would soon be dark, a dive call out was deemed to not be prudent at that time.
I contacted LFD and requested that they respond to the area with a Zodiac and check the river where a hat and
a shoe believed to be Brandon's were located. LFD personnel checked both North and South of the location but
were unable to locate anyone in the water or along the bank.
Sgt. Eichenberg, Ofc. Murlick and I conducted and area search along the river but were UTL Brandon.
DISCOVERY OF EVIDENCE:
While searching the area I located a baseball style hat approximately 5 to 6 feet inside of the wooded area. I
then later located a black Jordan tennis shoe farther down the river embankment. I continued down the
embankment towards the water and observed an approximate 2 foot area that appeared to be recently
disturbed. There was debris that appeared to pile up at the bottom portion of the disturbed area. The bottom of
the disturbed area was lower on the slope of the embankment and closer to the river. I marked the area of
disturbed ground and the shoe for dive team evaluation.

INITIAL INFORMATION:
On 6/30/14 I was advised of a missing person who possibly fell in the river in the vicinity of
I went to the scene and checked the area. I found some foot prints I did not associate with the scene and took
scale photos of them but learned they were not in the area of where the shoe and hat were found.
I took photos of the location where the shoe and hat were found by officers and areas that had broken
branches and scuff marks on the hill side.
I spoke with the Tri -County Dive team and advised them on what location the deceased apparently entered
the water.
Further I spoke with the business owner at Mik's Pizza Supply, John Johnson, and he advised the business
closed at noon on Saturday and he has no video surveillance system.
I spoke with the occupant of He advised he was home at around 00:30 to 01:00 and he did not
hear or see anything unusual that morning.
RECOVERY OF BODY:
I was present when the Tri-County Dive Team recovered the deceased. He was taken from the river in the
vicinity of the Elm St Bridge at S Washington.
On 6/30/14 I conducted an interview with Leven. Present with me was Det St Aubin. The interview was audio
and video recorded.
Leven stated he and a number of friends, to include the deceased, went out on a party bus and stopped at a
number of bars. He advised the entire group was very intoxicated and after the final departure from the party bus
the deceased, Brandon Mitchner, departed heading S/B on S Washington. Leven went with him to insure he did
not drive. He said they ended up at the dead end of W South St and Brandon headed for the wood line. Leven
followed. Leven said it was dark and he lost sight of Brandon. Leven heard a sound he associated with a fall
and called to Brandon. When Brandon did not reply, he ran and tried to call his friends to have them come help.
After a number of attempts he was unable to get his friends to his location he found himself at Admiral Gas
Station at Cedar St and called for a cab. Leven advised he has very little memory of happened after this time.
During the interview Leven consented to a search of his cell phone. I read and presented him the consent to
search and he reviewed it and signed it. I turned the phone over to Det Seyka and he downed loaded it and
turned over to me. I placed the phone in an envelope and asked Sgt Osborn to return it to Leven when he
arrived at the police station.
Bonofiglio stated he was present with several other persons on and they stopped at a number of bars in the
area where members of the group drank shots celebrating the 21st birthday of Jackson Van knocker . He said
the group returned to the starting point, Suits Bar on Washington. At this point he and several of the group went to
Eden Rock Bar and he was unaware of where Mitchner and Leven had gone. A time later he received phone
calls from Leven saying something about Mitchner falling. Bonofiglio said Leven tried to give him his location but
he was unable to find it on his phones GPS. He said he eventual stopped getting the calls and sometime later
he went back to his residence and saw that Leven was there.
He advised they awoke the next morning and found that Mitchner was unaccounted for and begin to look for
him and contacted the police.
The interview was audio and video recorded in room number one.
I was advised by family member that the deceased had left his car on Washington in the vicinity of
"Instaprints". I went there and photographed the car and attached those photos to this report.
On 7/1/14 at approximately 0730 Craig Anderson and I went to and Anderson recovered a
video showing the deceased and subject Leven walking toward the dead end of W South St.
Anderson advised he recovered the video in .264 and converted it to .AVI. I had this video down loaded onto
the DB S drive and a disc made of the video.
The video was provided by Theodore Wilson.
AUTOPSY:
I was present at the autopsy of the deceased. I collected the evidence and placed the wet the clothing and
placed it in the drying room. I tagged the remaining autopsy evidence in at the North Precinct. With the exception
of a set of three keys attached to a lanyard. I returned this property to family members so they could move the
deceased's car.

On 6-30-14, at approx 1040 hrs, CSI was requested to meet Det Hogan in the 100 block of W South St. to take
photos.
-Det Hogan
Hogan was examining the area where it was believed that the decedent in this case had gone down the hill and
into the Grand River. Hogan advised that Patrol officers had marked where the decedent's shoe had been
found on the hillside. In addition, Hogan had found several freshly broken branches along the hillside. Photos
were requested.
-Photographs
Photos were taken of the area along the hillside showing what appeared to be slide marks and freshly broken
branches all the way down to the river's edge as well as traffic cones used to mark locations of the shoe and
trail. Photos were also taken from across the river on the river trail.
-Body Recovered
Just before 1300 hours, the decedent's body was located and recovered in the river near the Elm St bridge. I
responded to the location and took photos of the recovery and the decedent.
I stayed on-scene to assist the MEI and until the decedent was removed from the scene by Lansing-Mason.
-Photos Stored
All photos were stored on the CSI drive. Copies of the photos were provided to Det Hogan and to Sgt, J. Brown,
Dive Team Commander.
him. Benjamin advised his ex-wife, I do not know her name, of what he saw on the morning Victim Mitchner went
missing. This was then posted to facebook, and brought to the attention of detectives.
I met with Benjamin on 7/02/14 at approximately 1200 hours at the investigations division. We spoke in interview
room #1.
Benjamin stated his ex-wife is living on Cottage St., which is off S. Washington Ave. He stated he went their
around 2330 hours on 6-28-14. He stated he could not drive from Cottage to Washington due to the road being
closed for a festival. Benjamin stated he left his ex-wife's residence and drive south through a parking lot.
Benjamin advised this was at 0120 hours on 6-29-14. He stated this was the time as he texted his ex-wife when
he got to his home in DeWitt Township, which would have taken him about 10 minutes. Benjamin checked his
cell phone messages and was positive of the time frame.
Benjamin stated as he pulled out of the parking lot onto South St., he looked west and saw two males at the end
of the street near the guardrail. He stated he could not see faces, and it was dark, but thought they were black
males. Benjamin stated he heard them yelling at one another and it appeared they were fighting. One of the
males said: "I'll kill your ass mother fucker!" Benjamin could not describe what the subjects were wearing.
Benjamin stated it was dark at the end of the street.
Benjamin also state there was a gold colored Ford Explorer parked south of the parking lot exit on South St. A
lighter skin, but not white, male was standing near this SUV with black shorts.
Benjamin then returned to his home. When he heard that police were in the area, he told his ex-wife about what
he saw, and she then made a facebook post about a fight at the end of South St.
Information:
On 6/29/14 at approx. 1930 hrs, I was contacted by Sgt. N. Osborn re: a missing person. Sgt. Osborn indicated
that the victim had been reported missing and believed to be in the vicinity of the riverbank at the dead end of
South St.
After some discussion, I determined that we would not dive at this time as we did not have confirmation that the
victim was in the river. Further if he was in the river, there was no LSP and it would be dark by the time a dive
team was assembled. If further information was developed, a dive operation could be conducted on the
following morning. I suggested that LFD be utilized to conduct a surface search with a Zodiac and officers walk
the banks downriver to look for any evidence of a victim.

Follow up:
On 6/30/14, I met with DB Sgt. Chris Baldwin and Det. Hogan. It had been determined that based on follow up
information; it was likely that the victim had fallen into the river.
I surveyed the scene, developed a dive plan and initiated a dive call back. A briefing was held at the LPD dive
garage before the operation was held.
Scene Briefing:
It was determined that the Dive Team would stage on the Elm St Bridge and the divers were divided into two
teams.
Team 1 - divers would utilize patterns and search the probable area where the victim would have fallen in, in the
vicinity of South St.
Team 1 was comprised of Ofc. Curtis, Sgt. Curtis, Ofc. Mills, Dep. Walter, Dep. Cramer, Dep. Richards, and Dep.
Huhn. Divers worked the operation from the pontoon boat.
Team 2 - utilized side scan sonar from a Jon boat and searched down river of Team 1 to the Elm St. Bridge.
We noticed that the float began to travel down river, which was unusual due to the float being weighted. We
followed the float and as we approached the Elm Bridge, I observed the body floating near the float just under
the surface of the water. I grabbed the arm and secure the body. It's my opinion the sonar hit was accurate
and the float hooked onto the body in some manner. The motion of the boat disturbed the body which was
ready to float from decomposition.
Recovery:
The body was taken under the Elm Bridge to the east bank and out of sight of onlookers. Divers Walter and
Cramer put the body into a water body bag. LFD was summoned and a stokes basket was used to pull the
body up to the grassy area adjacent to the bridge. DB, CSI and MEI responded. CSI took photos and Ofc.
Belill bagged the hands for the ME.

No risks were identified to prevent the dive/recovery.

On 2 July 14 at approximately 0930 I conducted an interview with witness Degood. The interview was audio
and video recorded.
Degood advised he was friendly with the deceased and was present on the evening early morning of the
incident.
Degood advised he was not drinking on the night of the incident as he is currently on probation and trying to
stay sober. He stated it appeared that everyone else in group was drinking heavily as he witnessed them drink
multiple shots over the course of the evening. He stated he did not see or hear anything that looked like there
was conflict between anyone in the group and that everyone was having fun and drinking.
He mentioned that when the group returned to Suits Bar Brandon got very ill and vomiting in the restroom.
Degood said he left a short time later.
On 3 July 14 at approximately1340 I conducted an interview with witness Bowman. The interview was audio
and video recorded.
Bowman stated he had a friendly relationship with Mitchner. He said he was present the night of the incident.
Bowman advised he was drinking a lot that night and witnessed almost everyone else doing the same. He said
he did not see or hear anything that caused him to think something was wrong or that anyone was upset or angry
at anyone in the group.
On 8 July 14 at approximately 0930 I conducted a telephone interview with witness Mandley. The interview was
audio recorded.
Mandley said he had been good friends with Brandon since elementary school. Mandley voiced concern that
Brandon was in business with a person and had stated Brandon was upset/frustrated that his partner was not
working as hard at the business as Brandon was. Mandley said he and Brandon had discussed this situation
several times and Brandon thought due to legal issues he was stuck in the business situation.
Mandley said the shirt business was capable of making up to $3000 a month. He said he had never heard
anything about violence between Brandon and his partner and that he does not know anything about what
happened the night Brandon died.
FINDINGS:
Based on the results of the autopsy and the investigation the case is closed as a noncriminal incident.

Manner: Accident
INFORMATION:
Based on information provided by the mother of the deceased Shirley Mitchner I conducted several interviews
and have provided summaries listed below.
a T-shirt business together. Hayden thought of the business as a college side job and not a major money
making business. She was not aware of any violence between Carlos and Brandon and has no first-hand
knowledge of the night of Brandon's death.
The interview was audio recorded and a copy will be presented to the ICPO.
On 6/28/18 I drove to in Charlotte MI and after identifying myself as a Lansing Police Detective I
spoke to a subject who identified himself as Tyler's father Randy. I told Randy this concerned the death of
Brandon Mitchner and that Tyler possibly had additional information about the case. Randy appeared to
remember the incident and advised me that Tyler was currently at work and that he would be certain to advise
him of the situation and that Tyler would be calling me soon. I left Randy with a business card.
On 7/3/18 I sent a letter to Degood at and as of the completion of this portion of the report I have
had no response.
On 7/17/18 I had a message left by a subject identifying himself as Degood and advising he had received a
letter from me and that he was willing to cooperate. I called and left messages with my contact information on
July 17th, 19th and 20th with no responses.
