The committee met to receive testimony on no-bid intelligence gathering contract given to Israeli-based intelligence
gathering firm the Institute of Terrorism Research and Response by the Pennsylvania Department of Homeland Security.

"Chairman Lisa Baker (R-Luzerne) noted "this controversial matter that prompted this hearing is toxic to the public trust"
and noted the "concern and outrage" that prompted the investigatory hearing. Further, she noted, it is hard to believe the
people listed in the bulletins were "perceived as threats against the commonwealth" and "even harder to believe that no
one in a position of authority red-flagged the practice of issuing warnings about groups legitimately exercising their
constitutional rights. " She stated it would be unnerving if nobody in a position of power was paying attention to this
information. However, she said, "if highly-placed state officials, were aware of what was being disseminated, that is scary,
because the bulletin information defies common sense, defies any understanding of real risk, and defies any regard for
the exercise of constitutionally protected rights."

'We are obligated to seek answers and establish accountability," she said.

Minority Chairman Larry Farnese (D-Philadelphia) agreed the committee and the public both deserve an explanation.

Virginia Cody, a resident of Wyoming County, recounted her efforts to protest the natural gas industry in Pennsylvania,
including a letter-writing campaign to both legislators and newspapers and the creation of a blog to publicize the issue.
She said she also was a frequent poster on the Susquehanna County Gas Forum . She remarked her efforts were
evidently "loud enough to rouse the attention of my government." She said the government "branded me an extremist or
possibly and eco-terrorist for writing a more balanced truth , for writing opinions that didn't sit well with those in power."

Chairman Baker asked if either French or Powers were aware ITRR co-director Michael Perelman was recognized in an
article written by the Central Penn Business Journal dated June 2007, which reported much of Perelman's recognition
comes from his work involving environmental extremists. Neither man was aware of the article.

Chairman Baker asked how ITRR came to the attention of the administration, particularly since the firm has contracts with
no other governmental body. Powers stated the basis of the contract was to help develop an information sharing
environment with respect to the state's critical infrastructure, and to bridge a gap that existed with respect to dedicated
analytic researchers.

He described how in 2006 he discussed with the Pennsylvania State Police (PSP) commissioner and deputy
commissioner the idea of providing focused attention on critical infrastructure and key resources in the state. Powers
noted the existing Criminal Intelligence Center (PaCIC) did not have the complement to fulfill the agency's needs. He said
then-Commissioner Jeff Miller as well as current Commissioner Pawlowski recognized the need such a focus, and
continue to do so. Powers went on, explaining that in 2007 a grant application for around $500,000 was submitted and
approved by the federal Department of Homeland Security (DHS) for funds to provide "critical infrastructure protection and
intelligence activities." He stated that is the only grant he is aware of that the state is utilizing for homeland security
purposes.

Chairman Baker questioned why the specific financial details, specifically a budget, surrounding the grant and its single-
purchasing order are not available. Powers said he is not aware of the "administrative details" of the purchase order,
though he acknowledged he was the one who requested the sole-source purchasing order. He described the process by
which he settled on ITRR as the preferable, and in his estimation only, organization capable of fulfilling his needs.

Powers also acknowledged that in his search he did not consult with PSP. Chairman Baker asked who in the
administration other than Powers and the PEMA purchasing agent signed off on the ITRR contract. French said he is the
one responsible for the contract itself being approved. He said he did not advise anyone else in the Governor's Office of
the contract.

Chairman Baker asked if French and Powers have ever visited the PaCIC facility. French said he has once and Powers
said three or four times. Chairman Baker said "that is somewhat surprising" given the apparent contradiction between the
statement that PSP was not consulted. Powers pointed out he is in touch with PSP "all the time" with respect to various
issues, and noted they got the raw ITRR bulletins. Chairman Baker asked if they ever raised any concerns with it, to which
Powers acknowledged that on some occasions he was informed by PSP that "some of the information looked like it was of
useless value." Powers noted however that other stakeholders, including "those at the lowest level of government" found it
much more useful.

Chairman Baker took issue with a statement from Powers' testimony asserting no state money was used for the contract.
She remarked that although the grant money was from a federal program, that money itself still came from the pockets of
Pennsylvania taxpayers.

"In my judgment I believe the Criminal Intelligence Center had the capability and I'm disappointed that they were not vitally
a part of this discussion, " Chairman Baker stated. Powers pOinted out that various organizations including DHS don't
focus on the county or local level when it comes to intelligence.

Chairman Baker asked how many individuals were disseminated the tri-weekly bulletins from ITRR. Powers said it
depended on the contents of the bulletin itself. He said they went to a set number of law enforcement and emergency
preparedness officials, with more or less in the private sector and elsewhere depending on the subjects contained in a
given issue. He estimated at least roughly 800 people received each bulletin. Chairman Baker said she has not had one
person come forward and tell her the information they got was useful or vital.

Minority Chairman Farnese asked Powers if he believed he was getting what he was paying for with the bulletins. Powers
said he did and considered the bulletins "raw data," which he then melded with data from other sources such as the FBI.
Calling it a "subjective" decision related to the idea of "situational awareness," Powers said he "thought it was important to
get the word out to counties and municipalities that these incidents might be impacting upon their critical infrastructure and
key resources."

Minority Chairman Farnese asked of any if the bulletin threats disseminated required an emergency response. Powers
said "there were not any threats per se," and noted immediate threats were usually publicized by DHS. He noted there
were "about three or four" incidents where there were Pennsylvania students located overseas that he felt the university

Given the stated need for the bulletins, Senator Mensch questioned why it took until 2010 to implement them , given
Powers' testimony that the idea was born in 2006. Powers explained "it just takes that long to put things in place" given
the small size of his office and the massive undertaking involved.

Chairman Baker asked if there is any information from ITRR about groups being monitored entered into a criminal justice
system. Powers said that did not happen to the extent he is aware. He said his office maintains no data system, but could
not speak for ITRR itself.

Senator Ferlo stated he believes French's avoidance in his testimony of the critical issue to Pennsylvanians that of a
government "run amok," and infringing on people's civil liberties, is "absolutely outrageous." He also criticized French for
offering a "very wishy-washy" statement in defense of the contract. Senator Ferlo pointed out a social event he hosts
every month called "Green Drinks," which he described as being a venue over which hundreds of people meet to have
beers and discuss sustainability, was flagged in an ITRR bulletin as being a "Iow-to-moderate" threat.

French explained his point was that in general PEMA attempts to help emergency responders deal with a variety of
eventualities. Senator Ferlo interrupted and asked again why his event was classified as a threat. Powers admitted "it
probably should not have been included." Senator Ferlo pointed out the Southern Poverty Law Center (SPLC) identifies
hundreds of neo-Nazi and related gatherings, whose attendants have previously engaged in violent behavior, none of
which were included in the ITRR bulletins. He said the contract has resulted in a violation of civil rights.

Senator Ferlo also remarked that if Governor Rendell were "truly appalled," neither Powers nor French would be sitting at
the panel, and would instead have been sacked.

Continuing, he asked if the information is still being collected. French said the bulletins are no longer being disseminated,
with issue 137 being the last prepared. He noted the contract itself will be allowed to expire when it comes due in October.

Senator Ferlo added he believes the contract did not "just arise from nowhere" and questioned its source. "Something
stinks here," he commented, adding that with respect to ITRR, "they've got a good scam going."

Senator Folmer pointed out a group he co-founded in 2005, known as the Constitutional Organization of Liberty, which
teaches civics classes to adults, was also flagged in an ITRR bulletin . He said it was in fact flagged falsely as sponsors of
an anti-tax rally that was scheduled to occur, which in fact had nothing to do with the group. He stated the information
ITRR is providing is "bogus" and questioned the criteria for the various listings. Powers said they are relevant simply as
situational awareness updates.

Senator Robbins asked about the relationship between the FBI and the ITRR bulletins. Powers explained he took
information from FBI advisories and included them along with the ITRR "raw data" in the bulletins. He said he did this to
whittle the information down to Pennsylvania-relevant information.

Senator Dinniman said his concern is that the ability to combat legitimate threats is compromised as a result of the
bulletins, aside from any question of civil liberties. French said he is "clearly concerned" with the broad scope of the
information that ITRR provided .

Regarding the contention that ITRR was the only suitable organization for the contract, Chairman Baker pointed out a
cursory internet search resulted in a number of companies that could be capable of fulfilling its requirements. Powers
pointed out that he submitted a sole-source provider and DGS did its own due diligence and confirmed ITRR was the only
company capable . Chairman Baker pointed out DGS's own research was based on information Powers provided.

Given the potentially tenuous nature of French and Powers' positions, Chairman Baker asked if either have had any
discussions with private employers regarding future work. Both men said that have not.

Frank Pawlowski, PSP Commissioner, described the work of the PaCIC and its "highly-trained intelligence analysts who
provide intelligence briefs, alerts, threat assessments, crime trend analyses, and other information to local, state and
federal law enforcement officers." He stated PaCIC and PSP stand ready to work with PEMA and OHS to address the
intelligence needs of the private sector.

Additionally Pawlowski also assured Cody and anyone else concerned that the FBI is not compiling a list of anti-drilling
activists, and said PSP never placed Cody's name on any list and is not monitoring her emails.

Senator Ferlo asked what citizenship Perelman holds. Perelman confirmed he is an American citizen . Senator Ferlo
pointed out the contract with ITRR is not being terminated but rather is simply being allowed to run its course and will not
be extended. He asked how many employees ITRR has. Perelman stated there are around 15 traditional staff members,
with more than 70 others around the world.

Senator Ferlo roundly criticized ITRR, again calling it a "scam." He questioned Perelman why his Green Drinks event
would have been classified as a "Iow-to-moderate" threat. Perelman said if there is concern about a conflict between two
groups, it is a public safety issue.

Chairman Baker concluded the hearing, noting the testimony presented "clearly raises a number of questions," and stated
the committee will continue to look at the issue.

HB 2321 (consolidation of fire service statutes, consolidation of 911


statutes & enactment of 9-1-1 prepaid wireless surcharge).

HB 2321 passed the House on September 28. On September 29 it was reported, as


amended, from the Senate VA & EP Committee and referred to Senate
Appropriations. It is scheduled to be considered in Senate Appropriations on
October 12. After coming out of Appropriations, the Senate plans to pass it before
they recess. The House plans to pass it on concurrence when they come back
after the elections .

Residential Fire Sprinklers.

We are monitoring legislation to exclude residential fire sprinklers from the


Pennsylvania Uniform Construction Code ("UCC") Act. Specifically, we are
monitor ing HB 1196 which would amend the UCC. There has been discussion that
the Senate may try to amend HB 1196 to delay implementation of the sprinkler
requirement for one year. The Fire Commissioner has stated he will send a letter to
the Governor recommending that he veto any bill that delays implementation of
residential fire sprinklers.

enforcement provIsion ensuring that volunteer fire companies with liquor licenses
distribute a certain amount of the profits to the firefighting operations.

Federal Disaster Declaration.

We are continuing to process payments for the counties and municipalities that are
receiving reimbursement for their snow removal costs under the Federal Disaster
Declaration for the February snowstorms.
