PAKYAW AGREEMENT

KNOW ALL MEN BY PRESENTS:

This AGREEMENT, made and entered into this ____ day of _____________________ at Gen.
Macarthur Eastern Samar by and between the Local Government Unit Represented herewith by
the Punong Barangay and duly authorized for the purpose and hereafter referred to as the
PAKYAW GROUP and herein represented by their Pakyaw Group Leader
_________________________________.

WITNESSETH:

1. That the consideration of the rates in the SCHEDULE OF WORK, attached as Annex B to
this agreement and made an integral part thereof, the PARTIES hereto covenant
amount of ______________________________.
2. That the Pakyaw Group completes the work in accordance with the corresponding
plans and specification, under the survision of the site supervisor appointed for the
purpose by the Punong Barangay.
3. That the Pakyaw Group shall further comply with all the terms and conditions of this
contract more specifically those contained in the following documents:

Annex “A” General Conditions of Pakyaw Agreement”

Annex “B” Schedule of Work
Annex “ C” Application to Undertake Work by “ Pakyaw System”

4. That the Pakyaw Group agrees to commence work within three (3) days upon singing
of this contract and to complete the same within _____ calendar days, Sunday and
legal holidays included.
5. That the Pakyaw Group shall submit to the Barangay Captain/project management
office a periodic report on the time records of the workers, the group accomplishment
and corresponding payments made thereof.

We, the undersigned all of legal age, Filipino and member of the Pakyaw Group, hereby
apply to undertake the work described in the “Invitation to Pakyaw Group for Contact No. (S)01

WE are a team of workers willing to undertake the work jointly under the direction of the
Punong Barangay or his duly authorized representative.

This will also authorized ________________________________, who has been elected as

Pakyaw Group Leader to make representations, sign documents and receive for and in behalf of
the group.

ANNEX “A” to PAKYAW AGREEMENT

GENERAL CONDITIONS OF PAKYAW AGREEMENT

1. All works called for under this agreement shall be in accordance with the plans and
specification. Any deviations from this plans specification must be ordered in writing by the
Engineer.

2. The works shall be carried out using number of hours operated by the equipment methods
under the direction of the Engineer.

3. The Engineers may stop or suspended the works at any time be deem it to be necessary
by informing the PAKYAW GROUP in writing such cases payment shall be made based on
the amount works completed.

4. The quantities and amount entered in the schedule of works, the estimates only, payment
will be based on the actual accomplishment on completion of the work and acceptance
by the Engineers.

5. Entering payments may be allowed at the discretion of the engineer and shall be based
on the partial accomplishment. Ten percent (10%) of any amount shall be retired by the
implementing agency retention money pending completion of works and acceptance of
the Engineer.

6. If the opinion of the Engineers the work is not performed in accordance with the plans and
specification and is unreasonably delayed when the contract may be terminated and
claims for partial payment shall be based on the completed work acceptance to the
Engineer.

7. The IMPLEMENTING AGENCY shall not be liable for any obligation arising from the injury
sickness, disability or death of the group members.
