Fixed Sum Loan Agreement under the Consumer Credit Act


(Key information about your loan)

This document contains some important information about your Phone Plan Consumer Credit Agreement (CCA)
with Telefónica UK Ltd (trading as O2).

We‟ve produced a summary of the Pre-contract information (SECCI) for you to keep. This tells you the amount
of credit you‟ll take and your monthly repayments. You can also have a copy of the Phone Plan CCA to consider
before you sign up. You‟ll also be agreeing to our Pay Monthly Mobile Agreement (Airtime Agreement) which
covers the terms and conditions relating to services under your Airtime Plan (e.g. calls, texts and data on the
O2 network).

Phone Plan Credit Agreement

 Please consider all the information, including this document and the SECCI.
 You are entering into a credit agreement called a “Fixed Sum Loan Agreement” which allows you to pay
back the cost of the device you‟re buying over time.
 The credit provided is for the device only and cannot be used for anything else other purchase.
 The amount of loan will be applied as payment for the device (less any upfront payment you choose to
make). You must pay any upfront payment when signing up.

Change your mind on your device?

 If you change your mind and want to return your device, you can do so within 7 working days of
purchasing it.
 You‟ll need to return it to the same place you bought it.
 You can either return it and cancel your whole Refresh deal (both the Phone Plan and Airtime Plan
agreements) or change it for another device (you can only do this once).

Want to withdraw from the Phone Plan Credit Agreement?

 You can withdraw from the Phone Plan within 14 days (cooling-off period). If you do this after the „7 day
change of mind period‟, you‟ll have to pay the full price of the device.
 The 14 day cooling-off period starts on the day after you sign the Phone Plan Credit Agreement or when
you receive the device (if that‟s later).
 You can choose to continue with the Airtime Plan if withdraw from the Phone Plan within 14 days and
settle the credit amount or if you pay the Phone Plan in full later on. You can then upgrade to a new O2
Refresh deal at any time.

What happens if I miss payments?

 If you do not keep up with the Phone Plan repayments or Airtime Plan payments (either individually or
both together):
 Your device and / or SIM may be barred and only reconnected when your payments are up-to-
date;
 We could require you to repay the full amount of the credit early.
 If you sell the device before the end of the agreement, we could ask you to pay the outstanding balance
on your Phone Plan early.
 Failure to make payments could also mean:
 You may have to pay costs and expenses that we incur enforcing the credit agreement (like legal
costs or admin fees for debt collectors).
 We may take action under your Airtime Agreement.
 Your credit records may be affected, making it more difficult or more expensive for you to borrow
again or take contracts from us in the future.
 If we are ultimately unable to obtain repayment, we may have to take legal action including
bankruptcy proceedings against you.

Other things I need to know and might not expect

 You may also have to repay the amount of credit early if you cancel your Airtime Plan without notice by
porting to another network before settling your Phone Plan.
 If you are in breach of your Airtime Agreement it means we could take action under the Phone Plan Credit
Agreement (e.g. we could require you to repay your Phone Plan early).
 There are other ways you can be in breach of the credit agreement, for example, by becoming apparently
insolvent, and there are other instances of default – ask us for more details.

So what’s next?

 Make sure you read this, the SECCI and your Phone Plan Credit Agreement carefully before you sign.

 If you want more information about you rights under the Phone Plan CCA, contact your local Trading
Standards or nearest Citizens Advice Bureau.
