Limitations of Liability

To the fullest extent permitted by law, the total liability, in the aggregate, of Preferred Electric, Preferred Electric’s, owners, officers, directors, partners, employees, agents, and subcontrac-
tor's, to Customer, and anyone claiming by, through, or under Customer for any claims, losses, costs, or damages whatsoever arising out of, resulting from or in any way related to this
Project or Agreement from any cause or causes, including but not limited to negligence, professional errors and omissions, strict liability, breach of contract, or breach of warranty, shall not
exceed the total compensation received by Preferred Electric or $20,000 whichever is greater. The warrantees listed below in no way certifies, guarantees, or attests to the safety or proper
installation of electrical systems not specifically covered in this invoice. Preferred Electric is in no way liable of damage, failures, fires, or personal injuries resulting from failed electrical
systems or equipment not specifically covered in this invoice.
Definitions
Customer– When the term Customer is used it is referring to the party that order the work and/or paid for the work to be done.
Property Owner—The term Property Owner refers to the legal owner of the property where the electrical work was performed.
Warrantee
Work done on this invoice is eligible for our two-year limited warranty for electrical equipment, devices, wiring and lighting fixtures oother than EE ’s with non-replaceable diodes) supplied
by Preferred Electric excluding bulbs. The warrantee is limited to the repair or replacement of the defective equipment, part, fixture, or installation. Whether to repair or replace the war-
ranted item is at the full discretion of Preferred Electric. Identical fixtures replacement can not be guaranteed through the life of this warrantee; if the fixture is no longer available, or the
cost exceeds original purchase price, a comparable substitute will be used. At the end of the warrantee period the owner of the property assumes full liability for all work described in this
proposal whether or not they were the ones to order and pay for the electrical work.; including but not limited to code compliance, safety, and maintenance. This warrantee is non-
transferable; sale of the property terminates this warrantee period and all liabilities and responsibilities fall on the new owner at time of closing. If any portion of the described work is al-
tered, tampered with, or changed by anyone other than Preferred Electric during the warrantee period, the warrantee is voided. It is the sole responsibility of the Customer to contact Pre-
ferred Electric as soon as possible if any electrical work described in this proposal is suspected to be malfunctioning. Failure to notify promptly could limit the extent of the warrantee, Pre-
ferred Electric is not responsible for the extensive damage to property or per-sons, caused by prolonged use of failed equipment, parts or installation. Preferred Electric is not responsible for
any electrical wiring or equipment not specifically mentioned in this invoice. It is the responsibility of the Customer to notify Preferred Electric immediately if there is any indication that said
warranted items are not working properly, failure to notify promptly voids the warrantee. Any damage to the warranted items that is caused by improper use, such as, but not limited to,
overloading of electrical circuits, will not be covered by this warrantee. amage from other connected electrical failures will not be covered by this warrantee. Except as expressly stated in
this agreement, the Preferred Electric expressly disclaims and negates any implied or express warranty of electrical safety, any implied or express warranty of electrical products for a partic-
ular purpose, and any implied or express warranty of electrical performance of equipment installed. Any unpaid invoices or finance charges voids the warrantee until the account is made
current, accounts paid more than 90 days from the original invoice date or after being sent to collections voids the warrantee.
Acceptance of Agreement
The payment of this invoice will be considered consent to the terms, limitation of liability and warranties listed above. By signing and/or paying this invoice you are acting on behalf the
Customer, property owner or any interested party and warrantee that you have full authorization to accept these terms and are fully satisfied with the work performed on this invoice. The
Customer, property owner or any interested party has 5 days from the first payment of this invoice to make a complaint or contest any of the charges on this invoice or performance of the
work on this invoice, the complaint or challenge of charges must be delivered in writing within 5 days of the first payment or all rights to challenge the invoice is waived by the Customer,
property owner or any interested party. If any provision of this agreement shall be declared by any court of competent jurisdiction to be illegal, void, or unenforceable, the other provisions
shall not be affected but shall remain in full force and effect.
