EXECUTIVE ORDER NO.

“AN EXECUTIVE ORDER REORGANIZING THE BIDS AND AWARDS


COMMITTEE (BAC), BAC SECRETARIAT AND BAC TECHNICAL
WORKING GROUP OF THE LOCAL GOVERNMENT UNIT OF PITOGO,
ZAMBOANGA DEL SUR”

WHEREAS, RA 9184 directs the creation of the Bid and Awards Committee (BAC) and its
Secretariat and Technical Working Group (TWG);

WHEREAS, Section II of RA 9184 and Subparagraph 11.24 of Section II of Rule V of its


Implementing Rules and Regulation, provides that the members of the Bids and Awards Committee
(BAC) shall have a fixed term of one (1) year reckoned from the date of appointment, renewable at
the discretion of the head of the procuring entity;

WHEREAS, there is a need reorganize the Bids and Awards Committee of the
Municipality;

NOW THEREFORE, I, ENGR. JAMES L. YECYEC, Local Chief Executive of the


Municipality of Pitogo, Province of Zamboanga del Sur, do hereby reorganize the members of the
Bids and Awards Committee (BAC), BAC Secretariat, and BAC Technical Working Group as
follows:

SECTION 1a. Composition. Pursuant to Section 11 of RA 9184 and Subparagraph 11.2.2 of


Section 11 of Rule V of its Implementing Rules and Regulation, the Bids and Awards Committee
shall be composed of the following:

SECTION 1b. Secretariat. The following shall be the members of the Secretariat which shall serve
as the main support unit of the Bids and Awards Committee:

Section 1c. BAC Technical Working Group. The following shall be the members of the Technical
Working Group which shall provide assistance to BAC in terms of technical, financial, legal, and
other aspects of the procurement at hand.

SECTION 2a. Functions of the Bids and Awards Committee. The BAC shall have following
functions:

1. Advertise and/or post the invitation to bid/request for expressions of interest;


2. Conduct pre-procurement and pre-bid conferences;
3. Determine the eligibility of prospective bidders;
4. Receive and open Bids;
5. Conduct the evaluation of bids;
6. Undertake post-qualification proceedings;
7. Resolve motions for reconsideration;
8. Recommend award of contracts to the head of the procuring entity or his duly authorized
representative;
9. Recommend the imposition of sanctions in accordance with Article XXIII;
10. In proper cases, it shall also recommend to the head of the procuring entity the use of
Alternative Methods of Procurement as provided in Article XVI of RA 9184; and
11. Perform other related functions as may be necessary, including the creation of a Technical
Working Group from a pool of technical, financial and/or legal experts to assist in the
procurement process.

SECTION 2b. Functions of the Secretariat. The Secretariat shall have the following functions and
responsibilities:

1. Provide administrative support to the BAC and the TWG;


2. Organize and make all necessary arrangements for the BAC and the TWG meeting and
conferences;
3. Attend BAC meeting as Secretary;
4. Prepare Minutes of meetings and resolutions of the BAC;
5. Take custody of procurement documents and be responsible for the sale and distribution of
bidding documents to interested bidders;
6. Assist in managing the procurement processes;
7. Monitor procurement activities and milestones for proper reporting to relevant agencies
when required;
8. Consolidate PPMPs from various units of the procuring entity to make them available for
review as indicated in Section 7 of the IRR of RA 9184;
9. Make arrangements for the pre-procurement and pre-bid conferences and bid opening; and
10. Be the central channel of communications for the BAC with end users, PMOs, other units of
the line agency, other government agencies, providers of goods, infrastructure projects and
consulting services, observers, and the general public.

Section 2c. Functions of the BAC Technical Working Group. The Technical Working Group shall
have the following functions and responsibilities:

1. Assist the BAC in the preparation of the bidding documents, ensuring that the same properly
reflects the requirements of the procuring entity and that these conforms to the standards set
forth by RA 9184, its IRR-A and PBDs prescribed by the GPPB;
2. Assist the BAC in the conduct of eligibility screening of prospective bidders, and in the short
listing of prospective bidders in case of bidding for consulting services;
3. Assist the BAC in the evaluation of bids and prepare the accompanying reports for the
BAC’s consideration and approval;
4. Assist the BAC in the conduct of post-qualification activities and prepare the post-
qualification summary report for the BAC’s approval;
5. Assist the BAC and the BAC Secretariat in preparing the resolution recommending award,
with regard to the technical aspect, if necessary; and

6. Provide utmost priority to BAC assignments over all other duties and responsibilities, until
the requirements for the procurement at hand are completed.

Section 3. Quorum. A majority of the total BAC composition shall constitute a quorum for the
transaction of business provided that the presence of the Chairperson or Vice Chairperson is
required.

Section 4. Meeting. The Chairperson or, in his absence, the Vice-Chairperson, shall preside at all
meetings of the BAC. The decision of at least a majority of those present at a meeting at which there
is quorum shall be valid and binding as an act of the BAC: Provided, however, that the Chairperson
or, in his absence, the Vice Chairperson, shall vote only in case of a tie. Observers and representative
of BAC members shall have no right to vote during BAC meetings, nor shall the representative of
BAC members be authorized to sign in behalf of the member represented.

Section 5. Observers. To enhance the transparency of the process, the BAC shall, in all stages of the
procurement process, invite, in addition to the representative of the COA, at least two (2) observers
to sit in its proceedings;

Section 6. Responsibilities of the Observers. The observers shall have the following responsibilities:

1. Preparation of the report jointly separately indicating observation made on the bidding
activity conducted by the BAC submission to the Head of the Procuring entity, copy
furnished the BAC Chairman. The report shall assess the extent of the BAC’s compliance
with the provision of this IRR-A and areas of improvement in the BAC proceedings. For this
purpose, the BAC shall furnish them a copy of the following documents upon their request:
a. Minutes of related proceedings of BAC meetings;
b. Abstract of Bids;
c. Post-qualification summary report;
d. APP and related PPMP; and
e. Copies of opened proposals

Section 7. Honoraria of BAC Members, Secretariat and Technical Working Group. The grant of
honoraria for BAC members, Secretariat and Technical Working Group shall be subject to the
provisions of Section 15 of Article V of RA 9184 and DBM Budget Circular No. 2004-5.

Section 8. Term of Office. The members of the BAC provided under this Executive Order shall
have a fixed term of one (1) year to be reckoned from the date of the issuance of this Order and
renewable at the discretion of the Head of the Procuring Entity.

Section 9. Guidelines. All procedures and activities of the BAC shall be subject to compliance of the
provisions of RA 9184 and its implementing Rules and Regulations.

SECTION 10. Effectivity. This Executive Order shall take effect immediately and shall be valid
until sooner revoked or amended.
