CONTRACT OF LEASE

KNOW BY ALL THIS PRESENTS:

This CONTRACT OF LEASE made and entered in the Brgy. Balayhangin Calauan Laguna
Phillipines by and between.

Deo Carpio of legal age, Filipino and resident of


Brgy. Balayhangin Calauan Laguna here after called the “LESSOR”:

Socorro D. Barte of legal age, Filipino and resident of


Brgy. San Benito Alaminos Laguna here after called the “LESSEE”:

WITNESSETH: That

WHEREAS, The LESSOR is the proprietor and owner of the (6,000) six thousand sqm. of lot
area situated at Brgy. Balayhangin Calauan Laguna Phillipines and therefore hereby
appoints Pablito M. Alcantara as the LESSOR’s representative.

WHEREAS, The LESSEE intends to rent (6,000) six thousand sqm. of lot area thereof; and
hereby appoints Laarni Shyr B. Chavez as the LESSEE’s representative.

Now therefore for and in consideration of the foregoing premises and mutual covenants
contained herein, the LESSOR hereby leases the LEASED PROPERTY to the LESSEE
and the LESSEE hereby accepts the same from the LESSOR, under the following terms
and conditions:

1. TERM of LEASE

The lease shall start on November 1, 2019 and shall end on October 31, 2024
with an option to renew under such terms and conditions mutually agreed upon
by both parties.

That if the LESSOR or the LESSEE decides after the term to not renew the
contract, the LESSEE shall have (2) two months grace period after the term
ends to pull out from the property.

That if the LESSEE decides before the term to end the contract the LEESEE
shall give (30) thirty days prior notice to the LESSOR before the pullout from the
property.
2. RENTAL

The LESSEE shall pay (P 20,000.00) Twenty Thousand pesos annually in (5)
five years total lease period with the total amount of (P 100,000.00) One
Hundred Thousand Pesos at the end of contract.

That if the said payment will not be returned, the LESSEE shall have the right to
finish the (5) five years term-contract with (2) months grace period after term
expiration.

That payment for electricity, water and the likes shall be paid by the LESSEE
upon the coverage of the contract term.

3. USE OF PROPERTY

a. Purpose of Lease. The Leased Property shall be used exclusively by the


LESSEE as they deemed fit for their purpose.

Inclusions:

 All fruit bearing trees in the property except for (6) six Lanzones trees
and (2) Rambutan trees shall be under the LESSEE’S discretion, sale
and use.
 All trees and plants in the property shall be used upon the discretion of
the LESSEE.

b. That no fruit bearing tree shall be cut down or removed without the consent
of the LESSOR, owner/ representative.

c. That the property shall not be used in any Illegal purpose or acts.

d. That the property shall be used upon the discretion of the LESSEE.

4. SUB LEASE:

The LESSEE shall not directly or indirectly sublet, allow or permit the leased
premises to be occupied in whole or in part by any person, form or corporation,
neither shall the LESSEE assign its rights hereunder to any other person or
entity and no right of interest thereto or therein shall be conferred on or vested in
anyone by the LESSEE without the LESSOR’S written approval.

5. FORCE MAJEURE

If the whole or any part of the leased premises shall be destroyed or damaged by
fire, flood, lightning, typhoon earthquake, storm, riot or any other unforeseen
disabling cause of acts of God, as to render the leased premises during the term
substantially unfit for use and occupation of the LESSEE, then this lease contract
may be terminated without compensation by the LESSOR or by the LESSEE by
notice in writing to the other.

6. LESSOR’S RIGHT OF ENTRY

The LESSOR or its authorized agent shall after giving due notice to the LESSEE
shall have the right to enter the premises in the presence of the LESSEE or its
representative at any reasonable hour to examine the premises.

7. IMPROVEMENTS:

Any improvements made or to be made, the LESSEE should inform the


LESSOR and that the expenses incurred is not deductible to the lease. At the
end of the contract, the LESSEE has the option to remove non-permanent
improvements or structure as deemed necessary, while the LESSOR can
demand the removal of the structures built if deemed necessary.

8. TAXES AND INSURANCE

All real estate taxes levied or assessed on the Leased Property and the following
insurance (if applicable) shall be for the account of the LESSOR.

9. JUDICIAL RELIEF

Should any one of the parties herein be compelled to seek judicial relief against
the other, the losing party shall pay a amount of One Hundred (100) % of the
amount claimed in the complaint as attorney’s fees which shall in no case be less
than P50,000.00 pesos in addition to other cost and damages which the said
party may be entitled to under the law.

10. This CONTRACT OF LEASE shall be valid and binding between parties, their
successors- in- interest and assigns.
