PETITIONER, respectfully manifest:

1. That your petitioner is a Filipino citizen, of legal age, widow, with residence at
39 Purok 2, Brgy. Saimsim, Calamba City, Laguna, respectfully manifest:

2. That, I am the registered owner of a parcel of land situated in Brgy Saimsim,


Calamba City, Laguna with an area of 2,553 square meters embraced in TCT No. 060-
201601015868 issued on 21st day of July 2016;

3. That on page 3 of the aforesaid certificate of title appears an annotation under


Entry No. 2016019535 dated July 21, 2016 “ LIABILITIES UNDER SECTION 4
RULE 74: TO CREDITORS, HEIRS, AND OTHER PERSONS UNLAWFULLY
DEPRIVED OF PARTICIPATION IN THE ESTATE OF DECEASED SECERINO
VILLA, AS EXTRAJUDICIALLY SETTLED FOR A PERIOD OF TWO (2) YEARS
PURSUANT TO SECTION 4 RULE 74 OF THE RULES OF COURT, DATE OF
INSTRUMENT: April 16, 2008. SGD. . ATTY. CASIANO C. ARCILLAS, REGISTER
OF DEEDS .”

4.. THAT two (2) years had elapsed without anybody registering any claim against
said property, hence said annotation has lost its efficacy by virtue of the expiration of
the two (2) years time frame from July 21, 2016 todate, as mandated by PD 1529;

WHEREFORE, it is respectfully prayed of this Honorable Office to cancel said


annotation appearing in the said title to clean our Title, in the interest of justice and
equity, pursuant to PD 1529.

That we are the registered owner of a parcel of land containing 2,553 square
meters embraced in TCT NO. 060-2016015868 issued by the Registry of Deeds for
Laguna, Calamba Branch, Calamba City, on 21 July 2016;:
That this petition was filed based on our personal knowledge and
authentic records;
That we certify under oath to the truth of the foregoing facts and that no other
petition/case was filed in any court/quasi/judicial/administrative bodies and If we could
learn of one, we undertake to inform the court of origin of its existence within
5 days period;

AFFIDAVIT OF DISCREPANCY

I, LORNA MAYON BAUTISTA, Filipino citizen, of legal age, widow, with


residence at B2 L4 Bayshoreville, Brgy. Sinalhan, Sta Rosa City, Laguna, after having
been sworn according to law, hereby depose and say:

THAT, I am the registered owner of a parcel of land situated in the Brgy. Dela
Paz, Binan, Laguna with an area of 327 square meters, more or less, covered by TCT
No. 060-2017010962 issued by the Register of Deeds for Laguna, Calamba Branch,
Calamba City, on June 7, 2017, Xerox copy of Title is attached as Annex “A” made
part hereof;

THAT, a DISCREPANCY was noted in the Technical Description of said Title


with regards to “ PSD-389654”;

THAT, to correct said DISCREPANCY the Technical Description of said Title


should be “ PSD-389564” as correctly described in the old TCT NO.T-473448, attached
as Annex “B” made part hereof;

WHEREFORE, it is respectfully prayed of this Honorable Office to correct the


deficiency noted in the said title in the interest of justice and equity, pursuant to PD
1529.

Sta Rosa City, after having duly sworn to in accordance with law, hereby state:
1. I am the registered owner of a parcel of land in the above-entitled petition,
and caused the preparation of the foregoing petition and I have read and understand all
the allegations contained therein, the same being true and correct of my personal knowledge and
authentic records.
2. I certify under oath to the truth of the foregoing facts and that no other
petition/case was filed in any court/quasi/judicial/administrative bodies and .
If I could learn of one I undertake to inform the court of origin of its
existence within 5 years period;
