This Judicial Affidavit, signed and executed by ___________ is respectfully submitted to

this Honorable Court to serve as his/her direct testimony in this complaint for direct bribery
punishable under THE REVISED PENAL CODE art. 210 against ATTY. JOHN DOE.

This Judicial Affidavit is offered to: (1) prove all the material facts and allegations stated
in the Information; (2) to identify his/her Affidavit Complaint including all the exhibits attached
therein, which he/she respectfully requests to be correspondingly marked as EXHIBITS “__” TO
“__”, respectively, and (3) all other pertinent matters related thereto, with reservation to present
additional exhibits in the course of the proceedings of the instant case.

The following questions were propounded by Assistant City Prosecutor _________, in

English (Tagalog), which the affiant fully understands, while ANSWERS were given/made by
witness ___________, in English/Tagalog dialect and the corresponding translation of his answer
is provided after each question.

1. Please state your name, age, residence address, and occupation.

2. Do you remember having executed any pleading regarding this case?

Yes Sir, I executed an Affidavit-Complaint.
3. Showing you this document, which we request mark as our Annex “A” entitled,
Affidavit-Complaint. Is this document you are referring to?
Yes Sir. That is the same document.

Manifestation: Your Honor please, we request that the document we hereto attach and mark as
Annex “A” be marked as our Exh “A”.

4. Do you know the accused in this case, John Doe? Under what circumstances did you
come to know him?
Yes Sir, I fully know him because he is one of the employees in my office, Department of
xxx.

5. Where is your office, Mr. Witness?

Our Office is at ….xxx….Makati City

6. Can you please tell this Honorable Court why you filed this complaint against John Doe?
 Because I came to learn that he accepted money from one of the bidders, ABC Corp. so
that the latter’s competitor, XYX Corp., would not be included in the shortlist of
accredited suppliers despite the fact that XYZ Corp. has all the qualifications.

7. By the way, what is the position or rank of John Doe in your office?
He is the ….xxx….

8. Since when did he hold that position?

He held the position since,….xxx…Sir.

9. What are his responsibilities as the …xxx… of your office?

10. You mean to say, Mr. Witness, that he holds influence in the approval or disapproval of
bidding activities?
Yes sir.

11. What is in his position that wields him influence in the bidding process?

12. Under what circumstances did you come to know that he received from ABC Corp. for
such malicious purpose?

13. Do you have any proof of such incident?

Yes, an affidavit from one of his employees who knew of the transaction.

14. Showing you this document, which we marked as our Exh. “B” entitled, Affidavit. Is this
the document you are referring to?
Yes Sir.

15. You mean, Mr. Witness, that you have no personal knowledge of the said transaction
between John Doe and ABC Corp.?
I was not present Sir, but as the head of the Department, I came to know during the
investigation that indeed, John Doe was bribed by ABC Corp.

16. You mean to say that there was investigation conducted?

Yes Sir, to give him the opportunity to rebut the allegations against him.

17. Do you have the result of such investigation?

Yes Sir, the report of the fact-finding committee where I am the chairman.

18. Showing you this document, which we marked as our Exh. “C” entitled, Investigation
Report on John Doe. Is this document you are referring to?
Yes Sir, that is result our investigation.

 19. Mr. Witness, what other evidence do you have, if any, that John Doe received money
from ABC Corp.?

20. What happened to ABC Corporation’s bid to be included in the shortlists?

We immediately rectified the situation by including XYZ Corp. as one of the accredited
suppliers.

21. What other actions did you do against ABC Corp.?

We also filed a criminal case for graft and corruption and the same is now pending at …

22. In the case of John Doe, what other actions did you or your office do against him?
We immediately filed for his preventive suspension an right now, he is …xxx
