JOINT JUDICIAL AFFIDAVIT

We, JAY-ARR S. MIRANDA AND FREZAMAE O.


MIRANDA, both of legal age, married to each other,
Filipinos and residents of Lot 7, Block 9, Villa Estefania
Subdivision, Brgy. Estefania, Bacolod City hereby depose
and state:

1.That we were examined by Atty. Juniven Rey S. Umadhay,


a lawyer engaged in the private practice of law, in his
office at Block 17, Lot 3, Sancaville Subdivision, Brgy.
Rizal, San Carlos City;

2. We are answering the following questions asked of us,


fully conscious that we do so under oath and that we may
face criminal liability for false testimony or perjury;

3. The questions asked of us and our answers thereto are as


follows:

Q1 : Are you the same Jay-arr S. Miranda and Frezamae


O. Miranda, the petitioners in case?
A1 : Yes, sir.

Q2 : If a copy of the Petition you filed in relation with this


case is shown to you, would you be able to identify
the same?
A2 : Yes, sir.

Q3 : I am showing you a Petition marked as EXHIBIT


“A” for the petitioner, what relation has this
document to the petition you filed in relation with
this case?
A3 : This is the same Petition, we filed for the adoption of
the minor Christine Higtenta.

Q4 : On page 6 of the Petition is a signature above the


name Jay-arr S. Miranda and Frezamae O. Miranda,
do you know whose signatures are these?
A4 : Yes, sir, that is our signature appearing above our
respective names.

Atty. Umadhay : I would like to request that the


signatures appearing above the names Jay-arr S.
Miranda and Frezamae O. Miranda found on page 6
of the Petition be collectively marked as Exhibit “A-
1” for the Petitioner.

Q5 : Do you know whose signature appears above the


name of the subscribing officer Juniven Rey S.
Umadhay?
A5 : Yes, sir. It is your signature which you affixed in our
presence after we signed above our respective
names.

Q7 : Have you read and understood the contents of your


Petition?
A7 : Yes, sir.

Q8 : Do you affirm and confirm before this court the


truthfulness of the allegations stated therein?
A8 : Yes, sir.

Q9 :You mentioned in your Petition that you are married to


each other as attested to by your Certificate of
Marriage. If a copy of your Certificate of Marriage is
shown to you, would you be able to identify the
same.
A9 : Yes, sir.

Q10 : I am showing you a Certificate of Marriage marked as


EXHIBIT “B” for the petitioner, what relation has
this document to your Certificate of Marriage?
A10 : This is our Certificate of Marriage.

Q11 : Do you know Christine Higtenta?


A11 : Yes, sir. She is a minor held under the custody of
Department of Social Welfare and Development after
being committed by her biological parent.

Q13 : What is your proof that Christine Higtenta was the


person voluntarily committed by her parent at
Department of Social Welfare and Development?
A13 : We have the Certificate of Live Birth of Christine
Higtenta attesting that he was born on March 26,
2017. We had a copy of his Certificate of Live Birth
attached to the Petition.

Q14 :I am marking the Certificate of Live Birth of Christine


Higtenta attached to the Petition as EXHIBIT “C”,
do you confirm my actions?
A14 : Yes, sir.

Q15 : Can you tell the court about yourselves, particularly


your educational and professional backgrounds?
A15 : I Jay-arr Sevilleno Miranda, 33 years old. Both my
parents are alive. I am a graduate of Bachelor of
Elementary Education major in Science and Health. I
graduated on March 2008 and became a licensed
and professional teacher after passing the Licensure
Examination for teachers.

I used my license as a professional teacher to enter


the Bureau of Jail Management and Penology. I took
my oath as a Jail Officer on November 17, 2009. I
am presently in my 9th year in government service.

I, Frezamae O. Miranda, 33 years of age. I am a


graduate of Bachelor of Science in Biology at the
Northern Negros State College of Science and
Technology. I am the eldest of the six off springs of
Mr.____ and Mrs._____.

Although, I was offered of many work opportunities,


I preferred to be a housewife to able to properly take
care of Christine Higtenta and my husband.

Q16 : What documentary evidence do you have to prove


such fact?
A16 : I have a Certificate of PRC Board rating and a BJMP
Identification Card.

Q17 : I am marking the PRC License you presented as


EXHIBIT “D” and “D-1”, your Bureau of Jail
Management and Penology (BJMP) Identification
Card, respectively, do you confirm my actions?
A17 : Yes, sir.

Q18 : You mentioned that you are residents of Block 29, Lot
9, Phase 5, Charito Heights subdivision, Brgy.
Granada, Bacolod City, Negros Occidental.
A18 : We have here a copy of our title to the property
where we maintain residence denominated as
Transfer Certificate of Title No. 092-2016003415;

Q19 : I am marking this Transfer Certificate of Titles as


“EXHIBIT E” do you confirm my actions?
A19 : Yes, sir.

Q20 : How did you know Christine Higtenta, the child you
seek to adopt?
A20 : We first came to know Christine when we went to
DSWD who said if we are amenable to adopt a child.
We were told that the department has custody of
children who were voluntarily committed by their
biological parent for the purpose of having them
available for adoption.

Q21 : How did you react that the department has this
program, wherein they can help you adopt a child?
A21 : We were equally thrilled since we had long been
praying for a baby to come. We both had this
discernment that the prospect for adoption was
God’s answer to our prayer. We had this strong
feeling that Christine was the child we have been
praying and waiting for.

Q22 : What did you do after you decided to adopt the child?
A22 : We went to DSWD.

Q23 : What happened when you went to the DSWD?


A23 : We were told by the attending DSWD Officer that a
Child in the person of Christine Higtenta has just

been Voluntarily Committed by her biological mother


and is available for adoption.

Q24 : Since you never had children, how are you able to
cope with the physical, financial, emotional and
mental demands of parenting, caring and rearing
Christine, now and in the near future?
A24 : With our age, we are both physically able to tend to
the needs of and keep pace playing with Christine.
We have no medical nor mental condition that
unable us to address the demands of parenting. We
do not smoke nor ingest alcohol. I, Jay-arr is a Jail
Officer, a regular government employee that enables
me to provide for the needs of my family while I,
Frezamae, a housewife, can take care of Christine.
We both are not in any manner engaged in
gambling, immoral nor illicit activity. We are
practicing Christians intending to raise and mold
Christians according to the teachings of our faith.

Q25 : What proof can you show to the court that you are
physically fit and able to comply with the physical
demands of parenting?
A25 : We have here our Medical Certificates attesting to
our clean bill of health issued by Dr.
________________.

Q26 : What proof do you have to show that you are


mentally, emotionally and financially capable of
raising Christine?
A26 : We have here a copy of our Police Clearance,
Municipal and Regional Trial Court Clearance, NBI
Clearance and Brgy. Clearance, attesting that we
are of sound mental and emotional health and never
had any brush with the law. I also have an Annual
Tax Return to attest our financial capacity to provide
for the needs of Christine.

Q27 : I am marking your Medical Certificates, Police


Clearances, Municipal and Regional Trial Court
Clearances, NBI Clearances, Brgy. Clearances, and
Income Tax Return as EXHIBITS “F” and “F-1”,
“G” and “G-1”, “H” and “H-1”, “I” and “I-1”.

“M”, respectively, do you confirm my actions?

Q28 : You mentioned that the biological parent of Christine


voluntarily gave her for foster care and adoption,
what documentary proof do you have to prove such
fact?
A28 : They both signed a Deed of Voluntary Commitment
with the DSWD who attests to such fact its Affidavit
of Consent to Adoption thru its _______________,
DSWD Officer certifying that Christine is legally
available for adoption.

Q29 : I am showing you an Affidavit of Consent to Adoption


executed by the ________________of the DSWD,
what relation has this document to the Affidavit of
Consent you are referring to?
A29 :This is the same document.

Q30 : I am marking this Affidavit of Consent to Adoption as


EXHIBIT “N”, do you confirm my actions?
A30 : Yes, sir.

Q31 : Who currently takes care of Christine, if you know?


A31 : Frezamae has been the one who takes care of
Christine whenever I, Jay-arr has a duty. However,
during my off-duty, we both take care of Christine.
We read her bedtime stories before she goes to
sleep.

During summer or school breaks, we both would


bring Christine to Cadiz City where both of our
parents are residing for vacation. We had always
treated, loved and cared for Christine as our own
child. She recognizes us as her parents.

Q32 : What are your future plans for Christine?


A32 : We intend to raise Christine in our home Block 29, Lot
9, Phase 5, Charito Heights subdivision, Brgy.
Granada, Bacolod City, Negros Occidental, and send
her to a school best suitable for her learning needs
that would maximize her full potential as a person.
We want to inculcate in her the value of Christian
education and social responsibility by living a life that
exemplify the values we teach her.

established during the period of your cohabitation.

Q34 : How is Christine doing at present?


A34 : She is a happy, loving and active child. She likes to
cuddle with me as her mother and likes to horse play
with me (Jay-arr). She has established a strong
emotional attachment with us as her recognized
parents. We have our family photos showing how
we are together as a family.

Q35 : I am marking these photographs and MV Registration


as EXHIBIT “O” and “P”,do you confirm it?
A35 : Yes, ma’am.

Q36 : What is your purpose in filing the present Petition?


A36 : We want to obtain a court order that would provide
Christine all the rights and privileges accorded by the
law to a legitimate child. We want Christine to be
able to legally carry our surname to dispel any
confusion that may arise why her surname is
different from ours, her parents. We also want to
include her as our dependent and beneficiary in our
social security records and investments. We want to
protect her successional rights in our estates and
obtain the court’s imprimatur in our exercise of
parental custody and authority over her person.

Q37 : With that purpose in filing the present Petition, what


is it now that you ask from this court?
A37 : It is our prayer that after due notice and hearing, our
Petition for adoption be approved and granted and
that the name of Christine Higtenta be changed to
Kristin O. Miranda.

5. We are executing this Judicial Affidavit in order to attest


to the truth of the foregoing statements.

6. We certify that the photocopies of the documentary


exhibits marked and attached to our Petition are faithful
