AFFIDAVIT OF ARRESTING OFFICER

I, PO3 Yndrei Dela Pena, of legal age, bonafide member of the Philippine National
Police and presently assigned with Southern Police District, Pasay City Police, Donada
Police Community Prescint, after having been duly sworn to in accordance with law,
hereby depose and state that:

1) I am the officer tasked to be with the team composed of Rizza Mangalleno

(Informant), PO1 George Almeda – Assistant City Drug Enforcement Officer, PO1
Edgardo Lara, and PO1 Von John Magallanes, to conduct the buy-bust operation
which happened in a carinderia located at Donada cor. Menlo Sts., Pasay City;

2) On 10th August 2019, at around 3 o’clock in the morning, I, together with my team,
proceeded to station ourselves near the church. PO1 Von John Magallanes with
our informant, stationed themselves in a table near the door of the said carinderia,
while PO1 Magallanes, Lara and Almeda positioned themselves in the opposite
table, in front of the table to which I and the informant was positioned;

3) As agreed upon by the team, the informant, called the accused Jonnel Bediones
and told him that there was a customer who was interested in purchasing
Metamphetamine Hydrochloride or known as “shabu”;

4) As agreed upon by our team, we waited for the signal of PO1 Von John Magallanes
to raise his cap signaling to us that the exchange was already complete;

5) After Mr. Bediones realized that this was a buy-bust operation, he quickly run
towards the direction of Taft Avenue to evade arrest;

6) Fortunately, with the help of the team, I was able to arrest Mr. Bediones in front of
the San Isidro Labrador Church after chasing him;

7) That at the time I apprehended Mr. Bediones, I informed him of his constitutional
rights and a body search was conducted to him, yielding various items;

8) Mr. Bediones was brought to the prescint after the body search and right after the
inventory of the seized items were made;

9) That due to the operation being conducted in the early hours of the morning, and
after calling media representatives stationed at Pasay Central Police Station, there
being none, and due to the fact that the place of the arrest was too dim, the actual
physical inventory, markings and taking of photographs at the Donada Police
Community Prescint witnessed by the suspect himself in the presence of Barangay
Kagawads Michael Prades, Gianna Cantoria, Celine Garcia, and Cha Gomez of
Brgy. Labrador, Pasay City;
 10) Mr. Bediones was later brought to Pasay Police Medical Laboratory for
medical/physical and laboratory screening test while the confiscated pieces of
evidence were turned-over by the investigator-on-case to Pasay Crime Laboratory
at about 3:05 pm of 10th August, 2019 for chemical analysis.

That anything not mentioned in this affidavit will be narrated during proper trial;

That I executed this affidavit to attest the truthfulness of the above narrated facts and to
support our charge for violation of Sec. 5 of Art. II, RA 9165 against the above-named
suspects.
