1. Sinclair is on a limited income of $674.00 per month.

2. Sinclair does not have the financial means to make a trip to Washington,

DC from Chattanooga, TN under such short notice due to some economic hardships

that have caused him to already expend his monthly budget.

3. Sinclair has offered to make the necessary arrangements to appear for a

Status Conference on either January 19, 20, 26 or 27, 2011 and counsel for all parties
have confirmed their availability on January 26, 2011, if that date is also convenient for

14 4. This request is unopposed and no parties will be prejudiced by said

16 Should this Honorable Court find that a request for a continuance cannot be
17 granted, Sinclair moves for leave to appear by telephone on December 22, 2010.
