You will need to research qualifications for charitable

organizations in Canada. I will need it as detailed as


possible and I can revise it when you are finished. Here
is some requirements:

PROCESS OUTLINE:

1. Set up your organization before applying for registration


a. Determine/describe your CHARITABLE PURPOSE
b. Pass the public benefit test
c. Create a governing document
d. Designation – CRA will designate you as a specific type of charity based on
your application.

On June 1, 2019, the Canada Revenue Agency launched a suite of digital services, including an online application form that
replaces Form T2050, Application to Register a Charity under the Income Tax Act. The new online application is accessible
through: My Business Account.

1. SET UP YOUR ORGANIZATION BEFORE APPLYING FOR REGISTRATION:

a. Charitable Purpose
An organization’s governing document must clearly state its purpose(s), and each stated
purpose should identify the three elements either expressly, or implicitly through its
context.

A purpose should identify three elements:

First element – The charitable purpose category


Establish that the purpose falls within one of the four broad categories of charity:

1. relief of poverty
2. advancement of education
3. advancement of religion
4. certain other purposes that benefit the community in a way the courts have said
is charitable

For the first three categories of charity – this element is usually met by including
the purpose category in the wording of the purpose.

For purposes in the fourth category of charity (other purposes beneficial to the community
in a way the law regards as charitable) – the specific purpose descriptor within the
broad purpose category must be identified Example:
promoting health by providing the public with:
 medical diagnostic services
 in-patient or out-patient medical care and nursing services

relieving conditions associated with aging to individuals affected by these


conditions by providing:
 personal care
 shopping assistance
 transportation to medical appointments

advancing the public’s appreciation of the arts by providing the public with:
 high-quality performances of classical choral works
 free, high-quality theatrical performances

Second element – The means of providing the charitable benefit


Define the scope of the activities that can be conducted to directly further the purpose
and ensure the provision of a charitable benefit (for example, “by providing housing,” “by
operating a school,” “by conducting prayer services that advance the teachings of Islam,”
or “by operating a hospital”)
Third element – The eligible beneficiary group
Ensure the charitable benefit is provided to the public or a sufficient section of the public
(for example, “for the poor” or “for the general public”)

**The wording of a purpose is, therefore, very important. A purpose that is worded in
language that is too broad or vague may not be eligible for charitable registration**

Charitable Purpose:

 relief of poverty
 advancement of education
 building houses

- Build schooling, housing and water systems to villages


- Help restore orphanages
- Bring volunteers to teach (English, sports, music)

Fundraising in the city by way of

food drives

Getting volunteers together to come together to do workshop to help other learn how to
build

Partnering up with colleges/universities

Partnering with ground charities and identifying needs

Establishing key volunteers (screening process)

Building our network in the city of volunteers and coordinators, teachers that will help in
the city and abroad.

Building schools where we employ teachers locally along with recruiting volunteer
teaching staff from abroad (colleges/uni).

b. Execute a Governing Document


All registered charities (other than internal divisions* of existing registered charities) must
be legally established by a governing document such as:

 letters patent
 articles of incorporation
 a constitution
 a trust document

What type of governing document should be included with an application?


The type of governing document required depends on whether an organization intends
to operate as a charitable organization, or as a public or private foundation.

 Charitable organizations must be incorporated or established by a constitution


or a trust document.
 Public or private foundations must be incorporated or established by a trust
document.

Charitable organization

 it is established as a corporation, a trust, or under a constitution


 it has only charitable purposes
 it primarily carries on its own charitable activities
 it has more than 50% of its directors, trustees, or like officials dealing with each
other at arm's length (meaning, they must be unrelated to each other)
 it generally receives its funding from a variety of arm's length donors

**The Charities Directorate will not review applications submitted with draft governing
documents. These applications will be treated as incomplete and returned to the
applicant. To submit a complete application, you must include certified governing
documents.

If an organization seeking registration as a charity owns, or intends to own, land or


buildings, we recommend that it become incorporated so that it can hold title to the
property. An unincorporated charity may have property held in trust by trustees acting
on behalf of the charity.**

2. APPLY FOR REGISTRATION


Online form to apply for registration

To apply to be a registered charity under the Income Tax Act,


complete the online form available through My Business
Account (MyBA).

Applying for registration for the first time


You are the director or trustee of an organization that wants to apply
to become a registered charity:
If your organization has a business number (BN) (for example
because it is incorporated or already has another CRA program
account):

1. Go to Business Registration Online to obtain a pending RR


account.
2. Go to CRA login services, select “My Business Account” and use
your CRA user ID and password to login.
3. Once logged into MyBA, select “Manage business number(s) in
your profile”, and then select “Add a business” to add your
organization’s BN.

If you don’t have a BN:

1. Go to Business Registration Online to obtain a BN and a pending


RR account.
2. Go to CRA login services, select “My Business Account” and use
your CRA user ID and password to login.
3. Once logged into MyBA, select “Manage business number(s) in
your profile”, and then select “Add a business” to add your
organization’s BN.

Tips about the online form


1. The online form walks you through the application process. You
will only be asked for additional information on certain items
depending on whether you say yes or no to previous questions,
or check certain items on a list.
2. Progress bars and status indicate which sections you’ve
completed, started, or haven’t started yet.
3. You can review and make changes to a section at any time.
4. Be ready to provide detailed information for each charitable
activity your charity currently carries out or proposes to carry out.

5. Start and stop the form at any time. Clicking “next” saves the
information up to that point.
6. Multiple individuals can take turns and log into MyBA to complete
different sections of the form.
7. At the end of the application you will be asked to upload all
required documentation, such as governing documents,
pamphlets, agreements, and financial statements.
8. You can only submit your application once you have answered all
mandatory questions and uploaded all mandatory documents.
9. You can view and print a summary of your application.
10. Once you have submitted your online application, you can
track your application status by logging into MyBA, and selecting
“View application status” under your RR account.

Describe your CHARITABLE ACTIVITIES


In the section on Purposes and activities of the Application to be a
registered charity under the Income Tax Act, you must describe in clear
detail each charitable activity you will undertake to achieve each of
your stated charitable purposes and show how it provides a benefit to
the public.

When describing a charitable activity, keep the following points in


mind:

 what you want to achieve


 how you're doing it – detailed plans
 who the beneficiaries are and how they are selected
 any fees charged
 frequency and length of the activity
 involvement of employees and volunteers
 how you maintain direction and control over activities and
resources
 other logistics (transportation, facilities, etc.)

In addition to your description of the activity, you will also be asked


to provide the following information:

 activity start date


 details of intermediaries and other partnerships
 location(s) of activity
 anticipated expenditures for this activity
 purpose the activity supports
Example of an activity description
Activity: Classes on employment life skills
The Northern Education Society is focused on providing job-skills
training to individuals in isolated Northern communities, in an effort to
relieve poverty.
The Society will host a two-hour class every Monday and Wednesday
evening, at the Northern Community Centre. Classes will consist of
lesson plans focusing on life skills to assist participants to obtain and to
maintain employment, such as effective time management and
budgeting. Participants will also have access to the centre’s computers
and will be introduced to Microsoft Word, Excel, and Outlook, to learn
computer skills. Examples of course material are attached. Each class
will be facilitated by two volunteer instructors who currently work in the
education field.
The classes will be offered to anyone in the community at no charge,
but will be limited to 10 participants per session. The training will be
advertised throughout the community, and participants will be selected
on a first-come, first-serve basis.
In addition, each Tuesday and Thursday evening, volunteers will be
available at the Northern Community Centre to provide one-on-one
assistance with resume building and job interview preparation. The
Society will focus on recruiting volunteers who have experience in
human resources and/or management, and this service will be available
to residents of the community at no charge.

OUR MISSION
KNOW is a non-profit organization (charity) with a
vision to help minority communities. Our goal is to
provide youths, young adults and individuals new to
the community with essential tools and education for
employment and how to be proactive in their day to
day lives.

Helping out the new-comers settle in with providing


them with the proper support and guidance. Educating
the youth and helping them with their future goals.
Here is a basic outline.
Fundraising will create things to do in the community
while raising funds for food drives. And essentially
building houses overseas and possibly within Canada
for those who can not afford housing. We want to
educate the less fortunate on ways to create wealth
through real estate. We want to make sure there are
after school activities so youths don’t have an idle
mind. We want to teach language dance sports and
trades by having a community gathering.we believe
the only way to have unity is within the community.
