CASE BRIEF/UPDATE

OFW JERSON ENRIQUEZ, ET AL.


13 OFWS HIRED BY THE INTERNATIONAL EXPERTS FOR TECHNICAL
SUPPORT SERVICES, INC. FOR BADR SAAD AL MARSHAD CONT EST.

 The case of OFW Jerson A. Enriquez and his co-workers was brought to the attention of the
Philippine Overseas Labor Office-OWWA Alkhobar (POLO-Alkhobar) on 11 December 2019
relative to the Hearing by the House Committee on Overseas Workers Affairs on the said
date. OFW Enriquez’ wife testified before the Committee on the sad plight of her husband
and his co-workers relative to their employment in Saudi Arabia;

 OFW Jerson A. Enriquez and his five (5) other OFWs appear to be the 3rd Batch of workers
deployed by the agency, International Experts For Technical Support Services Inc., to the
“employer”, BADR SAAD AL MARSHAD CONT EST.. Accordingly, there were other
OFWs sent by said agency to same employer ahead of OFW Enriquez’ group.

 POLO Actions/Assistance include:

 On 11 December 2019, upon receiving the information on OFW Enriquez’ plight, Welfare
Officer Levin Gabutan immediately coordinated with then POLO-OIC Ronaldo Reyes.
The latter apparently had already contacted OFW Enriquez and advised him on what to
do about their case. OIC Reyes also instructed Case Officer/Interpreter Rauf Agao to
assist the group of OFW Enriquez, as he is also the one handling the case of the
earlier batch of 5 OFWs from the same deploying agency/employer who came ahead of
OFW Enriquez’ group. (Note: On same date, Case Officer Rauf Agao
assisted/facilitated the filing of case for this earlier batch of 5 OFWS against the
employer, with hearing scheduled on 18 December 2019).

 December 12, 2019 — POLO/OWWA ERO delivered food supplies at the


accommodation of Mr. Enriquez and provided transportation fare in transacting with
regards to their case.

 December 17, 2019 — OIC Ronaldo Reyes attended the meeting with Saudi Labor
Office, Crisis Management Committee and the employer. Also, Mr. Hashim Maguindanao
and Rauf Agao who made the meeting possible were also around during the meeting. As
to the result, the employer has no problem of repatriating the workers but he wanted to
get refund of the deployment costs. A letter to POEA copy furnished the PRA was sent
by Mr. Reyes regarding this matter.

 December 18, 2019 — labor hearing for the 5 workers (who are not qualified as welders
with same employer of Mr. Jerson Enriquez). The result was quite positive and will be
given exit visas. However, the employer will be waiting from the PRA the amount he is
asking.
 January 8, 2020 — Eight OFWs ( Mr. Enriquez and other 7 co-workers) decided to file a
labor case and needed 50 riyals each for the online filing of the case at Saudi Labor
Office in Dammam. (Note: Seven of these eight workers did not work).

On same date, the group was provided food supplies, toiletries and medicines for those
having hypertension maintenance and diabetes maintenance including Mr. Enriquez.

 January 9, 2020 — POLO/OWWA ERO gave the 8 workers the 50 riyals for each of
them for a total of 400 riyals.

 January 12, 2020 — Mr. Enriquez and his group proceeded to Dammam Saudi Labor
Office at 8AM to formally file the case against their employer with the assistance and
guidance of Welof Levin Gabutan and Case Officer/Interpreter Rauf Agao. The group
filed the case successfully and they are now waiting for their schedule of hearing.

 January 15, 2020 — POLO/OWWA ERO provided the group with food supplies and
toiletries.

 January 20, 2020 - Labor Attache Reydeluz D. Conferido and Welfare Officer Levin
Gabutan presented Mr. Enriquez and his co-workers to the Head of the Crisis
Management Center of Dammam Saudi Labor Office, Hamed Nasser Alsaqor. The
result of the meet was:

On the five OFWs who were hired as Welders but not qualified as such, they were given
exit visas.

On the eight OFWs (including OFW Enriquez) who filed the complaint on 08 January
2020, the Ministry of Labor scheduled to call the employer on 22 January 2020 to
discuss their problems/case and to negotiate further with the employer.
 January 22, 2020 – The 8 OFWs who are still in Dammam together with Welfare
Officer Gabutan went and met with Abu Rayan, Head of Ministry of Labor, and in the
presence of the Employer for their settlement/negotiation. The group is expected to
return to the Labor Office on 02 February for the final settlement and hopefully to be
provided exit visa. Once the exit visa is issued, they will be booked for repatriation.

 January 25, 2020 – The earlier batch of 5 OFWs who were given exit visas arrived at
the NAIA Terminal 1 where the staff of Repatriation Assistance Division met and
oriented them for possible OWWA programs they can avail.

 January 31, 2020 – Upon Request of OFW Enriquez, POLO-OWWA, provided the
group with food supplies immediately.

 February 02, 2020 – The group went to Dammam Saudi Labor Office, and the
Employer showed up for the meeting and settlement. Case Officers/Interpreters Rauf
Agao and Hashim Maguibdanao assisted the group in the discussion and settlement.

 The following OFWs whose Iqama were not issued but the employer will give their
exit visas within this week, before Thursday, 6 February 2020. Once the exit visas
will be released, POLO-ERO will book them plane tickets for their eventual
repatriation:

 Three (3) workers will continue their Labor Hearing.

 Two (2) workers will continue to work.


1. MARK NEIL C. DAET
2. BERNARDO V. DIMAUNAHAN

 The rest of the group will still be assisted and being monitored by POLO-ERO until
the resolution of their cases.

 Also, food assistance and toiletries were provided for the group, 02 February 2020.
