MEMORANDUM OF UNDERSTANDING

KNOW ALL MEN BY THESE PRESENTS:

The Memorandum of Understanding is entered into by and between:

The PROVINCIAL GOVERNMENT OF BOHOL, a local government unit of the Republic of


the Philippines, represented herein by its VICE GOVERNOR, ATTY. DIONESIO BALITE with office
address at the Provincial Capitol Building, CPG Avenue, City of Tagbilaran, hereinafter referred to
as FIRST PARTY
- and -
The BARANGAY TAGUM SUR, a component barangay government unit, represented
herein by its Barangay Captain, GABINO G. AGOT with principal office at Tagum Sur, Trinidad,
Bohol, herein referred to as SECOND PARTY
WITHESSETH
That the FIRST PARTY has appropriated funds for financial assistance/ counterpart funds
for projects, programs and activities which are aligned to its development agenda.

That the SECOND PARTY has requested for financial assistance/ counterpart funds from
the FIRST PARTY for the following projects/ program/ activity:

DESCRIPTION:

That the foregoing project/ program/ activity has been determined by the FIRST PARTY to
be qualified for the financial assistance/ counterpart funding as requested by the SECOND PARTY.

NOW, THEREFORE, in view of the foregoing, the parties hereto hereby agree as follows:

I. THE FIRST PARTY SHALL:


1. Monitor the SECOND PARTY on its utilization of the fund to ensure that the same is
used for the intended purpose as described above.

II. THE SECOND PARTY SHALL:

1. Acknowledge receipt of the aforementioned fund released/ provided by the FIRST


PARTY.
2. Utilized the said amount strictly in accordance with the intended purpose as described
in this MOU in the manner allowed by laws, such as the observance of the
Government Procurement Reform Act (R.A. 9184) , if applicable.

3. Submit fund utilization report within sixty (60) days after the completion of project/
program/ activity. No succeeding fund releases shall be made without the compliance
of this requirement.

4. Cooperate and allow the FIRST PARTY to monitor the implementation of the project/
program / activity.

III. ADDITIONAL STIPULATIONS

1. In the event that the project/ program / activity is no longer feasible or viable to be
implemented, or will not be implemented after the lapse of one (1) year from the
release of the fund, the SECOND PARTY shall return the unused amount to the FIRST
PARTY.

2. The program of work/ project brief or description/ activity design in support of the
conduct or implementation of the said project/ program / activity and all other
supporting documents shall be considered as an integral part/s of this MOU.

IN WITNESS WHEREOF, the parties hereto have signed this MOU this ____ day of
