EXTRA-JUDICIAL SETTLEMENT OF ESTATE OF THE LATE TOR

L. TERO WITH WAIVER AND RENUNCIATION OF RIGHTS

KNOW ALL MEN BY THESE PRESENTS:

This AGREEMENT, made and entered into in the City of Iligan,


Province of Lanao del Norte, Philippines, by and among:

1. DO L. TERO, of legal age, single, Filipino and a resident of Champaca


St., Iriga City, herein referred as (Heir-Waivor);

2. NEST L. TERO, of legal age, single, Filipino and a resident of


Champaca St., Iriga City, herein referred as (Heir-Son);

3. PHILLIP L. TERO, of legal age, single, Filipino and a resident of


Champaca St., Iriga City, herein referred as (Heir-Son);

4. LYN L. TERO, of legal age, single, Filipino and a resident of


Champaca St., Iriga City, herein referred as (Heir-Daughter);

5. CELYN L. TERO, of legal age, widow, Filipino and a resident of


Champaca St., Iriga City, herein referred as (Heir-Wife);

WITNESSETH, that:

WHEREAS, we are the only legitimate surviving heirs of deceased of


TOR L. TERO who died on February 1, 2010 at Iligan City, a copy of his
death certificate is hereto attached as ANNEX “A”;

WHEREAS, OF TOR L. TERO died instate, without Will or Testament,


and without any outstanding debts in favor of any person or entity and
their only surviving heirs are hereinabove named and enumerated at the
time of their death, they left a parcel of land which are conjugal and
owned in common together with no improvements found thereon situated
at Barrio of,Iriga City Philippines covered by Transfer Certificate of Title
No. T-53,912 containing an area of THREE HUNDRED (300) SQUARE
METERS under Tax Declaration No.063-0010-0000 (land), , copies of
which are hereto attached as Annex “B” & “C” and more particularly
described and bounded as follows:

A parcel of land point of beginning; containing an area of


THREE HUNDRED (300) SQUARE METERS, more or less.

WHEREAS, the parties hereto are the only surviving heirs of the
decedent entitled to succeed their estate, they being their surviving

and legitimate heirs, hereto are the only heirs of the decedent, they

being the children of the decedent, copies of their respective birth


certificates and marriage certificates are hereto attached as Annexe’s
“B”, “ C”, “D” & “E”;
WHEREAS, it is to the best interests of the herein parties to divide
and partition and NOW THEREFORE, for and in consideration of the
premises, and invoking the provisions of Rule 74, Section 1 of the
Rules of Court, the parties hereto do by these presents agree to
divide and partition the entire estate, adjudicating as they do hereby
adjudicate, the same to and among themselves in the following
proportion, to wit:

Transfer Certificate of Title No. T-63,984 (a.f.) a parcel of land, situated


at Barrio of Mangas, City of Iligan, containing an area of Three Hundred
(300) Square Meters with market value of (Php1,203,000.00).

subject In conformity with and in accordance with the provision of


Section 4, Rule 74 of the Rules of Court, seller hereby warrants to
compensate from any damage or claims arising from or owing to
contingent liabilities to creditors, heirs or other persons who might
have been deprived of lawful participation the estate of the
decedent, for a period of two years from and after the settlement
and distribution thereof;
The parties agree to publish this instrument in a newspaper of
general circulation in the City and Province of Iriga once a week for
three consecutive weeks.

That in the event that any other property of the decedent should
later be found which is not included hereinabove, the HEIRS hereto
further agree as they do so agree to settle and distribute,devide and
adjudicate, the same in like manner and proportion as herein
established and disposed.

WAIVER AND RENUNCIATION OF RIGHTS

WHEREAS, We, DO L. TERO, NEST L. TERO, PHILLIP L. TERO &


LYN L. TERO (whose personal circumtancesarementioned above) have
agreed and covenanted to CEDE, TRANSFER and CONVEY unto our
mother CELYN L. TERO (whose personal circumtances is mentioned
above), her heirs and assigns the full ownership and possession of the
above-described properties.

NOW, THEREFORE, for and in consideration of the foregoing premises,


WE hereby waived and renounced, as by these presents we hereby
WAIVE and RENOUNCE our respective shares, rights and participation
over the above-described property in favor of our mother CELYN L.
TERO.
