 THE CLERK: People versus Richard Wanke.

THE COURT: Good morning, Mr. Wanke.

THE DEFENDANT: Good morning.

THE COURT: Good morning.

Mr. Wanke, it is my understanding that your

attorney withdrew from this case; is that correct?

THE DEFENDANT: That's correct, your Honor.

THE COURT: Do you have other counsel?

THE DEFENDANT: No, I do not.

10 THE COURT; Are you going to be able to afford to

11 hire counsel?

12 THE DEFENDANT: No, I am not.

13 THE COURT: I will appoint the Public Defender's

14 Office to represent you.

15 THE DEFENDANT: The Public Defender's Office has

16 withdrawn in the past, citing conflicts of interest, so

17 have all of the conflict counsel in Winnebago County.

18 THE COURT: Okay. We‘ll see. I mean I have to ——

19 you know, I'm going to appoint them. If they file a

2O motion to withdraw, then I will consider it.

21 THE DEFENDANT: Sure. I'm just informing you for

22 expedience.

23 THE COURT: Yeah.

24 THE DEFENDANT: When I was before Chief Judge

 McGraw we went through the process, and it took four

months to appoint and withdraw, appoint and withdraw.

And I have the dockets from Judge McGraw's court

basically to show you that ——

THE COURT: Well, this case is new. The

attorneys that were there at that time may not be the

attorneys there now. Just because they had a conflict

in the past does not mean that they have a conflict

now.

10 I will appoint the Public Defender. And I'm

11 going to set it for status regarding that appointment.

12 If they wish to file a motion to withdraw due to

13 conflict, then they are going to have to do it pretty

14 quickly.

15 THE DEFENDANT: Okay.

16 THE COURT: We will set it for status regarding

17 that. I can set it for status next Friday.

18 Mr. Doll, is that available?

19 MR. DOLL: Yes, your Honor.

20 THE COURT: Is that available for the State?

21 MS. HITE ROSS: Yes, your Honor.

22 Marilyn Hite Ross and Jim Brun for the

23 People.

24 THE COURT: 9:00 o'clock on Friday, September 5.
