A N O RDER
R EORGANIZING THE M UNICIPAL C OUNCIL FOR THE
P ROTECTION OF C HILDREN , P RESCRIBING R ULES AND
R EGULATIONS T HEREFOR , AND F OR O THER P URPOSES

WHEREAS, recognizing the vulnerability of children as well as their key

role in the future of the nation, the 1987 Philippine Constitution included the
following provision: ―The state recognizes the vital role of the youth in nation
building and shall promote and protect their physical, moral, spiritual,
intellectual and social well being‖ (Article 11, Section 13). Likewise, Article 15,
Section 3 of the Constitution states that the Government must ensure ―the right
of children to assistance, including proper care and nutrition, and special
protection from all forms of neglect, abuse, cruelty, exploitation, and other
conditions prejudicial to their development‖;

WHEREAS, Section 1 of Republic Act No. 4881, otherwise known as ―An

Act Creating a Council for the Protection of Children in Every City and
Municipality of the Philippines and for Other Purposes‖ states that:

“It is the declared police of the State not only to assure that
every family should be helped into bringing up their children to
make them useful men and women but also to see that the proper
direction, supervision and guardianship in the training,
education, and other interests of its minor citizens by
undertaken by it.”

WHEREAS, our children have the right to be protected from all forms of
abuse, neglect, exploitation and violence. This right to protection has been
clearly laid out in the Convention on the Rights of the Child (CRC) adopted by
the United Nations General Assembly on 20 November 1989;

WHEREAS, as a concrete expression of that commitment, the Philippine

Congress enacted on 17 June 1992 Republic Act No. 7610, ―An Act Providing
Stronger Deterrence and Special Protection Against Child Abuse, Exploitation
and Discrimination‖. To monitor the enforcement of RA 7610, the Special
Committee for the Protection of Children (SCPC) was created in 1995 through
Executive Order No. 275;

WHEREAS, the government, non-government organizations, families

and communities, religious communities and faith-based organizations, and
the rest of civil society are obliged to respect, protect, facilitate, and fulfill the
rights of children;

WHEREAS, the Municipal Government espouses vigorous advocacy and

public consciousness-raising, capacity building, alliance building, family and
community participation and empowerment, civil society mobilization and
resource generation towards a broad-based response – akin to a social
movement – for the promotion, protection and fulfillment of the rights of
children, particularly those in need of special protection measures;

WHEREAS, mindful of its commitment to the protection and promotion

of children’s rights and welfare, cognizant of its aspiration to become a child -
friendly municipality, the Municipal Government seeks to establish effective
institutional mechanisms to make this a reality;

NOW, THEREFORE, I, ARNEL F. MENDOZA, Municipal Mayor of the

Municipality of Bustos, Province of Bulacan, by virtue of the powers vested
upon me by law, do hereby order:

S ECTION 1. R EORGNIZATION OF THE M UNICIPAL C OUNCIL FOR THE

P ROTECTION OF C HILDREN . – The Municipal Council for the Protection of
Children, hereinafter referred to as the ―MCPC,‖ is hereby reorganized as
follows to serve a full 3-year term beginning on the enactment of this Executive
Order until the 30 th of June two thousand and thirteen:

S ECTION 2. D UTIES AND R ESPONSIBILITIES OF THE MCPC. – (A) Pursuant

to Republic Act No. 4881, the MCPC shall supervise and act as guardian for the
health, education and well-being of all the minors within the Municipality, and
for this purpose it shall, among others, have the functions provided for in
Article 360 of Republic Act No. 386 or the ―Civil Code of the Philippines,‖ to
wit:

“The Council for the Protection of Children shall look after the
welfare of children in the municipality. It shall, among other
functions:

(1) Foster the education of every child in the municipality;

(2) Encourage the cultivation of the duties of parents;
(3) Protect and assist abandoned or mistreated children, and
orphans;
(4) Take steps to prevent juvenile delinquency;
(5) Adopt measures for the health of children;
(6) Promote the opening and maintenance of playgrounds;
and
 (7) Coordinate the activities of organizations devoted to the
welfare of children, and secure their cooperation. ”

(B) In addition, the MCPC shall:

1. Strengthen government commitment and capacity to fulfill children's

rights to protection.

2. Facilitate enactment and enforcement of child protection laws

consistent with the CRC (Convention on the Rights of the Child).

3. Equip children with knowledge, life skills and capacity for meaningful and
effective participation.

4. Spearhead advocacy and social mobilization, situation analysis,

program development, modeling of innovative approaches,
partnership and alliance building, monitoring and impact assessment
of interventions, and annual reporting on the situation and progress
of children at the municipal level.

5. Push for a faster process of organizing, strengthening, activating and

sustaining BCPCs in all barangays.

6. Make available without discrimination basic and preventive social

services as well as specialized interventions in rescue, recovery,
healing and reintegration of child victims.

7. Prepare, with the assistance of the Local Finance Committee, the

programs, projects and activities that will be funded from the one
percent (1%) fund for the protection of children .

8. Formulate approaches and technical tools that can be used to influence

child-friendly budgets in the Municipal Government, i.e.:

a. Measure effectiveness. Evaluate how the budget funds social

services for children and how it achieves the realization of
children's rights. This helps to measure the effectiveness (with
respect to costs, time, etc.) of the strategies employed to
achieve the policy goals.

b. Analysis by sector or group. Analyze the impact of the budget

on specific sectors or socioeconomic groups, e.g., children's
sector. Compare allocations of these sectors with o ther
sectors, the entire economy or past levels of support.

c. Beneficiary assessments. Assess public perception of how far

public spending is meeting their needs. Use opinion polls,
attitude surveys, group discussions, organized debates with
citizens and a discussion of proposals for the coming year.
Through these exercises, development concerns such as social
inclusion, poverty reduction and social equity promotion,
which have impact on the realization of children's rights, can
be integrated into budget management.

d. Monitor social spending. Identify core social indicators on the

situation of children and young people and arrive at a ―child
protection index‖ which can used to measure commitments to
fulfilling children's rights.

S ECTION 3. S ECRETARIAT – (A) With reference to the provisions of

Presidential Decree No. 603, otherwise known as ―The Child and Youth Welfare
Code,‖ the MCPC shall have an Executive Director and Secretariat to be
composed of the following:

(B) The Executive Director shall be in charge of the detailed

implementation of MCPC programs and project act ivities. The Secretariat shall
keep and maintain the MCPC records and prepare such correspondence as may
be necessary.

S ECTION 4. M EETINGS . – The MCPC shall hold meetings at the call of the
Municipal Mayor but it may also be convoked upon written request of at least
two (2) members thereof. A majority of the members of the MCPC is sufficient
for the Council to transact its business provided that in the absence of a
quorum, the Council may adjourn from day to day.

S ECTION 5. A NNUAL A PPROPRIATIONS FOR THE P ROTECTION OF C HILDREN . –

In conformity with Republic Act No. 9344 otherwise known as the ― Juvenile
Justice and Welfare Act of 2006,‖ one percent (1%) of the annual internal
revenue allotment of the Municipality shall automatically accrue to the
protection of children. The MCPC shall develop that budget for such purpose.

S ECTION 6. E FFECTIVITY . – This Executive Order shall take effect upon

approval.
