1 Standard Tech. (a)The tenderer must have successfully completed any of the following during last 07 (seven) years, LOCAL NO NO ALLOWED NO Standard technical

last 07 (seven) years, ending last day of month previous to the one in which tender is invited:
Three similar works costing not less than the amount equal to 30% of advertised value of each component
of tender, or
Two similar works costing not less than the amount equal to 40% of advertised value of each component
of tender, ora
One similar work costing not less than the amount equal to 60% of advertised value of each component of
tender.
Note: Separate completed works of minimum required values for each component can also be considered
for fulfillment of technical eligibility criteria. (b) (ii) In such
cases, what constitutes a component in a composite work shall be clearly pre-defined with estimated
tender cost of it, as part of the tender documents without any ambiguity. Any work or set of works shall be
considered to be a separate component, only when cost of the component is more than Rs. 2 crore each.
The tenderer shall submit the completion certificate as per proforma given in annexure-IV-A or IV-B or IV-
C as applicable or in the format containing all information as required as per the Annex. IV-A or IV-B or IV-
C. Note :- Criteria for the completed work has been given in the General instructions in the tender
document.

2 Standard Fin. The tenderer must have received contractual payments in the previous three financial years and the LOCAL NO NO ALLOWED NO Standard financial

conditions. I/We also agree to keep this tender open for acceptance for a period as mentioned in NIT ALLOWED Compliance Tab
header from the date fixed for opening the same and in default thereof, I/We will be liable for forfeiture of
my/our “Earnest Money”. I/We offer to do the work for North Western Railway, at the rates quoted in the
attached schedule and hereby bind myself/ourselves to complete the work in all respects within time
period as mentioned in the NIT Header from the date of issue of letter of acceptance of the tender.

73 Undertakings I/We also hereby agree to abide by the General Conditions of Contract-2019 corrected up- to- date and LOCAL NO NO NOT NO Undertakings in
to carry out the work according to the Special Conditions of Contract and Indian Railways Unified Standard ALLOWED Compliance Tab
Specifications (Materials and Works) Vol-I & II 2010 as corrected up-to-date, Unified Standard Schedule of
Rates of North-Western Railway, 2010 as corrected up-to-date (for the present contract).

74 Under-takings An amount towards Tender document cost and Earnest Money Deposit As mentioned in the relevant Para LOCAL NO NO NOT NO Undertakings in
of NIT header has been submitted online through net banking or payment gateway. The full value of the ALLOWED Compliance Tab
Earnest Money shall stand forfeited without prejudice to any other right or remedies in case my/our tender
is accepted and if:- (a) I/We do not execute the contract
documents within seven days after receipt of notice issued by the Railway that such documents are
ready; and (b) I/We do not commence the work within fifteen days after receipt of orders to that
effect.
75 Under-takings Until a formal agreement is prepared and executed, acceptance of this tender shall constitute a binding LOCAL NO NO NOT NO Undertakings in
contract between us subject to modifications, as may be mutually agreed to between us and indicated in ALLOWED Compliance Tab
the letter of acceptance of my/our offer for this work.

76 Under-takings The tenderer shall submit the original copies of the documents as per Annexure II, IX, X, XI, XII, XIII, LOCAL NO NO NOT NO Undertakings in
XIV, XV, XVII, XVIII, XX, XXI, XXII, XXIII, XXIV and XXV or other document as applicable for Sole ALLOWED Compliance Tab
Proprietor/ Partnership firm/LLP firm/ Registered Society / Registered Trust /Limited Company/JV Firms as
and when required by the Railway for the verification. If the required documents are not submitted by the
tenderer or there any discrepancy is found between the scanned uploaded documents by the tenderer
and original documents then the offer of the concerned tenderer will be summary rejected and the action
will be taken as per the various provisions of Affidavit to be submitted by the tenderer as per Annexure-II.

77 Under-takings The tenderer shall comply with the provisions of the Contract Labour (Regulation and Abolition) Act 1970 LOCAL NO NO NOT NO Undertakings in
and the Contract Labour (Regulation and Abolition) Central Rules 1971 as modifed from time to time, ALLOWED Compliance Tab
wherever applicable and shall also indemnify the Railway from and against any claims under the aforesaid
Act and Rules.

78 Under-takings The tenderer shall comply with the provisions of the Payment of Wages Act 1936, Minimum Wages Act LOCAL NO NO NOT NO Undertakings in
1948, The Workmen Compensation Act 1923, and the rules made there under in respect of any employees ALLOWED Compliance Tab
employed directly or through petty contractors or sub-contractors engaged by them, as modifed from time
to time, wherever applicable and shall also indemnify the Railway from and against any claims under the
aforesaid Act and Rules.

79 Under-takings The tenderer shall comply with the provisions of the Employees provident fund and Miscellaneous Provision LOCAL NO NO NOT NO Undertakings in
Act 1952 and the rules made there under as modifed from time to time, wherever applicable and shall also ALLOWED Compliance Tab
indemnify the Railway from and against any claims under the aforesaid Act and Rules.

80 Under-takings The tenderer shall comply with the provisions of the Employees State Insurance Act 1948 and Employees LOCAL NO NO NOT NO Undertakings in
Pension Scheme 1995 and the rules made there under as modifed from time to time, wherever applicable ALLOWED Compliance Tab
and shall also indemnify the Railway from and against any claims under the aforesaid Act and Rules.

81 Under-takings The successful tenderer after award of the contract shall register himself on website LOCAL NO NO NOT NO Undertakings in
www.shramikkalyan.indianrailways.gov.in and will comply the provisions of the Para 39 of the Special ALLOWED Compliance Tab
Conditions (General) of Standard Tender Document.

82 Under-takings I/We have read the various conditions of clause no. 25 of General Instructions of Tender Document and LOCAL NO NO NOT NO Undertakings in

Constituent of JV firm including partner of partnership firm in JV has/ have been black listed or debarred by Railway or
any other Ministry /Department/ Public Sector Undertaking of the Government of India/ any State from participation in
tenders/contract on the date of opening of bids either in our individual capacity or in any firm in which we are partners.
