13 known and unknown to the. grand jury to distribute controlled substances,
14 to wit:. 1 kilogram and more of a mixture and substance containing a
15 detectable amount of heroin, a Schedule I Controlled Substance;
16 5 kilograms and more of a mixture and substance containing a detectable
17 amount of cocaine, a Schedule II Controlled Substance; 1,000 kilograms
18 and more of a mixture and substance containing a detectable amount of
19 marijuana, a Schedule I Controlled Substance; and 50 grams and more of
20 methamphetamine, its salts, isomers and salts of its isomers, a
21. Schedule II Controlled Substance; all in violation of. Title 21 United
22 States Code, Sections 84l(a) (1) and 846 .

25 and elsewhere, defendants VICTOR ZAPIEN VENEG,AS, ak;. "Domingo,"

27 and others did knowingly and' intentionally distribute and possess with
28 intent to distribute a controlled substance, to wit: 5 kilograms and

1 more of . a mixture and substance containing a detectable amount of
2 cocaine, a Schedule II Controlled Substance; all in violation of
3 Title 21, United States Code, Section 841(a) (1), and Title 18, United
4 States Code, Section 2.

6 Beginning at a date unknown to the grand jury and continuing up to
7 and including March 29, 2016, within the Southern District of California,
8 the countxies of Mexico, Colombia, Peru and elsewhere, defendant
9 who will first enter the United States
10 in the Southern District of CalifoFnia, did knowingly and intentionally
11 conspire with others known and unknown to the grand jury to distribute
12 and cause the distribution of a controll.ed substance, to wit: 5 kilograms
13 and more of a mixture and substance containing a detectable amount of
14 cocaine, a Schedule II Controlled Substance; intending and knowing that
15 ~uch cocaine would be •unlawfully imported into the United States; all
16 in violation of Title 21, United States Code, Sections 959, 960, and 963.

26 persons known and unknown to the grand jury to commit offenses against
27 the United States in violation of Title 18, United States Code,
28 Section 1956 (h) , to wit: to knowingly conduct and attempt to conduct

1 financial transactions affecting interstate commerce and foreign
2 commerce, which transactions involved the proceeds of specified unlawful
3 activity, that is, Conspiracy to Distribute Controlled Substances in
4 violation of Title 21, United States Code, Sections 84l(a) (1) and 846,
5 knowing that the transactions were _designed in whole and in part to
6 conceal and disguise the nature, location, source, ownership, and
7 control of the proceeds of specified unlawful activity, and that while
8 conducting and attempting to conduct such financial transactions, knew
9 that the property involved in the financial transactions represented the
10 proceeds of some form of unlawful activity, in violation of Title 18,
1.1 Up.ited States Code, section 1956 (a) (1) (B) (i); and to transport,
1.2 transmit, and transfer, and attempt to transport, transmit, and transfer
1.3 a monetary instrument or funds involving the proceeds of specified
1.4 unlawful activity, that is, Conspiracy to Distribute Controlled
1.5 Substances in violation of Title 21, United States Code,
1.6 Sections 841 (a) (l.) arid 846, from a place in the united States to and
l. 7 through a place outside the United States, knowing that the funds
1.8 involved in the transportation, transmission, and transfer represented
1.9 the pr9ceeds of some form of unlawful activity and knowing that such
2 o transportation, transmission, and transfer was designed in whole and in.
21 part to conceal and disguise the nature, location, source., ownership,
22 and control of the proceeds of specified unlawful activity, in violation
23 of Title 18, United States Code, Section 1956 (a) (2) (B) (i); all in

1 Criminal Forfeiture Allegations
2 1. The allegations contained in Counts 1 through 4 are realleged
3. and by their reference fully incorporated herein for the purpose of
4 alleging forfeiture to the United States of America pursuant to the
5 provisions of Title 21, United States Code, Section 853 and Title 18,
6 United States Code, Section 982.
7 2. As a result of the commission of the felony offenses alleged

8 in Counts 1 through 3 of this indictment, said violations being
9 punishable by imprisonment for more than one year and pursuant to
10 Title 21, United States Code, Sections 853 (a) (1) and 853 (a) (2),

18 interest in any and all property constituting, or derived from, any
19 proceeds the defendants obtained, directly or indirectly,. as the result
20 of the offenses, and any and all property used or intended to be used

6 value; or (e) has been commingled with other property which cannot be
7 subdivided without difficulty; it is the intent of the United
8 States, pursuant to Title 21, United States Code, Section 853 {p), and

10 other property of the defendants up to the value of the said property
11 listed above as being subject to forfeiture.

15 detectable amount of heroin, a Schedule I Controlled Substance;

16 5 kilograms and more of a mixture and substance containing a detectable

17 amount of cocaine, a Schedule II Controlled Substance; 1,000 kilograms

18 and more of a mixture and substance containing a detectable amount of

19 marijuana, a Schedule I Controlled Substance; and 50 grams and more of

20 methamphetamine, its salts, isomers and salts of its isomers, a

21. Schedule II Controlled Substance; all in violation of. Title 21 United

22 States Code, Sections 84l(a) (1) and 846 .

24 In or about January 2014, within the Southern District of California

25 and elsewhere, defendants VICTOR ZAPIEN VENEG,AS, ak;. "Domingo,"

28 intent to distribute a controlled substance, to wit: 5 kilograms and

1 more of . a mixture and substance containing a detectable amount of

2 cocaine, a Schedule II Controlled Substance; all in violation of

4 States Code, Section 2.

6 Beginning at a date unknown to the grand jury and continuing up to

8 the countxies of Mexico, Colombia, Peru and elsewhere, defendant

9 who will first enter the United States

10 in the Southern District of CalifoFnia, did knowingly and intentionally

12 and cause the distribution of a controll.ed substance, to wit: 5 kilograms

13 and more of a mixture and substance containing a detectable amount of

14 cocaine, a Schedule II Controlled Substance; intending and knowing that

18 Beginning at a date unknown to the grand jury.and continuing up to

27 the United States in violation of Title 18, United States Code,

28 Section 1956 (h) , to wit: to knowingly conduct and attempt to conduct

1 financial transactions affecting interstate commerce and foreign

2 commerce, which transactions involved the proceeds of specified unlawful

3 activity, that is, Conspiracy to Distribute Controlled Substances in

5 knowing that the transactions were _designed in whole and in part to

6 conceal and disguise the nature, location, source, ownership, and

7 control of the proceeds of specified unlawful activity, and that while

8 conducting and attempting to conduct such financial transactions, knew

9 that the property involved in the financial transactions represented the

10 proceeds of some form of unlawful activity, in violation of Title 18,

1.3 a monetary instrument or funds involving the proceeds of specified

1.4 unlawful activity, that is, Conspiracy to Distribute Controlled

1.5 Substances in violation of Title 21, United States Code,

1.8 involved in the transportation, transmission, and transfer represented

2 o transportation, transmission, and transfer was designed in whole and in.

21 part to conceal and disguise the nature, location, source., ownership,

22 and control of the proceeds of specified unlawful activity, in violation

24 violation of Title 18, United States Code, Section 1956(h).

1 Criminal Forfeiture Allegations

2 1. The allegations contained in Counts 1 through 4 are realleged

3. and by their reference fully incorporated herein for the purpose of

4 alleging forfeiture to the United States of America pursuant to the

6 United States Code, Section 982.

7 2. As a result of the commission of the felony offenses alleged

9 punishable by imprisonment for more than one year and pursuant to

18 interest in any and all property constituting, or derived from, any

19 proceeds the defendants obtained, directly or indirectly,. as the result

21 in any manner or part to commit and to facilitate the commission of the

22 violations al·leged in this indictment.
