CITY OF MARCO ISLAND

EMERGENCY ORDER
(COVID-19/CORONAVIRUS HEALTH EMERGENCY)
THIS EMERGENCY ORDER BY THE CITY OF MARCO
ISLAND, FLORIDA, RELATING TO THE TEMPORARY
CLOSURE OF PUBLIC BEACHES AND CAXAMBAS BOAT
RAMP IN REPSONSE TO COVID-19; PROVIDING FOR
SEVERABILITY/INTERPRETATION AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the detailed findings of Governor DeSantis’ Executive Orders
Number 20-52, Number 20-68, Number 20-70, and 20-83 are hereby incorporated
herein by reference; and
WHEREAS, to reduce the spread of COVID-19, the United States Centers for
Disease Control and Prevention (“CDC”) and the Florida State Department of Health
recommend implementation of community mitigation strategies to increase
containment of the virus, including cancellation of large gatherings and social
distancing of at least six (6) feet between persons in smaller gatherings; and
WHEREAS, limitations on gatherings and the use of social distancing to
prevent transmission of COVID-19 are especially important for people who are over
sixty five (65) years old and people with chronic health conditions because those
populations are at a higher risk of severe illness and death from COVID-19.
However, it appears that everyone, regardless of age or health condition, is
threatened by COVID-19; and
WHEREAS, this Emergency Order is intended to temporarily close public
beaches on the City of Marco Island, Florida (“City”) as recommended by the
Federal Center for Disease Control (CDC) guidelines to continue social distancing
through April 30, 2020; and
WHEREAS, on March 16, 2020, the Marco Island City Council (“City Council”)
declared a State of Emergency for the City of Marco Island in response to COVID-
19; and
WHEREAS, on March 18-20, 2020, Marco Island Police Department issued a
cover letter and Executive Order to all restaurants alerting them of new restrictions
(20-68 and 20-71); and

WHEREAS, on March 20, 2020, the City closed beach parking and public
beach access; and
WHEREAS, on March 23, 2020, the City closed City Hall to the public, keeping
business open online and via telephone; and
WHEREAS, on March 25, 2020, the City urged visitors and tourists to stay
home and not visit Marco Island, and encouraged short term rental reservations to
be cancelled or postponed; and
WHEREAS, on March 27, 2020, the City closed the City’s Racquet Center;
and
WHEREAS, on March 30, 2020, the Marco Island Police Department issued a
letter and an Executive Order to vacation rental property owners through real
estate agencies and property management companies alerting them to new
restrictions; and
WHEREAS, on March 30, 2020, the City closed the base of the Jolley Bridge,
closed playground equipment, spray park, and bathrooms at Mackle Park; and
WHEREAS, the City Council finds that, this Order is necessary to protect the
lives, health, welfare, and safety of the City’s residents from the devastating
impacts of this pandemic, and will promote the public health, safety, and welfare
of the community.

NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF


MARCO ISLAND, FLORIDA:

Section 1. All prior Emergency Orders, Closures, and Directives related to the
COVID-19/Coronavirus State of Emergency dated March 16, 2020, are hereby
ratified, and confirmed as if fully set forth herein.
Section 2. Temporary Closure of Public Beaches. Effective April 1, 2020, the City
of Marco Island will close all public beaches throughout the City.
Section 3. Temporary Closure of Caxambas Boat Ramp. Effective April 1, 2020,
the City of Marco Island will close the Caxambas boat ramp and access to the boat
ramp.
Section 4. Enforcement. Local law enforcement will be charged with enforcing the
temporary closure of public beaches and the boat ramp.

Section 5. Necessary for Protection. This Emergency Order is an emergency
measure necessary for the protection of public health, safety, and welfare of the
City and the community, due to the serous threat of COVID-19.
Section 6. Effective Date. This Emergency Order shall take effect on April 1, 2020
and remain in effect until April 30, 2020 unless otherwise extended, or modified or
terminated by written order of the City Council or the City Manager.
