PETITION

The undersigned, WINONA N. DINGAL hereby applies (or apply) to


have the land hereinafter described brought under the operation of the
Property Registration Decree, and to have the title thereto registered
and confirmed:

AND DECLARE . . .

1. Petitioner is owner of the parcel of land, together with the


improvements thereon, situated at No. 22 Concepcion St., Barangay
Tubod, San Pablo,Zamboanga Del Sur and more particularly described
as follows, to wit:

“A PARCEL OF LAND (Lot 1 of the original survey plan, Psu


-123456, LRC Record NO.) Situated in Barangay 201, Zamboanga
Del Sur, Bounded on the W., along lone 1-2 by Lumbia St. (5 m.
wide and beyond by Mercado Borja; on the N.,along line 2-3 by
spouses Jose Albario ang Facita Albario(Psu-789123); on the E.,
along line 3-4 by Lot 2 original survey plan ; and on the S., along 4-
1 by Orly Perlada(Psu-456789).Beginning at a point marked “1 of
Lot No. 1234, Cad. 314-D, being S.26-55 W., 861.44 m. from BLLM
No. I, Cad. 314-D; thence N.74-78 E., 58.99 m. to point 2; S. 21-02
E., 10.64 m. to point 3; S. 20-05 E., 12.41 m. to point 4; S. 69-40 W.,
49.70 m. to point 5; N. 38-12 W., 29-75 m. to point 1; point of
beginning. Containing an area of ONE THOUSAND THREE
HUNDRED AND EIGHTY-TWO (1,382) SQUARE METERS. All
points are marked on the ground by P.S. Cyl. Conc. Mons. Bounded
on the N., along line 1-2 by Lot 3804, Cad. 314-D; on the E., along
line 2-3 by Lot 17558.”

2. That said land at the last assessment for taxation was assessed at P
50000, Philippine currency, and the buildings and other improvements
at P 10000, Philippine currency.

3. That to the best of my knowledge and belief, there is no mortgage or


encumbrance of any kind whatsoever affecting said land, nor any other
person having any interest therein, legal or equitable, or in possession.

4. That the applicant has acquired said land in the following manner:

That the applicant inherited this parcel of land from her parents who
had been in in open, continuous, exclusive and notorious possession and
occupation of alienable and disposable lands of the public domain under
a bona fide claim of ownership since May 29, 1944. This is in accordance
to section 14 (1), PD No. 1529 which provides:

(1) Those who by themselves or through their predecessors-in-interest


have been in open, continuous, exclusive and notorious possession and
occupation of alienable and disposable lands of the public domain under
a bona fide claim of ownership since June 12, 1945, or earlier.
That the said land has been declared as alienable and disposable on May
1, 1960
Moreover, the property has become part of the conjugal property of the
spouses.

5. That said land is occupied by herein petitioner since birth and by


their predecessors from time immemorial.

6. That the names in full and addresses, as far as known to the


undersigned, of the owners of all adjoining properties, of the persons
mentioned in paragraphs 5, and of the persons shown on the plan as
claimants, are as follows:
a. Mercado Borja at No. 23 Lumbia St., Barangay Tubod, San
Pablo,Zamboanga Del Sur .

b. Spouses Jose Albario and Facita Albario at No. 24 Sugod St., Barangay
Tubod, San Pablo,Zamboanga Del Sur .

c. Orly Perlada at No. 24 Lumbia St., Barangay Tubod, San


Pablo,Zamboanga Del Sur .

7.That the applicant married to Nicasio Sajulga Bayocot.

8. That the applicant's full name, age, citizenship, residence, and postal
address are as follows:

Petitioner Winona N. Dingal is 74 years old, Filipino, Married to Nicasio


Sajulga Bayocot and residing at 5A Sulip St., Barangay Tambulian , San
Pablo, Zamboanga Del Sur.

9. That the following documents are attached hereto and made a part
hereof:

a. Original Plan as ANNEX “A” hereof;


b. Technical description, as ANNEX “B”, hereof;
c. Tax Declaration, as ANNEX “C”, hereof;
d. Tax Clearance, as ANNEX “D”, hereof; and
e. Land Status, as ANNEX “E”, hereof.

WHEREFORE, it is respectfully prayed that after due proceedings


judgment issue confirming petitioner’s title to the subject property
pursuant to the property Registration Decree.

That the applicant’s parents have been in possession of the parcel of


land since May 29, 1944 after having it purchased from Nicanor Mesa.
This is in accordance to section 14 (2), PD No. 1529 which provides:
“Those who have acquired ownership of private lands by prescription
under the provision of existing laws.”
Now, the property has become part of the conjugal property of the
spouses.

5. That said land is occupied by herein petitioner since birth and by


their predecessors from time immemorial.

6. That the names in full and addresses, as far as known to the


undersigned, of the owners of all adjoining properties, of the persons
mentioned in paragraphs 5, and of the persons shown on the plan as
claimants, are as follows:

Sajulga Bayocot and residing at 5A Sulip St., Barangay Tambulian, San
Pablo, Zamboanga Del Sur.

PETITION

The undersigned, Winona N. Dingal hereby applies (or apply) to have


the land hereinafter described brought under the operation of the

1. Petitioner is the owner of the parcel of land, together with the


improvements thereon, situated at No. 22 Concepcion St., Barangay
Tubod, San Pablo,Zamboanga Del Sur.

2. The land subject to this petition is projected in a duly approved plan


No. Psu-123456 , the sepia of which ( accompanied by its three(3)
blueprints copies is hereto attached as Annex “A” and made in the
integral part hereof, and more particularly described in a duly approved
technical description ( copy of which is hereto attach as Annex “ B” and
made an integral part hereof) as follows:

“A PARCEL OF LAND (Lot 1 of the original survey plan, Psu-


123456, LRC Record NO.) Situated in Barangay 201, Zamboanga
Del Sur, Bounded on the W., along lone 1-2 by Lumbia St. (5 m.
wide and beyond by Mercado Borja; on the N.,along line 2-3 by
spouses Jose Albario ang Facita Albario(Psu-789123); on the E.,
along line 3-4 by Lot 2 original survey plan ; and on the S., along 4-
1 by Orly Perlada(Psu-456789).Beginning at a point marked “1 of
Lot No. 1234, Cad. 314-D, being S.26-55 W., 861.44 m. from BLLM
No. I, Cad. 314-D; thence N.74-78 E., 58.99 m. to point 2; S. 21-02
E., 10.64 m. to point 3; S. 20-05 E., 12.41 m. to point 4; S. 69-40 W.,
49.70 m. to point 5; N. 38-12 W., 29-75 m. to point 1; point of
beginning. Containing an area of ONE THOUSAND THREE

3. The above described property is an accretion to the land owned by


and registered in the name of Nicanor Mesa situated in Bgy. Tubod, San
Pablo, Zamboanga Del Sur.Since the same land human or artificial
intervention gradually and imperceptibly, through time immemorial
deposited and/or accumulated silt or alluvion on its bank, thereby,
forming the accretion aforesaid;

4. Nicanor Mesa being the owner of the aforesaid accretion pursuant to


Art. 457 of the New Civil Code, waived and renounced in favor of herein
applicant’s parents (deceased), any and all his right to it, in an affidavit
(duplicated original copy of which is hereto attached as Annex “C”.

5. Petitioner has no knowledge or information of any encumbrance of


whatsoever nature, in favor of any one whatsoever, or any person or
entity having any interest on, much less possession of, the subject
property.

6. The subject property has not been assessed by the government for
the purpose of taxation or nay other purpose, for which reason a duly
authenticated affidavit, executed and signed by three( 3) disinterested
witness establishing the fair market value thereof at 1,500 per square
meter , more or less, hereto attached as Annex ” D”.

7. That the names in full and addresses, as far as known to the


undersigned, of the owners of all adjoining properties, of the persons
mentioned in paragraphs 5, and of the persons shown on the plan as
claimants, are as follows:
a. Mercado Borja at No. 23 Lumbia St., Barangay Tubod, San
Pablo,Zamboanga Del Sur .
b. Spouses Jose Albario and Facita Albario at No. 24 Sugod St., Barangay
Tubod, San Pablo,Zamboanga Del Sur .

8. That the applicant married to Nicasio Sajulga Bayocot.

recognized under the Indigenous Peoples Rights Act (IPRA).

This is in accordance to section 14 (4), PD No. 1529 which provides:


(4) Those who have acquired ownership of land in any other manner
provided for by law.

Now, the property has become part of the conjugal property of the
