CROSS EXAMINATION OF ATTY.

ARMAN HERNANDO, COUNSEL FOR THE


RESPONDENT TO THE PETITIONER

Atty. Hernando Good afternoon, Mr. Witness.


Mr. De Guzman Good afternoon, sir.

AH: Mr Witness, In Question no 16 of your Judicial Affidavit,


you averred that the Petitioner told you that the
Respondent considered benign happenings and events as
evidence to a non-existent infidelity on the part of
Petitioner. Is it correct?
PDG: Yes, sir.

AH: And you testified that the Respondent confirmed this


allegation.
PDG: Yes, sir.

AH: Was that confirmation vital in assessing the alleged


Personality Disorder of the Respondent in your Evaluation
Report, Mr. Witness?
PDG: Yes, sir.

AH: Now, how would you relate that confirmation by the


Respondent to the claim made by the Petitioner in
paragraph 23 of his Petition that:

He started engaging in extramarital sexual relationships


with other women, particularly the commercial sexual
workers which Respondent later on discovered.
PDG: I was not aware of that particular claim by the Petitioner
until the time that you pointed that one out to me, sir.

AH: Mr. Witness, based on your testimony, you said that you
have known the parties to this case because they wanted
to know from you if there is any problem in their
relationship. Is that correct?

PDG: Yes, sir.

AH: Mr. Witness, how were you selected by the petitioner as


his evaluator?
PDG: I was referred to the petitioner by his friend who
happened to be one of my clients. By such referral, I was
trusted by the petiioner to conduct a psychiatric
evaluation on him.

AH: How about the respondent? How did she choose you as
her evaluator?
PDG: It is the petitioner who told the respondent to take my
services as her evaluator.

AH: Mr. Witness, based on your testimony, you are a licensed


clinical psychologist, is it correct?
PDG: Yes, sir.
AH: Being a licensed psychologist, does that mean that you are
bound to the Code of Ethics and Professional Standards for
Psychology Practicioners in the Philippines?
PDG: Yes, sir.

AH: Mr. Witness, I am showing to you a certified true copy of


such Code consisting of __ pages duly attested by the
officer who has its legal custody. Will you please go over
the same and tell us if this is the Code of Ethics you are
bound to observe.
PDG: (Witness will go over the pages)
This is the Code of Ethics I am bound to observe.

AH: Your Honor, I move that this piece of evidence for the
Respondent be marked as Exhibit “2.”

AH: Mr. Witness, are you aware that one of the violations
thereof is “Multiple Relationship?”
MDG: Yes, sir.

AH: Title III, paragraph E, subparagraph a) In page 11 therein


provides:

“Psychology practicioners shall refrain from entering


into multiple relationships if such could reasonably be
expected to impair their objectivity, competence, or
effectiveness in performing their functions as such or if
such relationship will likely result to exploitation or harm
to the person with whom the professional relationship
exists. The multiple relationship occurs when a
Psychology Practicioner is in a professional role with the
same person and at the same time (1) is in another role
with the same person; (2) is in a relationship with a person
closely associated with or related to the person with
whom the Psychology Practicioner has professional
relationship; or (3) is likely to enter into a future
relationship with the client/patient or a person closely
associated with or related to that client/patient. If,
however, the Psychology Practicioner shall find that, due
to unforseen factors, a potentially harmful multiple
relationship has arisen, they shall take reasonable steps to
resolve it with due regard to the best interests of the
affected person and adherence to the provisions of this
Code.

Subparagraph b) of the same Title provides:

“When psychology practicioners shall be required by


law, institutional policy, or extraordinary circumstances to
serve in more than one (1) role in judicial or administrative
proceedings, they shall endeavor to inform the authorities
about their Code of Ethics, to clarify role expectations and
extent of confidentiality and update them as changes
occur.

In this particular case, have you diligently observed this


rule, Mr. Witness?
PDG: Yes, sir.

AH: No further questions, Your Honor.
