LIMA — As part of
Lima Memorial Health
System’s and St. Rita’s
Medical Center’s efforts
to foster a healthy work-
place and community,
both will begin hiring
only tobacco-free employ-
ees beginning Jan. 1.
Under the new hir-
ing practice, applicants
to either hospital will be
asked to confirm their
tobacco use status on their
employment application.
Lima Memorial will test
all applicants for tobacco
use as part of the regu-
lar, pre-employment drug
screening process. LMHS
applicants who declare
tobacco use, as well as
those who do not pass the
screening, may reapply for
a position after 90 days.
At St. Rita’s, applicants
will not be routinely tested.
Under the new hiring prac-
tice, failure to report correct
information on the employ-
ment application could be
grounds for termination.
The tobacco-free hiring
practice is aligned with both
hospitals’ ongoing efforts
to support good health
among their employees.

Iraq’s Christian leaders called
off Christmas celebrations
amid new al-Qaida threats on
the tiny community still terri-
fied from a bloody siege on a
Baghdad church.
Christians across Iraq have
been living in fear since the
assault on Our Lady of Salvation
Church as its Catholic congre-
gation was celebrating Sunday
Mass. Sixty-eight people were
killed. Days later Islamic insur-
gents bombed Christian homes
and neighborhoods across the
capital.
On Tuesday, al-Qaida
insurgents threatened more
attacks on Iraq’s beleaguered
Christians, many of whom
have fled their homes or the
country since the church
attack. A council representing
Christian denominations across
Iraq advised its followers to
cancel public celebrations of
Christmas out of concern for
their lives and as a show of
mourning for the victims.
“Nobody can ignore the
threats of al-Qaida against Iraqi
Christians,” said Chaldean
Archbishop Louis Sako in
Kirkuk. “We cannot find a sin-
gle source of joy that makes us
celebrate. The situation of the
Christians is bleak.”
Church officials in Baghdad,
as well as in the northern cities
of Kirkuk and Mosul and the
southern city of Basra, said
they will not put up Christmas
decorations or celebrate mid-
night Mass. They urged wor-
shippers not to decorate their
homes. Even an appearance by
Santa Claus was called off.
“It’s to avoid any attacks,
but also to show that people are

Driver faces

Christians were fleeing Iraq.
They make up more than a third
of the 53,700 Iraqis resettled in
the United States since 2007,
according to State Department
statistics.
Since the church attack,
some 1,000 families have
fled to Iraq’s safer Kurdish-
ruled north, according to the
United Nations, which recently
warned of a steady exodus of
Iraqi Christians.
The latest threats were post-
ed late Tuesday by the Islamic
State of Iraq, an al-Qaida front
group, on a website frequent-
ed by Islamic extremists. The
group said it wants the release
of two women it claims are
being held captive by Egypt’s
Coptic Church.
Muslim extremists in Egypt
accuse the Coptic Church of
detaining the women for alleg-
edly converting to Islam, an
accusation the church denies.
The message posted Tuesday
was addressed to Iraq’s
Christian community and said
it was designed to “pressure”
Egypt.
Few reliable statis-
tics exist on the number of
Christians remaining in this
nation of 29 million. A recent
State Department report says
Christian leaders estimate there
are 400,000 to 600,000, down
from a prewar level of some
1.4 million.
For those who remain,
Christmas will be a somber
affair.

Kirkuk, 180 miles (290 kilo-
meters) north of Baghdad, Sako
said there will be no Christmas
decorations outside churches
and a traditional visit by Santa
Claus has also been called off.

Van Wert, was sent to prison
for nine months after she was
found to be in violation of her
community control.
Garwood was found guilty
of violating her community
control by associating with
convicted felons and also to
have possession of dangerous
drugs.
Garwood had originally
been convicted of a drug vio-
lation when she was placed on
community control.
Judge Steele gave Garwood
credit for 200 days which she
had served on the sentence.
Haley J. Moser, 20, Van
Wert, was granted judicial
release from prison and placed
on three years of community
control.
Moser will spend up to six
months at the WORTH Center
in Lima as part of her com-
munity control program, had
her driver’s license suspended
for a period of six months and
was ordered to pay costs asso-
ciated with her prosecution.
Judge Steele suspended
the balance of her 10-month
prison sentence pending the
successful completion of the
community control program.
Rebecca Ridenour, 28,
Ohio City, was placed on one
year of community control on
a charge of domestic violence,
a misdemeanor of the first
degree.

Ridenour was ordered

assessment and complete any

John R. McGinnis, 29,

his community control.
McGinnis allegedly violat-
ed his community control after
being found in possession of
drug paraphernalia, associat-
ing with convicted felons and
possession of drugs.
McGinnis was ordered to
spend a 10-month prison sen-
tence and given credit for 124
days he had served against the
original sentence.
Terry Short, 41, Lima,
was found in violation of his
community control for failing
to pay his child support, and
that he had failed to notify the
probation department that he
had moved.
Judge Steele ordered that
Short spend the balance of his
12-month prison sentence and
was given credit for 159 day
he had previously served in
jail awaiting final disposition
of the charge.
Gilbert S. Gomez, 41,
Toledo, entered a no contest
plea on a charge of possession
of drugs, a felony of the fifth
degree.
Judge Steele ordered a pre-
sentence investigation and
scheduled sentencing for 9
a.m. Feb. 2.

ly 2:34 p.m., Delphos police
responded to the 700 block of
Clime Street in reference the

dog returned to their home
and they could hear it yelping.
When they let the dog inside,
they discovered a blue, field-
tip arrow protruding from the

ed to the Lima Emergency
Veterinary Hospital for treat-
ment.
The incident occurred
between 2-2:30 p.m. and is
still under investigation.
On Saturday at approxi-
mately 4:27 p.m., a homeown-
er in the 700 block of West
Third Street reported their
home had been broken into.
When the police offi-
cers arrived, the homeowner
reported the burglary and theft
occurred sometime after Dec.
16 and was discovered on
Saturday.
An undisclosed amount of
cash was stolen.
The case is still under
investigation.

initiated a routine traffic stop
on 20-year-old Delphos resi-
dent Dustin Kunz.
During the officer’s contact
with Kunz, it appeared Mr.
Kunz was under the influence.
His vehicle was towed and he
was transported to the Delphos
Police Department where he
was later released after being
cited into Van Wert Municipal
Court for driving under the
influence.

On Tuesday at approxi-
mately 7:44 p.m., a 50-year-
old resident from the 400
block of East Second Street
came to the Delphos Police
Department to file a report of
identity theft.
When the officers spoke
with the victim, they reported
numerous charges had fraud-
ulently been billed to their
Visa/debit card over the last 3
1/2 months.
The account(s) have been
closed and the case remains
under investigation.

police initiated a routine
traffic stop on 44-year-old
Delphos resident Stephen T.
Cunningham.
During the traffic stop, it
was determined Cunningham
was currently under a finan-

suspension.
Cunningham was released
after being cited into Lima
Municipal Court.

a traffic accident occurred
when the driver of a Pontiac
Grand Prix struck the decline
of a set of railroad tracks with
the undercarriage of his vehi-
cle.
Spencer Wells, 23, of
Delphos, was traveling south-
bound on Canal Street and
attempted to cross over the
incline/decline of the CSX
railroad crossing next to
Bunge Corp., striking the
underside of his vehicle on the
decline. This caused Wells’
airbag to deploy, causing him
non-incapacitating injury.
There was moderate dam-
age to Wells’ vehicle, which
was towed. Wells was trans-
ported to St. Rita’s Medical
Center by Delphos EMS.
He was cited for a failure to
maintain reasonable control.

Livestock care
rules, penalties
approved
COLUMBUS (AP) —
Rules for putting sick live-
stock to death and civil pen-
alties for violators cleared a
key legislative committee on
Wednesday.
The Ohio Livestock Care
Standards Board created by
voters last year has been
working for months to devel-
op standards governing the
care and well-being of farm
animals and penalties for vio-
lating those standards.
Approved penalties for
the euthanasia rules cleared
Wedneday and other care
standards still being devel-
oped range from $500 for
minor offenses to $10,000 for
repeat major ones. Some of
the care standards still being
developed deal with areas like
housing and overall manage-
ment of livestock.
Karen Minton, state direc-
tor for the Humane Society,
said the animal welfare group
is “comfortable” with the rules
stating acceptable ways of put-
ting sick animals to death.
The Humane Society had
wanted strangulation ruled out
as a method of euthanasia, and
it is omitted from the accept-
able methods.
Minton said there are some
concerns over the civil penal-
ties.
“We don’t believe some
of them are as clear as they
should be,” she said. “But
we are optimistic about the
board’s progress so far.”
Action by the Joint
Committee on Agency Rule
Review addressed some of
the issues from an agree-
ment reached in June between
Ohio agriculture businesses,
the Humane Society of the
United States and Gov. Ted
Strickland. The governor bro-
kered the agreement in which
the Humane Society agreed
to abandon a fall ballot issue
against animal cruelty in
exchange for livestock care
standards.
Caesars to play
role in casinos
COLUMBUS (AP) —
Rock Gaming LLC and
Caesars Entertainment Corp.
have entered a joint agree-
ment to develop and operate
new casinos in Cincinnati and
Cleveland.
The companies announced
the venture Wednesday, call-
ing it Rock Ohio Caesars
LLC. Detroit-based Rock and
Las Vegas-based Caesars say
a general manager for each
casino is to be named in early
2011.
Ohio voters approved casi-
nos for four Ohio cities in
November 2009. The oth-
ers will be in Columbus and
Toledo.
Rock Ohio Caesars expects
to invest $400 million in
Cincinnati and $600 million in
Cleveland and create a com-
bined 12,700 direct and indi-
rect jobs. Rock says it’s hired
two diversity consultants to
assure a mix of construction
contractors.

Supreme Court ruled unani-
mously on Wednesday that
lawmakers didn’t violate the
state Constitution when they
took about $230 million set
aside for tobacco prevention
and used it for other purposes.
Disappointed anti-tobacco
advocates called on Republican
Gov.-elect John Kasich and
the incoming GOP-controlled
Legislature to push for a
tobacco tax hike next year to
help pay for smoking-related
health care costs.
Tobacco-Free Kids presi-
dent Matthew Myers called the
state’s handling of the money
“penny-wise and pound-fool-
ish.”
“It is outrageous that this
year, Ohio will collect $1.2
billion in tobacco revenue
from the 1998 state tobacco
settlement and tobacco taxes,
but will spend none of it on
tobacco prevention programs,”
Myers said in a statement.
Affirming a ruling by the
10th District Court of Appeals,
the high court agreed that the
Legislature was within its
legal rights when it moved the
money in 2008, even though it
had been placed in a protected
fund.
The Ohio Tobacco Use
Prevention and Control Fund
was simply a state agency cre-
ated in 2000 and abolished in
2008, justices ruled — not a
trust with special privileges
under the law.
Lawmakers and Democratic
Gov. Ted Strickland struck a
bipartisan agreement in April
2008 liquidating the fund and
diverting most of it to help
pay for a $1.57 billion eco-
nomic stimulus package to
create jobs. Later, the money
was redirected to expand state
health care benefits.
Writing for the court,
Justice Paul Pfeifer said par-
ties in the case debated wheth-
er the money would be bet-
ter spent on tobacco cessation
than on job creation efforts.

Strickland said the ruling
frees up money that had been
pinpointed to extend Medicaid
coverage to children whose
families live at 200 to 300 per-
cent of the poverty level.
The largest portion of the
tobacco diversion was desig-
nated for optional Medicaid
services, including vision,
podiatry, dental and hospice
care. Other programs it was
to fund were adult and child
protective services, breast and
cervical cancer screenings and
a “buy-in” program that helps
special-needs children get
health care coverage.
“This is a great victory
for children’s health care in
Ohio,” Strickland said in a
statement. “Now, Ohio has the
resources to ensure that all
children in Ohio have access
to quality, affordable health
care coverage, regardless of
their financial situation. This
significant decision frees up
state funds that can now be
used to improve the lives of
children and families across
the state.”
The money in the tobacco
prevention fund came from
the landmark settlement Ohio
and other states reached with
tobacco companies to resolve
lawsuits over the effects of
smoking. Ohio’s share was
$10.1 billion.
Shortly after the stimulus
deal was announced, the trust
fund transferred $190 mil-
lion of the money to the anti-
smoking American Legacy
Foundation, and both groups
began their legal fight to pro-
tect the cash. The total is now
$258 million, which includes
interest.
American Legacy’s general
counsel Ellen Vargyas made
no apologies Wednesday for
engaging in the battle.
“We stand up for what we
did,” she said. “In our view,
if Ohio were to have kept the
programs it would have reaped
benefits both financially and
beyond that.”

Gallagher said he believes law-
makers intended to create a safe
trust fund for the money but
failed, stymieing legal protec-

What happened was that in
July 2010 a significant reduc-
tion in the amount of phos-
phates allowed in automatic
dishwasher detergent went
into effect in Washington
State. Similar regulations
were implemented in 14
other states (Illinois, Indiana,
Maryland, Massachusetts,
Michigan, Minnesota,
Montana, New Hampshire,
Ohio, Pennsylvania, Utah,
Vermont, Virginia, and
Wisconsin) for 2009 before
Oregon and Washington
added their names to the list
earlier this year. Previously
phosphates could constitute
up to 8.7 percent of dish-
washer detergent; now the
new regulations limit them to
0.5 percent.
The main problem with
phosphates, which also come
from agricultural and land-
scaping activities, is that they
get into natural water bodies
and act as fertilizer, acceler-
ating plant and algae growth.
When the plants and algae die,
a feeding frenzy of bacteria
consume all the oxygen dis-
solved in the water, creating
an environment inhospitable
to fish and other aquatic life.
These oxygen-devoid “dead
zones” can occur in freshwa-
ter or in the ocean. In fact,
two of the world’s largest
dead zones are in the Baltic
Sea and the Gulf of Mexico,
the result of fertilizers run-
ning off of farmland. Besides
phosphates’ negative effect
on water bodies, their pres-
ence in the environment can
also be harmful to terrestrial
wildlife and can trigger skin
and eye irritation and aller-
gies, among other ill effects,
in humans.

Senate ratifies nuke pact

Senate on Wednesday ratified
an arms control treaty with
Russia that reins in the nucle-
ar weapons that could plunge

joined 56 Democrats and two

ing merchandise to lure
shoppers. A price gauge tied
to the GDP report showed
that prices — excluding food
and energy — rose at a 0.5
percent pace in the third
quarter, the slowest quarterly
pace on records going back
to 1959.

the tradition of decorating a
tree for the holiday season.
According to the American
Christmas Tree Council, the
Christmas tree had its begin-
ning on the Rhine in Western
Germany during medieval
times. The live green tree
played a major role in plays
presented during advent,
the four weeks preceding
Christmas. This fir tree was
decorated with apples and
was only a prop on stage
for plays. It attracted the
attention of spectators, espe-
cially children, who would
help themselves to the apples
when no one was looking.
Long after the plays ceased
to be performed, the memory
of the fir tree decked with the
apples lived on in the minds
of the German people. They
began to bring the fir tree into
the homes during the advent
season and decorated them
with apples. As time went on,
other decorations were added

Storm lashes Calif., leaves polluted water

LOS ANGELES — California residents
who endured flooding, mudslides and evacua-
tions during a weeklong onslaught of rain now
have another problem: contaminated water and
fouled beaches.
The rain washed trash, pesticides and bac-
teria into waterways, prompting health warn-
ings. Four beaches were closed in Northern
California’s San Mateo County and another
12 miles of beach from Laguna Beach to
San Clemente in Southern California’s Orange
County were off-limits because of sewer over-
flows.
While the rain eased on Wednesday, the
danger was not over for foothill residents living
below wildfire-scarred hillsides.
“The ground is so saturated it could move at
any time” and the threat will remain for several
weeks, said Bob Spencer, spokesman for the
Los Angeles County Department of Public
Works.
More than 200 homes were ordered evacu-
ated for more than 24 hours in La Canada
Flintridge and La Crescenta, suburbs of Los
Angeles below steep hillsides that burned in
2009 and where mudslides inundated homes
and backyards in February.
After days of relentless rain, long-awaited
sunshine was finally in the forecast for today,
but officials said Californians may want to resist
the urge to head to the ocean.
“It can be very nice the next day and every-
one says ’This is great! This is a beach day,”’
said Jonathan E. Fielding, director of the Los
Angeles county public health department. “It
could well be but we will be monitoring and
testing water and we won’t recommend people
go back there until we’re sure it’s safe.”
Experts normally recommend waiting 72
hours after a storm before getting in the water,
though in this case some are saying five days
might be wiser. The contamination in some
areas could last for weeks because of the espe-
cially heavy rains.
Mark Gold, president of Heal the Bay, a
Santa Monica based group that monitors and
grades beach water quality said more rain
causes more pollution to get flushed into the
region’s water system
“Literally every beach gets an ’F’ when we
get a rain storm like this,” he said. “It’s big
enough to pollute each an every beach in LA
County. It’s a pretty extraordinary event when
we have rain like this.”
Sixty people were rescued and more than
30 homes evacuated Wednesday when water
surged through Dove Canyon, a gated Orange
County community.
In Highland, about 65 miles east of Los
Angeles, two creeks overflowed, swamping as
many as 20 homes in up to 3 feet of mud. Up
to 40 homes and around 100 residents were
evacuated.
In San Diego, the first floor of the Premier
Inn in the city’s Mission Valley flooded, forcing
guests to the second floor where lifeguards were
sent to rescue them, police said. SeaWorld San
Diego closed for the day as waters rose in the
nearby San Diego River, but it was expected to
reopen on today.
Amtrak said the Pacific Surfliner train service
between San Diego and San Juan Capistrano
was being suspended Thurday because of threats
of midslides and high water.
The storm weakened as it moved eastward,
but floods still washed away homes in Arizona
and inundated parts of Nevada and Utah.The
low-pressure system could reach the Gulf Coast
by Saturday with some rain, forecasters said.
In far northwestern Arizona, homes along
a flooded wash teetered on the edge as resi-
dents scurried to gather belongings. Five vacant
homes were lost in the rural area and nearly two
dozen homes were damaged.
Forecasters said the Virgin River, which cuts
through that part of the state, is expected to crest
today morning.
Floods threatened to swallow a bridge in
nearby Utah. The flooding forced the clo-
sure of Zion National Park on Tuesday. The
south entrance and the visitor center opened on
Wednesday afternoon.
In southern Nevada, a state of emergency
was ordered after rain-swollen creeks closed
some roads in the Las Vegas area and snow
disrupted electricity to about 300 customers on
nearby Mount Charleston.

halfway through her junior
year at Yale University. But

reapplied to West Point and
hopes to return there this sum-
mer to complete her final two
years.

“Retrospectively, now that
I’ve been to Yale, everything
at West Point is more of a team
