THIS TENANCY AGREEMENT is made this------------day of -------------------2013
BETWEEN
WHEREAS:
A. The landlord is the bonafide owner of that one bed room block of flat described and
situate at No………Orubuogwu close Nkpolu Rumuigbo Port Harcourt.
B. The landlord has agreed to LET and the Tenant has agreed to take on the TENANCY
of the aforementioned property with all its appurtenances [hereinafter referred to as the
DEMISED PREMISES for its exclusive use and occupation UPON the terms and
conditions hereinafter stated.
C. The Landlord and Tenant have agreed to be bound by the provisions of this Agreement
herein contained subject to the provisions of the relevant laws.
5. Not to do or permit to be done any structural alteration, nor permit air condition holes
or burglaries on the demised premises or any part thereof without the written consent
of the LANDLORD or his agent
7. Not to assign, sublet, underlet or part with the possession of the demised premises or
any part thereof without the written consent of the landlord or his agents.
8. Not to constitute noise pollution and or be unruly or to use electronic gadgets or any
other appliances capable of causing noise pollution with the property excessively.
9. Not to use animal/pets/poultry to constitute a nuisance within the property or cause to
be done on the property as a whole or individual flats therein including the demised
premises anything which may be of annoyance or nuisance to the landlord, his agents
or occupants of any adjoining flat or property.
10. Not to harass, intimidate, insult and or obstruct any staff carrying out his/her lawful
assignment in the property.
11. To appoint and report to the landlord as the arbitrator in matters of dispute between the
tenant and any other tenant/person on the property in respect of his tenancy in the
demised premises only and not to involve the police or resort to court action in event
of such dispute except where the Appointed Arbitrators failed to settle such dispute
reasonably.
12. To permit the landlord or his agents and all persons authorized by him at all reasonable
times and upon issuance of a 24 hours notice to examine the state and conditions of the
demised premises under covenants in this agreement and for the purpose aforesaid to
enter upon the said premises or any part there with or without necessary tools and
appliances.
13. To pay the services charges as may be appointed/levied to all tenants for the upkeep of
the premises, drains and general area including lighting of general areas and security
guard area. And are responsible for the maintenance, cleaning of the septic tanks and
pits, servicing of the demised property.
14. That anytime the tenant breaches any of the covenants herein contained, or at the
expiration of the tenancy with or without notice to quit, the tenants covenant to give up
vacant possession of the demised property upon being served with the said notice.
15. To use the Demised Premises for Residential purposes only and no other use that may
be prejudicial to the wishes of the Landlord or his agents.
THE LANDLORD HEREBY COVENANTS WITH THE TENANTS AS
FOLLOWS:
1. The landlord agrees to let the premises to the tenant.
2. To keep the demised premises structurally sound, wind and water tight and the
exterior of the said property and all addition thereto and the boundary walls and
fences exterior thereof in good and tenantable repairs and conditions.
3. That the tenant paying the reserved rent and observing and performing all the tenant’s
obligations under this agreement shall quietly enjoy the demised premises without any
interruption by the landlord, his agents or any person claiming under or in trust for
him.
4. That all notices to be given to the tenant under the terms of this agreement shall be
sufficiently served, personally served on any member of the family or if sent by
registered post to his address as given in this Agreement or to any agent authorized by
the tenant to receive the same or who must have received it on his /her behalf.
PROVIDED ALWAYS that if the rent shall be in arrears of twenty one (21) days whether
legally demanded or not or if the tenant shall commit any breach of his obligations under
this agreement, then the landlord may re-enter upon the said premises and immediately
terminate the tenancy as if a written notice to quit has been given and has expired.
i. That if the tenant at anytime fails or neglects to perform or observe any of the
covenants and conditions herein contained and on his part to be performed and
observed, the landlord may at anytime thereafter re-enter the demised premises or any
part thereof in the name of the whole and henceforth hold and enjoy the same as if
this tenancy was never granted but without prejudice to any right of action or remedy
of the landlord for any antecedent breach by the tenant.
ii. That the Landlord on written request of the Tenant made not less than three (3)
calendar months before the expiration of the term hereby created, provided there is
then no subsisting breach of the tenancy obligation under the present tenancy at the
rent negotiated and agreed upon at the time of renewal and otherwise subject to like
terms and condition obtained herein except there is a covenant for renewal.
IN WITNESS WHEREOF: the parties herein have hereunto set their hands and seal the
day and year first above written.
