Notice

In the movie, the element of rules of natural justice can be found by giving notice. Notice can be
defined as the act of giving the other part of the case against him. In the case of Khoo Cheng &
Ors. The court of appeal state that a failure to serve a notice is a clear of violations of the rules of
natural justice. The right of hearing becomes non worthy as the party have no idea that they are
in a case. The notice given doesn’t mean that they have to be given a merely notice, it must be
adequate notice as the case that are against him. This a set a fair opportunity for him to defend
himself in the future proceedings hence the rules of natural justice can be followed.
Based on the case of Maradana Mosque Trustees v Badi-ud-dinMahmud. The managers of a
school the minister explain why they had failed to the salaries of the teachers by the specified
date. The managers explained but then the government still took over the school. This was under
two ground, but the explanation given for only one ground. The managers thus had no notice of
the grounds which influenced the government decisions. The government decision was rejected
as the managers was not given notice of ground which was a far reaching matter and which
influencesd the Minister in making the order.
In the movie, we can see that there is an implementation of charge under notice in the rules of
natural justice. We can see in the scene where Sheriff Walls arrested two local white men, Billy
Ray Cobb (Nicky Katt) and Pete Willard (Doug Hutchison) for the abduction, rape, and beating
of a ten-year-old African American Tonya Hailey (Rae'Ven Larrymore Kelly). During the arrest,
Sheriff Walls clearly said that Ray Cobb and Pete Willard was arrested for inquiry under the
abduction, rape, and beating of Tonya Hailey. The Sheriff did give notice when he said
‘remember the girl that you gave her a ride, I’ve got bad news for you’ ‘She didn’t die’. The two
boys knew on what ground they were arrested and was given a fair arrest. This applied to rules of
natural justice that the party knew on all grounds that he was convicted

Acceptance/receive evidence
In the movie, there is also another element in the rules of natural justice which is receive and
acceptance of evidence. In an oral hearing the adjudicating authority is obliged to give the person
an opportunity to produce the evidence to support their case and to rebut any evidence against
them. A basic principle of natural justice is that his witnesses. Refusal to receive the evidence
which that party relies may cause the breach of rules of natural justice. This means that the
adjudicating officer must allow for the parties to bring material witnesses to testify.
Based on the case of Malaywata Steel Bhd v Union of Malaywata Steel Workers, A company
challenged an award of the industrial court on the ground of breach of natural justice as the
company was denied an opportunity to call for witnesses. The High Court state that there was a
denial of natural justice by the industrial Court because it did not allow an essential witness to
the relative case to come forward. Accordingly, the reward was quashed. This however does not
mean that any parties have to produce any evidence at all time. The party is needed to only
produce necessary and relevant evidence and the authority can decide whether it is relevant or
not. It may disallow evidence which it thinks unnecessary, immaterial or irrelevant. The
discretion must be exercised properly.
Based on the movie, this element can be shown by the court when the defendant Carl Lee was
permitted to bring witnesses for his hearing. This can help in strengthen his argument in the
court. For example, his lawyer Jake Tyler call upon Dr. Beth to testify that Carl Lee was indeed
insane in time of the killing. This is because the rape incident of his child may cause him to not
know what is right or wrong. This can help Carl Lee to strengthen his statement and hence the
rules of natural justice have been applied.
