of JOSEPH ESTRELLA
PRELIMINARY STATEMENT
Q3: Do you swear to tell the truth and nothing but the truth with
respect to your affidavit?
A: Yes Sir,
Q4: Do you know that if you tell a lie you will be prosecuted for false
testimony or perjury?
A: Yes Sir,
Q5: Are you the same Joseph Estrella, the petitioner in this case for
annulment of marriage?
A: Yes, Sir
Q13: What can you say about your relationship before you got
married?
A: Our relationship is okay although I could see her playing cards
but it is tolerable and I did not take it Seriously.
Q14: What happened after your marriage with the respondent?
A: When we were still living together in Salawagan Quezon,
Bukidnon, at the early stage of the marriage, our relationship
was good.
Q16: What happened to your relationship with your wife at that time
that you were away from home?
A: Our relationship became worst as she was addicted to
gambling and would no longer care for our children.
Q17: How did you know that she was addicted to gambling?
A: I observed my wife whenever I was home. I was also informed
by our neighbors and even our children about my wife's gamling
activities. Moreover, I caught her several times when I came
home from work in Lanao
Q18: Who was taking care of your children while you were assigned
in Lanao?
A: At first, I presumed that It was my wife. But later on I discovered
that she just left our children to her working students because
she was playing “ majong” or cards. Sometimes she would also
bring our children to the place where they would play “majong”.
My children informed me when I am home that sometimes they
would sleep in tables and chairs waiting for their mother to
finish playing “Majong”
Q19: What else did your wife do?
A: I was informed by my neighbirs and friends that sometime my
wife will not go home for several days.
Q20: What did you do after you learned of the vices of your wife?
A: I confronted my wife but she did not listen and instead got
angry which led to quarrels and misunderstandings.
Q21: Aside from the information from your neighbors, what other
proofs you had that your wife was addicted to gambling?
A: I asked people who have been to our house to ask for money
and then I discovered that she used the money of the Barangay
amounting to P120,000 to support her vices
Q22: What year did you ask those people who have been to your
house?
A: Sometime in 2003.
Q23: What action did you take when you were able to confirm what
your wife did?
A: I confronted my wife about the money and she admitted that
she used the money in gambling.
Q27: When did your wife and her boyfriend started living together?
A: One year after I left because I could no longer bear the pain of
what my wife was doing.
Q28: Who was giving support to your children at the time that they
were still studying?
A: I was the one giving support sir.
Q29: Did you have any idea about the psychological incapacity of
you wife before your marriage?
A: No Sir. I only knew about it after our marriage.
Q30: For how long are you separated in fact with your wife?
A: More or less 12 years already Sir.
Q31: Did you acquire properties during your marriage?
A: No Sir. We did not acquire any properties and until now I have
no property of valuable consideration.
