IN
PERSONS
ACT OF 2003
The recruitment,
transportation, transfer,
harboring or receipt of a
child for the purpose of
exploitation shall also
be considered as
“trafficking in persons”
even if it does not
involve any of the
means set forth by the
definition
WHO IS A CHILD ?
A person below eighteen
(18) years of age or one
who is over 18 but is
unable to fully take care
of or protect
himself/herself from
abuse, neglect, cruelty,
exploitation or
discrimination because of
a physical or mental
disability or condition
WHAT IS PROSTITUTION?
Confiscation and
forfeiture of all the
proceeds and
properties
Awards for
damages
ANY ADDITIONAL PENALTIES?
Registration with the
SEC and license to
operate shall be
cancelled and revoked
permanently;
If offender is a
foreigner, shall be
deported and barred
permanently from
entering the country,
after service of
sentence;
ANY ADDITIONAL PENALTIES?
Dismissal from the
service upon conviction
and permanently barred
to hold public office.
Retirement and other
benefits shall be forfeited.
Conviction of adopted
shall result in the
immediate rescission of
the adoption.
PRESCRIPTIVE PERIODS?
10 years; or
20 years if
committed by a
syndicate or in large
scale
Period to start
running from date
the trafficked person
is delivered or
released from
bondage
WHAT IS THE ROLE OF PNP?
undertake surveillance,
investigation and arrest of
individuals or persons
suspected to be engaged in
trafficking
Coordinates with various law
enforcement
Establish system of receiving
complaints and calls for
assistance and conduct
rescue operations.
LEGAL PROTECTION TO
TRAFFICKED PERSONS
Trafficked persons are
recognized as victims;
They shall not be
penalized for crimes
directly related to the acts
of trafficking or in
obedience to the order
made by the trafficker;
Consent of trafficked
person to the intended
exploitation is irrelevant.
OTHER FEATURES
Trafficked persons shall
have preferential entitlement
under the Witness Protection
Program
Trafficked persons who are
foreign nationals shall be
entitled to the protection,
assistance and services.
