Assembly, do enact as follows:

1) Single House Bill (introduced and printed separately in either or
both houses). Uni-Bill (introduced simultaneously in both houses and printed
as one bill. Senate and Assembly introducer sign the same copy of the bill).

1 Section 1. This act shall be known and may be cited as the "works

2 progress administration-pandemic recovery (WPA-PR)."

3 § 2. The labor law is amended by adding a new section 224-d to read as

4 follows:

§ 224-d. New York works progress program. 1. The following terms shall

6 ____________________________
have the following meanings:

7 ______________________________________________________________________
(a) "Program" shall mean the New York works progress program estab-

8 _____________________________________________________
lished pursuant to subdivision three of this section.

9 ______________________________________________________________________
(b) "Eligible individual" shall mean an individual who has been unem-

10 ________________________________________________________________________
ployed for at least the sixty-day period prior to the commencement of a

11 ________________________________________________________________________
project described in subdivision four of this section and who is not a

12 __________________
full-time student.

13 ______________________________________________________________________
(c) "Priority individual" shall mean an individual who has been unem-

14 ________________________________________________________________________
ployed for at least the sixty-day period prior to the commencement of a

15 ________________________________________________________________________
project described in subdivision four of this section and is between the

16 ________________________________________________________________________
ages of eighteen and thirty-five, not a full-time student and who is not

17 _________________________________
enrolled in any training program.

18 ______________________________________________________________________
2. (a) There is hereby established within the department the New York

19 _________________________________________________________________
works progress program which shall be headed by the commissioner.

20 ______________________________________
(b) The purpose of such program is to:

21 ______________________________________________________________________
(1) receive works project proposals submitted by state departments and

22 ________________________________________________________________________
agencies pursuant to paragraph (a) of subdivision three of this section;

23 ___
and

24 ______________________________________________________________________
(2) select works projects proposals that meet the criteria pursuant to

25 ________________________________________________________________________
paragraph (b) of subdivision three of this section, as being eligible

26 __________________________________
for assistance under such program.

27 ______________________________________________________________________
3. (a) Not later than thirty days after the effective date of this

28 ________________________________________________________________________
section, and subsequently at such times as the program shall request,

the commissioner of the department of health, the commissioner of the

2 ________________________________________________________________________
department of energy, the commissioner of agriculture and markets, the

3 ________________________________________________________________________
president of empire state development and the commissioner of the

4 ________________________________________________________________________
department of environmental conservation shall submit proposals to the

5 ________________________________________________________________________
program for works projects within the jurisdiction of each such commis-

6 ________________________________________________________________________
sioner or other administrator that satisfy the criteria described in

7 __________________________________
paragraph (b) of this subdivision.

8 ______________________________________________________________________
(b) Any work project to be considered for the program shall meet the

9 ___________________
following criteria:

10 ______________________________________________________________________
(1) the project would produce a high number of employee hours per

11 _________________________________
dollar of the total project cost;

12 ______________________________________________________________________
(2) individuals with the required skills necessary to carry out the

13 ________________________________________________________________________
project can be readily recruited or trained and employed from among the

14 ________________________________________________________________________
eligible individuals described in paragraph (b) of subdivision one of

15 _____________
this section;

16 ______________________________________________________________________
(3) The project would provide a continuing contribution to economic

17 __________________________________
growth once it has been completed;

18 ___________________________________________________________________
(4) The project may be staffed by employees with minimal delay; and

19 ______________________________________________________________________
(5) The jobs associated with a specific project shall last for a total

20 ________________________________________________________________________
of six months, provided they are not located within a county where the

21 ________________________________________________________________________
unemployment rate, as reported by the United States bureau of labor

22 ________________________________________________________________________
statistics, is more than five percentage points higher than such coun-

23 ______________________________________________
ty's rate as of February, two thousand twenty.

24 ______________________________________________________________________
(c) Works projects under this section may include, but not be limited

25 ___
to:

26 _________________________________________________
(1) contact tracing for the COVID-19 coronavirus;

27 ______________________________________________________________________
(2) climate change resiliency, environmental conservation, and water

28 _______________________________________________
quality projects including, but not limited to:

(i) residential and commercial water use efficiency improvement

2 _________
projects;

3 ________________________________________
(ii) water quality improvement projects;

4 __________________________________________________________________
(iii) residential and commercial building weatherization projects;

5 ______________________________________________
(iv) renewable energy infrastructure projects;

6 _____________________________________________________________
(v) soil erosion and pesticide runoff prevention projects; or

7 ________________________________
(vi) trail maintenance projects;

8 ______________________________________________________________________
(3) projects enhancing the creative economy including, but not limited

9 ___
to:

10 _____________________________________________
(i) commissioning public works of visual art;

11 _________________________________________
(ii) staging public musical performances;

12 ______________________________________________
(iii) creating public works of multimedia art;

13 _____________________________________________
(iv) creating public works of digital art; or

14 ________________________________________________
(v) staging public performing arts performances;

15 ______________________________________________________________________
(4) projects enhancing the agricultural, food and beverage sectors

16 ______________________________
including, but not limited to:

17 ______________________________________________________________________
(i) public instructional classes on nutrition, including community

18 _____________
gardening; or

19 _________________________________________________________
(ii) projects using technology to improve agriculture; or

20 ______________________________________________________________________
(5) any other project that is proposed by an eligible department and

21 ____________________________________________
determined to be appropriate by the program.

22 ______________________________________________________________________
4. Project proposals submitted to the program pursuant to paragraph

23 _______________________________________________________
(a) of subdivision three of this section shall include:

24 ______________________________________________________________________
(a) a description of the project and a full schedule of estimated

25 ______
costs;

26 ______________________________________________________________________
(b) an estimate of the number of employment hours required to complete

27 ____________
the project;

(c) a hiring timetable relating to the employment of various staffing

2 _________________________
levels under the project;

3 _____________________________________________
(d) an estimated project completion date; and

4 ______________________________________________________________________
(e) such other information as the eligible department determines to be

appropriate.

6 ______________________________________________________________________
5. (a) The program shall approve those proposals which are submitted

7 ________________________________________________________________________
pursuant to and meet the criteria set forth in subdivision three of this

8 ________________________________________________________________________
section and shall provide funding for such projects from amounts appro-

9 ________________________
priated for the program.

10 ______________________________________________________________________
(b) Priority shall be given to projects located within a county where

11 ________________________________________________________________________
the unemployment rate, as reported by the United States bureau of labor

12 ________________________________________________________________________
statistics, is more than five percentage points higher than such coun-

13 ________________________________________________________________________
ty's rate as of February, two thousand twenty or projects that demon-

14 ________________________________________________________________________
strate a commitment to hiring priority individuals described in para-

15 _____________________________________________
graph (c) of subdivision one of this section.

16 ______________________________________________________________________
6. An eligible department that has submitted a works project proposal

17 ________________________________________________________________________
pursuant to paragraph (a) of subdivision three of this section shall be

18 __________________________________________________________________
responsible for the administration and completion of such project.

19 ______________________________________________________________________
7. An eligible department shall be a party to any contract that

20 ________________________________________________________________________
governs a works project approved and funded in any manner under this

21 ________________________________________________________________________
section. Departments may contract with private corporations having tax

22 ________________________________________________________________________
exempt status under section 501 (c) (3) of the United States Internal

23 ________________________________________________________________________
Revenue Code and privately held businesses for part or all of an

24 ________________________________________________________
approved project subject to the approval of the program.

25 ______________________________________________________________________
8. Not later than six months after the effective date of this section,

26 ________________________________________________________________________
and biannually thereafter on June thirtieth and December thirty-first of

27 ________________________________________________________________________
each year, the program shall submit a report to the legislature which

includes:

(a) the number of works project proposals submitted to the program;

2 ______________________________________________________________________
(b) the number of works projects approved by the program during the

3 _________________
reporting period;

4 ______________________________________________________________________
(c) the number of works projects completed by the date of the report;

5 ___
and

6 ______________________________________________________________________
(d) with respect to each approved work project, a project description

7 ________________________________________________________________________
that includes information about whether the project is complete and such

8 ________________________________________________________
other information as the program determines appropriate.

9 __________________________________________________________________
9. The office of the comptroller shall conduct an annual audit of:

10 __________________________________________________
(a) the performance and activities of the program;

11 ________________________________________________________
(b) the performance and completion of work projects; and

12 ______________________________________________________________________
(c) the performance of the eligible agencies with respect to such

13 _________
projects.

14 § 3. This act shall take effect on the ninetieth day after it shall

15 have become a law and shall expire and be deemed repealed on and after

16 the thirtieth month after the state of emergency declared by executive

17 order 202 that began on March 7, 2020 has been lifted.
