PATERNITY AND FILIATION ON NON-CONVENTIONAL METHOD OF

PROCREATION

A. Artificial Insemination (AI) –

 It is the deliberate introduction of sperm into a female's cervix
or uterine cavity for the purpose of achieving a pregnancy
through in vivo fertilization by means other than sexual
intercourse.
 It is a fertility treatment for humans, and is common practice in
animal breeding, including dairy cattle (see Frozen bovine
semen) and pigs.

In Vitro Fertilization
 In vitro fertilization, better known as IVF is an assisted
reproductive technology in which fertilization takes place in the
lab instead of inside the body.
 The literal meaning of the phrase in vitro is "within the glass.” It
is a Latin term, which more generally refers to anything
occurring in a laboratory setting.
  a process of fertilization where an egg is combined
with sperm outside the body, in vitro ("in glass"). After the
fertilized egg (zygote) undergoes embryo culture for 2–6 days,
it is implanted in the same or another woman's uterus, with the
intention of establishing a successful pregnancy.

o The world's first "IVF baby" Louise Joy Brown is born

on July 25th, 1978 in England.
o The world's second IVF baby and first boy Alastair
MacDonald is born on January 4th, 1978.
o Australian's first IVF baby Candice Elizabeth Reed is born
on June 23rd, 1980.
o Dr. Georgeanna and Howard Jones perform the first
successful IVF procedure in the United States on April
17th, 1981.
o On December 28th, 1981, America's first IVF
baby Elizabeth Jordan Carr is born.

C. Test Tube Baby

 "Test tube baby" is a term sometimes used by the media to refer to children
conceived with in vitro fertilization (IVF). Despite the name, "test tube
babies" are not developed in a test tube. Test tubes are not part of the
modern IVF process at all. With IVF, the egg is fertilized in a petri dish. (Not a
test tube.) When the embryo is between three and five days old, it is
transferred to the uterus.
D. Virgin Birth
 Parthenogenesis is an adaptive strategy that allows organisms to
reproduce when sexual reproduction is not possible due to
environmental conditions.
 Virgin birth, known to scientists as parthenogenesis, appears to be
rather common in the animal kingdom. Many insects and other
invertebrates are capable of switching between sexual and clonal
reproduction. Among the vertebrates, virgin births have been
documented in at least 80 taxonomic groups, including fish,
amphibians, and reptiles.
 But humans and our fellow mammals provide a notable exception. So
far as anyone can say — and there are a few gaps in the data,
notably the platypus — no mammalian species is capable of giving
birth without a father.
Classified According to the Source of Semen

1. AIH (AI Homologous or Husband) – when the sperm comes from the husband.

2. AID (AI Donor or Heterologous) – when the sperm comes from a donor other
than the husband.

3. AIHD (AI Husband Donor, Polled donor Semen) – when the donor semen comes
from the husband and the third party.

Status of the Child Born by AI

1. In AIH there is no doubt that the child is legitimate child of the husband
because the semen came from him.

2. In AID and AIHD with the consent of the husband, the child born must also be
considered legitimate although the fertilization semen is not from the husband.
His consent to the AI may be considered as a waiver to the illegitimate status of
the child and vice versa.
