on the eve of International Day for Biological Diversity.
Zero FIR against operators of KVIC, Maharashtra KVIB along with Trade Mark officials for the violation of
section 9, 39, 63, 64 of the Wildlife Protection Act, 1972 read with the Wild Life (Stock Declaration) Central
Rules, 1973 & Declaration of Wild Life Stock Rules, 2003: IPC 188, 120-B with the Prevention of
Unlawful Activities in India & Biological Diversity Act, 2002.
References:
1. Section 9: Prohibition of Hunting - No person shall hunt any wild animal specified in Schedule, I, II,
III and IV except as provided under section 11 and section 12.
2. Section 39 (1)(c): Wild Animal, etc. to be Government property - Ivory imported into India and an
article made from such ivory in respect of which any offence against this Act or any rule or order
made thereunder has been committed.

Greetings,
It is humbly submitted that:
1. Khadi & Village Industries Commission, obtained trade marks of many brand as Kutir, Khadi &
Sarvodaya keeping in view class 20 of the Trade Marks Rules, 2002 under Trade Marks Act, 1999.
2. Affidavits related to trade Ivory has been submitted by the KVIC & Maharashtra State Khadi &
Village Industries Board, during application under class 20.
3. Raw materials with finished goods might be available with the marketing network of all Ivory
traders, obtained Trade Mark under class 20 for Ivory trading.
4. KVIC also applied under class 20 for brand Charkha, excepting Ivory.
As per guidelines of the Ministry of Home Affairs, zero FIR can be lodged, incase of cognizable offense in
legal terms, whereas all offenses under above said legislations, legal Notices required under section 55 of the
Wildlife Protection Act, 1972 but sections of IPCs are cognizable in legal terms, complaint already moved
with Delhi Police.

Whereas, trading & possession of Ivory & Whalebone, is not permissible under law, besides it KVIC dare
to registered as Trade Mark to trade objectionable wild animal trophies.
It would be pertinent to mention here that WCCB explained KVIC on our report, their Negative list was
amended, omitting scheme related to Elephant ivory, again crime against wildlife with the active
participation of the Controller General of Patents, Designs & Trade Marks, at Mumbai.
Hence:
1. Confiscate objectionable stock under the custody of KVIC, Ivory & Whalebone etc.
2. Book tainted officials under laws of the land.
3. Cancellation of Trade Mark, handling objectionable items.
The Inspector General of Wildlife forwarded above said matter to the WCCB & CWLW of Maharashtra but
no action has been taken by them, neither confiscated illegal, undeclared stock of IVORY from their
custody.
Being an cognizable offense in legal terms, I lodge complaint for legal action on the web portal as LG
Listening Post.
It would be pertinent ro mention here that as per Class 20: FOURTH SCHEDULE TO TRADE MARKS
RULES, 2002: Furniture, mirrors, picture frames goods(not included in other classes) of wood, cork, reed,
cane, wicker, horn, bone, ivory, whalebone, shell, amber, mother- of-pearl, meerschaum and substitutes for
all these materials, or of plastics, whereas KVIC also applied under class 20 to registered Trade Mark for
Charkha, explaining activities other than IVORY.
PRAYERS:
1. Controller General of Patents, Designs & Trade Marks is a co-accused, promoting crime against IVORY,
granting Trade Mark.
2. KVIC / Maharashtra KVIB committed as stated above, unaccountable illegal stock of undeclared
IVORY, needs immediate confiscation, lodging FIR agaist operators of KVIC at Rajghat with Maharashtra
KVIB, for the violation of the 188, 120-B, 420 IPC read with section 2, 9, 39, 40, 63, 64 of the Wildlife
Protection Act, 1972

Scouting for omitting IVORY from Class 20 as goods trading under the Trade Marks Rules, 2002, keeping
in view, the Convention on International Trade in Endangered Species of Wild Fauna and Flora:
Ministry of Commerce & Industry (Department of Industrial Policy & Promotion) - Smt. Sukanya Berwal
with Abhishek Kadyan, Wildlife Crime Control Bureau may issue Advisory, recalling all trade marks
treating IVORY as trading activity including KVIC & Maharashtra KVIB, confiscating their undeclared
stock of IVORY, as raw material with finished articles.
Classification of Goods or Services 22:
(1) For the purposes of the registration of trade marks, goods and services shall be classified in the manner
specified in the Fourth Schedule
(2) The goods and services mentioned in the Fourth Schedule only provide a means by which the general
content of numbered international classes can be quickly identified. It corresponds to the major content of
each class and are not intended to be exhaustive in accordance with the International Classification of goods
and services. For determining the classification of particular goods and services and for full disclosure of
the content of international classification, the applicant may refer to the alphabetical index of goods and
services, if any, published by the Registrar under section 8 or the current edition of the International
Classification of Goods and Services for the purpose of registration of trade mark published by the World
Intellectual Property Organisation or subsequent edition as may be published.

Grievance Description
There might be many more units financed by the KVIC under PMEGP – REGP – CBC – ISEC – Direct
funding scheme violating the Wildlife Protection Act, 1972 because keeping of Elephant tusk, Ivory and its
products are illegal, non bailable and cognizable offense in India, where as Gandhian ideology based Khadi
and Village Industries Commission – KVIC violated the law of the land, promote the crime against
Elephants, creating demands of ban articles in India, this is serious offense and misutilisation of Govt. funds
to promote crime, in fact this is a criminal syndicate between KVIC, Nationalized Banks and poachers /
manufacturers / traders. The United Nations affiliated ‘The International Organization for Animal
Protection – OIPA www.oipa.org in India’s – People for Animals (PFA) Haryana www.pfaharyana.in
Abhishek Kadyan and Sukanya Kadyan worked out this crime against Elephants, taken up matter with the
Wildlife Crime Control Bureau (Ministry of Environment and Forest – Govt. of India) to book all offenders
from top level up to grassroot level of implementing agencies, Banks and beneficiaries for the violation of
the section 9, 35,49B, 49C and 51 read with 420, 120-B of IPC etc. It is further requested to please direct
Bank concerned PNB to freeze the account, not to adjust margin money subsidy against outstanding loan.

offenders at serial No. 70, 71, 72, 74 and 75 of 2010-11 etc to recover the Ivory and articles manufactured.
It is further requested that complainant, whistle blowers safety and protection required from these organized
criminals. The Ministry of MSME is here by requested to please direct KVIC to prepare a complete list of
units financed under Horn and Bone including Ivory products by direct funding, ISEC, CBC, REGP and
PMEGP scheme all over India, all Nationalized Bank may kindly be directed not to adjust margin money
subsidy against outstanding loan, strict departmental action required against all black sheep's in the system.

Remarks
The negative list of items of PMEGP scheme indicated in the guidelines. In the list of Village Industries
under group Polymer and Chemical Based Industries where indicative items are mentioned, Ivory has been
indicated in this category along with horns and other bone products, which has already been deleted from
the KVIC website. A policy circular has also been issued on 12.08.2013 stipulating that
"Items/activities banned by Government of India or competent Government Authorities will
automatically be treated as items under negative list of PMEGP"
