Under instructions from and on behalf of our Client, M/s. Osho

Packaging Pvt. Ltd. having its office at C-91 & 92, UPSIDC, Bagpat Industrial
Area, Uttar Pradesh (hereinafter referred to as “our Client”); I hereby serve
upon you the following Legal Notice:

1. That our Client is a private limited company duly incorporated under

the Companies Act, 1956, having its Office at M/s. Osho Packaging
Pvt. Ltd. having its office at C-91 & 92, UPSIDC, Bagpat Industrial

Area, and Uttar Pradesh. That our client is engaged in the business
of manufacturing optimum quality range of MS Base Shell Cylinder.
MS Base Shell for rotograveur cylinder. Our client is a leading
Manufacturer of ms base shell India base shell cylinder, ms base
shell cylinder, ms rotogravure base shell and ms printing cylinders
from Delhi NCR, India.

2. It is stated that the Noticee is a Private Limited Company and is a

regular customer of our client.

3. That to avail the services of our client, you the Noticee approached
our client and intended to place various orders. After much
deliberation our client agreed to supply all the requisite goods with an
agreement that the payments shall be made immediately on the
receipt of the goods, to which you the Noticee wilfully agreed.

4. That from time to time various orders were received and duly
dispatched by our clients. All goods were received satisfactorily and
no objection whatsoever was ever raised against the same. Further
the transaction continued on a running account basis as you failed to
make the payments at the time of the receipt of the goods.

5. That our client from time to time raised proper and necessary bills of
each and every supply of goods, however the payments against the
same has remained unpaid.

6. That on various occasions our client requested you telephonically,

and at your office for release of the said outstanding payment, but
you have always been dilly delaying the same on one pretext or the

other and so far resisted in making the necessary payment. It was

only after continuous follow up that on 20.05.2020 you the noticee’s
transferred a sum of Rs. 50,000/- being part payment.

7. That inspite of acknowledging the liability of payment of principal

balance of Rs. 13,00,392/- (Thirteen Lakhs Three Hundred Ninety-
Two only) you the Noticee’s have miserably failed to make payment
of the said amount due to my client. Having failed to make the
necessary payments, our client being a registered under the MSME
act is entitled to the interest as per Section 15 – 17 of the Act, hence
you are liable to pay the above-said principal balance amount
alongwith interest from the date of due till actual realization of the
said sum.

In the premises of the above mentioned, I therefore call upon you the Noticee
to clear the outstanding amount of Rs. 13,00,392/- (Thirteen Lakhs Three
Hundred Ninety-Two only) alongwith the interest prescribed under the MSME
Act, from 11.03.2020 till the realization of the amount to our client within 10
days of receiving the notice failing which we shall be constrained to initiate
the legal action against you the Noticee. It is also needless to express that
the cost and consequences incurred by our client for the recovery of the
amount as above mentioned amount along with interest shall also be
attributable at your end and you shall also be liable to pay the same. Cost of
Rs. 55,000/- incurred by my client for sending this instant legal notice shall
also be borne by you the Noticee’s.

Copy of this notice is kept in our office for future reference and
records.
