This pertains to the practice of the Police Offices of filing cases for violation of

City Ordinance in lieu of violation of PD 1602 despite apprehension involving illegal

gambling activities such as pusoy, bingo and cara y cruz. In this regard, this office
sought for Legal Opinion from the Regional Legal Office regarding the Violation of
Special Laws and City/Municipal Ordinance for Illegal Gambling Operations and is
now awaiting for their response.

2. This pertains to the practice of the La Union Police Provincial Office of

filing violation of City/Municipal Ordinance, where the penalty is fine only, in lieu of
violation of PD 1602 despite apprehension involving illegal gambling activities such
as pusoy, bingo and cara y cruz.

3. In this regard, this office seeks for your Legal Opinion and guidance on
the correct procedure in dealing with abovementioned violations and whether there is
double jeopardy should the PNP file actions for violation of PD 1602 against the
apprehended persons including those who have already paid their fines.
