COMPLAINT-AFFIDAVIT

I, PO1 Jack Miranda, of legal age, single, a resident of 1234 Sta. Mesa, Manila, and a
member of PNP Manila, Police Station 1, Manila City, and having been sworn to in accordance
with law, do hereby depose and state:

1. That after conducting a month long surveillance on an apartment in 1234 Paco,


Manila owned by Amelia within our area of responsibility, we came to know that
Amelia knowingly allowed her apartment to be used for illegal drug activities.
2. That such owner, Amelia, is believed also in the illegal sale of marijuana.
3. That at around 5:00 in the afternoon of February 5, 2020, PSUPT Danny Velasco,
Station Commander of Police Station 1 of Manila City, conducted pre-operation
conference to conduct a buy-bust operation against the suspect. He designated PO1
John Dimagiba as the poseur-buyer and the undersigned as the head of the back-up
team. PSUPT Danny Velasco handed to PO1 John one (1) piece of One Thousand
Peso Bill with serial number K12345 as the buy-bust money. We put a recording
device to our poseur-buyer for us to hear their would-be conversation and after which
we proceeded to the suspect’s apartment located in 1234 Paco, Manila.
4. That at about 5:30PM of the same date, we positioned ourselves secretly in order to
observe and respond quickly.
5. That we saw our poseur-buyer knocking on the door’s apartment of the suspect, the
suspect opened the door, and they have a conversation, and eventually the suspect
handed something to our poseur-buyer.
6. We heard, through the recording device, that the suspect also offered our poseur-
buyer her dining area to use since the room is occupied by her other customers. Our
poseur-buyer signaled by shaking his head which prompted the operatives to make
the arrest.
7. That we immediately rushed to the scene and arrest the suspect and was able to
recover the marked money used for the entrapment from the suspect bearing the serial
number K1234 as well as the two (2) transparent sachets suspected to be containing
marijuana weighing 4 grams each.
8. After informing the suspect of his rights and the nature of his arrest, we confirmed to
her if she owned the apartment, to which she responded that she was.
9. We inspected the apartment and saw four (4) persons in one of the rooms. Ben is
holding a sachet suspected to be marijuana and in the act of opening it, while Bong is
holding a rolling paper. Mark and Prince are seated with them as well. The illegal
substance believed to be marijuana weighs 4 grams. They identified themselves as
Ben, Mark, Prince, and Bong. We asked them if anyone of them lived there, all of
them answered none and said that they just used the apartment with Amelia’s consent
for their illegal activities. We arrest them and informed them of their rights and nature
of the case also.
10. We sent the suspects under the custody of Police Station 1 of Manila City, which they
are currently detained and awaiting trial.
11. The suspected illegal drugs were immediately sealed per police procedure and were
delivered to laboratory examinations.
12. That I am executing this complaint-affidavit to establish the truth of the foregoing
facts.
