Ta the hand delivered packet you will find unemployment paperwork; an explanation of rights you bave under COBRA and your final paycheck. Please be advised that under Connecticut law you may, should you disagree with any of the information contained in this termination letter, submit a written statement explaining ‘Your position. Your written statement shall be maintained as part of your personnel file and shall accompany any transmittal or disclosure from such personnel file or records made to a third party. The hearing occured and was, completed on June 6, 2020 at the East Haven Senior Center. In conjunction with the hearing, I reviewed the following documents: (1) the Investigation Report, dated June 1, 2020, by Attorney David A. Ryan; (2) the Town's Notice of Pre-Termination Hearing, dated June 2, 2020, directed to Zack Berker!; (3) The Connecticut Department of Labor publication entitled “Unemployment Insurance: A Guide to Collecting Benefits in the State of Connecticut;”(4) email correspondence from Town Attomey Michael Luzzi, dated Mareh 17,2020, March 18, 2020 and April 13, 2020; (5) an April 16, 2020 exaail from the Connecticut Department of Labor to Mr. Barker, evidencing Mr. Barker’s enrollment in the Temporary LayoiiVacation Shutdown payment program: (6) the April 24, 2020 email from the Connecticut Department of Labor, concerning instructions for future weekly unemployment compensation claims; (2) Notice of Potential Liability, issued by the Connecticut Department of Labor to the ‘Town, regarding Mr. Barker’s claim for unemployment compensation; (8) email correspondence between Michelle Benivegna and Mr. Barker, dated April 29, 2020 and oMMt. Barker acknowledged atthe hearing that ho received the June 2 notice via hand delivery on June 2, 2020, Sune 12, 2020 Page 2 May 1, 2020, respectively; (9) a printout of a Claim Inquiry, showing uneraployment Compensation for Mr. Barker for the claim period effective April 5, 2020; (10) the ‘Connecticut Department of Labor’s Monetary Determination of Us it Compensation Benefits with respect to Mr. Barker, mailed April 15, 2020; (I1) a printout of VRU Claimant Data applicable to Mr. Barker, dated June 3, 2020; and (12) an email from the Connecticut Department of Labor to Mr. Barker, dated June 10, 2020. Mr. Barker, along with his representative, Paul LaVallee, were present for the emtirety of the pre-termination hearing. Attomey David A. Ryan was also present, Mr. Barker was provided with reasonable written notice of the charges against him, was given ample opportunity to respond, was given the opportunity to identify disagreement with the facts or charges set forth in the pre-termination notice and to identify any mitigating circumstances which should be considered and was given a full opportunity to offer any other arguments or facts which contradict or vary from the Town's version of the facts, Both Mr. Barker and Mr. LaVallee spoke extensively at the hearing. After considering all documents listed above, the information presented at the June 6* hearing, and assessing the credibility of same, I recommend termination of Mr. Barker's employment by the Town.
