PETITION

PETITIONERS, by the undersigned counsel and unto this


Honorable Court, respectfully states that:
1. Petitioners are both of legal age, Filipinos, married and
residents of 213 Phase 1 Olivarez Homes, Brgy. Tulo,
Calamba City. For the purposes of this petition, they may be
served with summons, orders and other legal processes of
this Honorable Court at the above-mentioned address;

2. The subject minor, Faundy Ling, has been administratively


declared a “child legally available for adoption” by the
Regional Director of the Department of Social Welfare and
Development pursuant to R.A. No. 9523, evidenced by its
Certification, herein attached as Annex A;

3. By virtue of the above declaration, the local civil registrar of


the City of Calamba has issued in favor of Foundy Ling a
Foundling Certificate, herein attached as Annex B;

4. Petitioners desire to adopt the minor child named Faundy


Ling, minor, female and currently residing at Bahay
Ampunan, Canlubang, Calamba City;
5. Petitioners are both eligible to adopt, pursuant to R.A. No.
8255, possessing full civil capacity and legal rights, good
moral character, has not been convicted of any crime
involving moral turpitude, and emotionally and
psychologically capable of caring for children, as evidenced
by various testimonies of three uninterested individuals.
Their affidavits are herein attached as Annex C-1, Annex C-
2 and Annex C-3;

6. Petitioners are both in a position to support and care for


Faundy Ling, as they have a combined earning of
P650,123.20 a month as evidenced by their recent pay slips
and Certificate of Employment herein attached as Annex D-
1, Annex D-2, Annex D-3 and Annex D-4;

7. Petitioners have dreamed of becoming a parent but was not


fortunate to have one. Now that both the petitioners have
reached a level of financial stability, emotional and
psychological maturity, it is their earnest desire to be given
the opportunity to love, raise, and care for a child, even if
such child be not of her own flesh and blood, all for the
child’s best interest.

WHEREFORE, petitioners respectfully pray that:


1. upon due notice, publication, and hearing, judgment be
rendered declaring that herein minor, Faundy Ling, be for all
intents and purposes the adopted child of herein petitioners
and for them to enjoy the rights pertaining thereto; and

2. Faundly Ling’s name be changed to Babe Poe Acoe.


Other reliefs and remedies available under the premises are
likewise prayed for.

1. The spouses are the petitioners in the herein case;
2. They certify that they have not commenced any action or field
any claim involving the same issues before any other court,
tribunal, or quasi-judicial agency;
3. To the best of their knowledge, there is no such pending action
or claim; and
4. If the spouses should learn that a similar action or claim has
been filed or is pending, they shall report such fact within five
(5) days from the discovery to this Honorable Court.
