candidate
attendance
at,
and
participation
in
the
Convention
and
any
other
Party
sponsored
events,
including
speaking
order,
speaking
time,
complementary
activities
(introductions,
demonstrations,
etc.)
(iv)
placement,
protection,
and
removal
of
campaign
materials;
(v)
establishing,
controlling,
supervising,
and
securing
the
voting
process,
including
any
matter
related
to
the
impartiality
or
validity
of
the
voting
process;
(vi)
approval
of
reporting
forms
and
all
procedures
and
processes
related
to
the
counting
of
the
vote(s);
(vii)
counting
the
vote(s);
and,
(viii)
reporting
the
results
of
the
vote(s).
(4)
Any
formal
request
for
an
interpretation
of
any
Rule
relating
to
the
conduct
of
the
Leadership
Campaign
and
Election
(a
“Formal
Request”),
or
any
complaint
arising
from
the
conduct
of
any
candidate
or
person
purporting
to
act
on
behalf
of
a
candidate,
or
any
agent
of
the
Alberta
Party
acting
in
respect
of
the
Leadership
Campaign
and
Election
(a
“Complaint”),
shall
be
made
to
the
Convention
Rules
Committee,
in
writing,
and
signed
by
a
Candidate
or
the
Candidate’s
Party
Liaison.
(5)
The
Convention
Rules
Committee
shall
consider
any
Formal
Request
for
an
interpretation
of
any
rule
or
any
Complaint,
having
regard
for
the
rules
of
natural
justice,
prudence,
and
timely
determination;
and
shall
provide
an
interpretation
or
render
a
decision,
and
the
form
of
the
interpretation
or
decision
is
at
the
sole
discretion
of
the
Convention
Rules
Committee.
(6)
Without
limiting
the
generality
of
the
foregoing,
a
decision
of
the
Convention
Rules
Committee
may
include
one
or
more
of
the
following:
(i)
publication
of
the
interpretation
or
finding
of
a
violation
of
the
Rules
in
a
media
release
or
by
announcement
during
any
part
of
the
Leadership
Campaign
or
Convention;
(ii)
disqualification
of
a
vote,
if
the
validity
of
a
vote
was
in
question;
(iii)
a
financial
penalty;
(iv)
a
direction
to
conform
to
the
Rules
and/or
to
make
good
any
non-‐compliance;
(v)
disqualification
of
a
candidate
to
stand
for
election
as
Leader;
(vi)
a
declaration
that
the
results
of
the
Convention
are
void
provided
that
the
remedies
set
out
in
(iii)
and
(iv)
may
only
be
applied
with
the
consent
of
the
Board
of
Directors,
and
a
decision
including
those
remedies
found
in
(iii)
and
(iv)
is
final
and
may
not
be
appealed
to
any
other
body
of
the
Alberta
Party
or
reviewed
by
or
appealed
to
any
judicial
body.
(7)
A
candidate
may
appeal
only
the
following
types
of
decisions
to
the
Board
of
Directors
(an
“Appeal”):
(i)
a
decision
on
a
Complaint
that
the
Party
has
breached
the
Constitution;
(ii)
a
decision
on
a
Complaint
alleging
bias
on
the
part
of
the
Convention
Rules
Committee;
(iii)
a
decision
on
a
Complaint
alleging
multiple
voting
or
other
voter
fraud
by
a
person
or
persons;
(iv)
a
decision
on
a
Complaint
concerning
inequity
in
access
to
the
voting
process.

(8)
The
Board
of
Directors
shall
consider
any
Appeal
having
regard
for
the
rules
of
natural
justice,
prudence,
and
timely
determination,
and
shall
provide
a
decision,
and
the
form
of
the
decision
is
at
the
sole
discretion
of
the
Board
of
Directors.
(9)
Prior
to
Nomination
Day
the
Board
of
Directors
will
appoint
two
Convention
Co-‐Chairs,
who
shall
be
charged
with
chairing
or
moderating
the
various
business
sessions
of
the
Convention.
(10)
Prior
to
Nomination
Day
the
Board
of
Directors
shall
appoint
a
Returning
Officer,
who
shall
be
responsible
for
conducting
the
vote(s)
for
the
election
of
the
Leader,
according
to
these
Rules,
the
Constitution
and
any
supplementary
rules
that
the
Returning
Officer
may
determine.
(The
Convention
Rules
Committee
does
not
make
supplementary
rules
about
the
voting
procedure.)
(C)
Direct
Vote;
“Eligible
Voters”;
Disqualification
of
Voters
(1)
The
election
shall
be
by
a
direct
vote
of
Eligible
Voters.
(2)
An
eligible
voter
shall
be:
(i)
of
the
full
age
of
16
years;
(ii)
ordinarily
resident
in
Alberta
for
at
least
six
(6)
months
immediately
prior
to
the
voting
date
both
of
which
may
be
evidenced
by
reference
to
a
document
such
as
a
valid
Alberta
driver’s
license,
a
birth
certificate,
a
passport,
a
treaty,
landed
immigrant
or
citizenship
card,
a
bill
or
invoice
indicating
an
Alberta
residential
address,
or
similar
document;
and,
(iii)
a
member
in
good
standing
of
the
Alberta
Party,
as
of
12:00
noon
on
Friday,
May
13th,
2011,
as
evidenced
by
such
member
being
listed
at
that
time
on
the
official
Alberta
Party
membership
list,
such
membership
list
as
validated
by
the
Vice
President
Membership
of
the
Alberta
Party
prior
to
the
Convention.
(3)
For
the
purpose
of
these
Rules
“good
standing”
in
the
Alberta
Party
requires
each
of:
(i)
an
acknowledgement
of
the
principles
and
values
of
the
Party,
indicated
by
a
signed
receipt
for
membership,
or
similar
indication;
(ii)
providing
a
name
that
differentiates
the
members
from
others
either
alone
or
in
combination
with
current
contact
information
(which
is
also
required),
a
residential
address
that
locates
a
person
within
a
provincial
constituency;
(iii)
payment
of
the
required
membership
fee
(see
Article
3
of
the
Constitution);
and
(iv)
provision
of
items
(i)
through
(iii)
to
only
the
Vice
President
of
Membership
or
the
Secretary
of
the
Alberta
Party
by
no
later
than
12:00
noon
on
May
13,
2011.
(4)
The
Alberta
Party
will
undertake
all
reasonable
measures
to
advise
any
person
whose
membership
is
found
not
to
be
in
good
standing,
and
to
do
so
expeditiously,
and
to
provide
the
reasons
why
such
membership
is
apparently
not
in
good
standing.
Such
a
person
may
respond
to
the
finding
by
providing
evidence
to
the
contrary,
and
the
Alberta
Party
may
reclassify
the
membership.

(F)
Memberships
(1)
During
the
campaign
period
each
sold
membership
must
be
represented
by
the
delivery
of
a
membership
card
to
the
member,
and
the
receipt
for
the
membership
card
must
show:
(i)
the
signature
of
the
member
(as
an
indication
of
the
member’s
understandings
and
undertakings;
(ii)
the
date
on
which
it
was
sold.
(2)
Each
candidate’s
campaign
organization
must
remit
all
membership
receipts
and
the
corresponding
membership
fee
to
the
Alberta
Party,
on
a
weekly
basis,
each
Friday
after
the
candidate
is
nominated.
(3)
Failure
to
remit
membership
receipts
and
fees
on
a
timely
basis
will
be
sanctioned
by
the
Convention
Rules
Committee.
(G)
Candidate
access
to
the
official
Alberta
Party
Membership
List;
Challenging
Names
(1)
The
Alberta
Party
will
provide
each
candidate
with
a
copy
of
the
official
Alberta
Party
Membership
List:
(i)
within
72
hours
of
the
candidate
filing
nomination
papers
or
Nomination
Day,
whichever
is
earlier;
(ii)
on
the
Monday
which
is
the
15th
day
of
each
month
or
which
first
follows
the
15th
day
of
each
month,
until
and
including
Monday,
May
16th,
2011;
and
(iii)
on
Friday,
May
27th,
2011.
(2)
A
candidate
may
challenge
any
name
on
the
official
Alberta
Party
membership
list,
with
respect
to
good
standing
(a
“Challenge”),
that
is
with
respect
to:
(i)
age;
(ii)
residence
in
Alberta,
and
duration
of
residence;
(iii)
awareness
of
membership
status;
(iv)
payment
of
the
membership
fee;
or
(v)
the
requirements
for
membership
having
been
met
by
the
deadline
for
membership
by
no
later
than
12:00
noon
on
May
13,
2011
provided
that
the
Challenge
is
accompanied
by
evidence,
satisfactory
to
the
Returning
Officer
in
his
or
her
sole
discretion,
that
the
membership
may
not
be
in
good
standing.
(3)
The
Party
will
only
receive
and
consider
a
Challenge
received
by
the
Returning
Officer
by
12:00
noon
on
Friday,
May
20th,
2011.
The
Returning
Officer
will
rule
on
all
Challenges
prior
to
Thursday
May
26th,
2011.
The
good
standing
of
any
member
listed
on
the
official
Alberta
Party
Membership
List
is
not
subject
to
Challenge
thereafter.

of
not
more
than
$10,000.00,
which
levy,
until
paid,
shall
be
a
debt
owed
by
the
candidate
to
the
Alberta
Party.
(I)
Breach
of
the
Rules
Governing
the
Leadership
Election
(1)
A
Candidate
for
election
as
Leader
shall
agree
in
writing
to
be
bound
by
the
Rules
of
the
Alberta
Party
relating
to
the
Leadership
Race,
including
the
Rules
of
its
Convention
Rules
Committee,
and
agrees
to
be
subject
to
such
financial
penalty
and/or
other
sanctions
as
may
be
imposed
by
the
Alberta
Party,
in
both
cases
subject
to
such
appeal
as
is
provided,
and
agrees
to
be
bound
in
this
regard
on
behalf
of
any
person
acting
as
his/her
agent
in
the
matter
of
the
Leadership
Race,
and
agrees
that
any
financial
penalty
properly
levied
by
the
Alberta
Party
is
a
debt
owing
to
the
Party.
(2)
The
Convention
Rules
Committee
may
disregard
or
waive
a
technical
breach
of
these
Rules,
provided
that
the
breach
does
not
contravene
a
provision
of
the
Constitution
or
the
clear
intent
of
these
Rules
and
is
not
material
and
does
not
prejudice
the
position
of
any
other
candidate
in
any
material
way.
(J)
Voting
Procedures
(1)(a)
Any
member
may
only
vote
once
on
a
question
or
on
a
round
of
voting
for
election.
(1)(b)
A
vote
may
be
cast
using
a
paper
ballot
at
the
Convention
site,
or,
at
the
sole
discretion
of
the
Convention
Rules
Committee
with
respect
to
cost,
technology,
method,
appropriate
security,
and
other
relevant
considerations,
by
use
of
a
telephone
or
the
internet
according
to
such
rules
as
may
be
adopted
by
the
Convention
Rules
Committee.
(2)
All
votes
will
be
counted
at
a
single
location
in
Edmonton.
(3)
Each
candidate
may
appoint
as
many
as
two
scrutineers
to
observe
the
counting
of
votes
and
to
challenge,
if
necessary,
votes
cast.
(4)
In
the
event
that
more
than
one
ballot
is
required
to
determine
the
next
Leader
of
the
Alberta
Party,
there
shall
be
a
minimum
of
45
minutes
elapse
from
the
announcement
of
the
results
of
one
ballot
until
the
close
of
voting
on
the
subsequent
ballot.

ARTICLE
9:
THE
LEADER
(a)
A
Leadership
Vote
shall
be
called:
(i)
when
the
Leader
delivers
written
notice
to
the
President,
of
his
or
her
intention
to
resign;
(ii)
when
the
position
of
Leader
otherwise
becomes
vacant;
or
(iii)
pursuant
to
Article
9(f)
of
this
Constitution.
(b)
The
Leader
shall
be
elected
by
a
majority
vote
of
the
Members
of
the
Party
personally
casting
a
secret
ballot.
If
no
candidate
receives
a
majority
after
the
first
ballot,
the
balloting
shall
be
repeated
as
many
times
as
necessary
until
a
single
candidate
receives
a
Majority
Vote.
On
each
round,
the
candidate
receiving
the
lowest
number
of
votes
shall
be
removed
from
the
next
ballot
and
any
other
candidate
may
choose
to
have
his/her
name
removed
from
the
ballot.
(c)
To
be
eligible
to
vote
in
a
Leadership
Vote,
an
individual
must
be
a
Member
in
good
standing
of
the
Party,
immediately
prior
to
the
vote,
as
determined
by
the
Provincial
Board
and
set
out
in
the
notice
of
the
Leadership
Vote…

Where
a
Leadership
Vote
is
to
be
called,
the
Provincial
Executive
shall
within
fifteen
(15)
days,
announce
the
date
on
which
the
Leadership
Vote
will
be
held.
Notice
shall
be
provided
to
all
Members
of
the
Party
by
the
Provincial
Executive
within
a
further
twenty-‐one
(21)
days
of
the
announcement.
The
Leadership
Vote
must
be
held
not
sooner
than
three
(3)
months
and
not
later
than
nine
(9)
months
from
the
date
of
the
event
that
triggered
the
Leadership
Vote.
(g)
In
the
event
the
Leader
is
unable
to
continue
as
Leader,
or
the
Leader
will
be
a
candidate
in
the
Leadership
Vote,
the
Provincial
Executive
shall,
in
consultation
with
the
Caucus,
select
an
Acting
Leader
until
the
Leadership
Vote
is
complete
and
a
new
Leader
is
named.
The
Acting
Leader
shall
not
be
eligible
to
be
a
candidate
in
the
Leadership
Vote.
(h)
The
Provincial
Board
shall
establish
the
procedures
and
mechanisms
whereby
the
Leadership
Vote
shall
be
conducted.
(i)
In
order
for
a
person
to
be
considered
as
a
candidate
for
the
Leader
of
the
Party,
the
individual
must:
(i)
be
a
Member
in
good
standing
of
the
Party
at
the
close
of
