II. FORMAL OFFER

The testimony of the witness Atty. Soya R. Bean of the Legal

Department of Philippine Postal Corporation to attest that the lease

contract has been legally terminated. Atty. Soya in the course of his

testimony, will identify documents pertinent to this case and will also

testify on other allied matters.

I, Soya R. Bean, of legal age, Filipino, married, with Manila

Central Post Office, Liwasang Bonifacio, Magallanes Dr, Intramuros,

Maynila, Kalakhang Maynila; after having been duly sworn to in

accordance with law, hereby states that:

 I am answering the questions propounded by Atty. Dina R.

Marzan of MALOAG CCA LAW FIRM fully conscious that I am under

oath and that I may face criminal liability for false testimony or

perjury;

This Judicial Affidavit is written in English, a language known

and understood by me, and the examination and execution thereof

were done at MALOAG CCA LAW FIRM, #69 Puso ng Baguio,

Session Road, Baguio City; and

This Judicial Affidavit shall serve as my direct testimony in this

case.

III. JUDICIAL AFFIDAVIT PROPER

1. Q- Please state your name, age, residence, and occupation.

A- I am Atty. Soya R. Bean, 69 years old, and a resident of

Crown Tower Condominium G. Tolentino St, Sampaloc, Manila.

I am a Legal Officer at the Legal Department of Philippine

Postal Corporation.

2. Q- Why are you here now?

A- To directly testify regarding the the lease agreement

between the Philippine Postal Corporation and Heart Land

Incorporated, which was legally terminated.

3. Q- For the record, please state the name of the Lawyer who is

now conducting your examination and the place where it is

being held.

A- Atty. Dina R. Marzan is conducting my examination in their

law office at Puso ng Baguio, Session Road, Baguio City.

4. Q- In what language do you want the examination to be

conducted?

A- In English.

5. Q- Do you undertake to answer the questions to be asked of

you, fully conscious that you will do so under oath, and that you

may face criminal liability for false testimony or perjury?

A- Yes, Ma’am.

6. Q- Are you aware of the existence of the petitioner Heartland

Incorporated?

A- Yes, they own the property which was being leased by

Philippine Postal Corporation.

7. Q- How about the respondent Philippine Postal Corporation and

Rufus Gomez?

A- Yes, I am fully aware of them. I work at the Philippine Postal

Corporation, as a legal officer and Mr. Rufus Gomez was our

agent authorized by the Corporation to transact regarding a

lease in Baguio City.

8. Q- Are you familiar with this contract of lease entered by your

corporation and the Respondent Corporation?

 A- Yes, I am familiar with this contract. As a matter of fact, I was

there to assist Mr. Gomez, at the time of signing of the contract.

9. Q- Now Atty. Bean, are you ar
