OPERATIONAL CONTRACT SUPPORT (OCS)

1. Situation:

a. Enemy. Refer to Annex B, Intelligence for relevant threats that impact

concept of OCS planning. [This section should provide guidance, as applicable,
on the potential threat(s) to the use of contracted support in the operation.]

b. Friendly. List major contract support related commands and agencies

involved in this operation, but not under the C2 of this command, and their
key OCS related organizational capabilities and assigned tasks. [e.g.,
USTRANSCOM, DLA, DCMA, DCAA, and other governmental agencies (OGAs)
impacting or influencing OCS actions operating in the JOA.

c. Commercial Business Environment. Provide a brief description of the

general business environment and estimated impact on the ability to utilize
commercial support in the designated joint operational area.

d. Assumptions. State valid and necessary assumptions. [Briefly describe

key OCS related planning assumptions based on threat assessment,
commercial business environment, host nation/international and
multinational considerations and any established OCS related facts.]

e. Limiting Factors. State all key limited factors to include specific

constraints and restraints. [Based on threat assessment, commercial business

environment research and any established OCS related facts and assumptions,
list specific OCS related limiting factors such as status of forces agreements
(SOFAs) restrictions (e.g. a SOFA that limits the number of US or third country
national contractors allowed in country), general business environment (e.g.
lack of established electronic banking systems), etc.].

2. Mission. See base plan.

3. Execution.

a. Concept of Contract Support Operations. Provide an OCS concept of

operations. (Include an overview of how contracting supports the operation and
articulates the commander’s priorities, intent, and specific OCS command
guidance by phase of operation. This section should also address the overall
contract support arrangements (e.g. support to own Services, lead Service or
Joint Theater Support Contracting Command (JTSCC)). The following is
guidance on utilization of types of contracted support.

(1) Systems Support Contracts. Provide any specific guidance on use of

system support contracts in this operation. [This sub-paragraph(s) addresses
any command guidance/restrictions on the use of Service weapon systems
support contracts. Use caution in placing any restrictions on the use of system
support contracts since most of these contract are critically important in
maintaining weapon and support system readiness.]

(2) External Support Contracts. Provide any specific guidance on use of

external support contracts in this operation. [This sub-paragraph addresses
general guidance on the use of major external support contracts (e.g. DLA,
USTRANSCOM, etc.) and Service CAPs (e.g. Army Logistics Civil Augmentation
Program; Air Force Capabilities Program [AFCAP]; and Navy’s Global
Contingency Construction Contract [GCCC] and Global Contingency Services
Contract [GCSC]). This section will also include commander’s guidance on the
transition of CAP support to theater support contracting by phase of operation
where appropriate. The GCC and/or sub-JFC Annex W may refer to the
appropriate Service component Annex Ws for a more detailed description of
planned CAP support (e.g. Army Annex W may have LOGCAP plan).]

(3) Theater Support Contracts. Provide any specific guidance on use of

theater support contracts in this operation. [This sub-paragraph addresses the
concept of theater support contracting in the joint operational area by phase of
the operation. The GCC and/or sub-JFC Annex W should refer to related
sections of the Annex W to include theater support contracting command tasks
listed in Appendix 1, Summary of Contracting Capabilities and Capacities.]

b. Contingency Contracting Administrative Services (CCAS). State how
CCAS will be performed. (Provides direction on CCAS at the GCC level. Normal
options include Services providing their own CCAS capability or CCAS being
provided by DCMA per theater business clearance guidance. If CCAS is going to
be performed by DCMA, this paragraph should refer to tasks to subordinate
units and other related guidance.)

c. Tasks to Major Subordinate Units. List major OCS related tasks for each
Service component, JTSCC (if formed), Joint Contingency Acquisition Office
(JCASO) mobile support team (MST)(if deployed) and CSAs to include
identification of the lead OCS manager/integrator staff or unit and
participation in boards, bureaus, centers, cells and working groups. [This sub-
paragraph should include OCS related guidance to major subordinate
commands, JTSCC (if formed) and supporting CSAs not contained in other
sections of the Annex W. The GCC plan should include the requirement for
Service components and CSAs to follow JFC OCS related guidance as found in
the DPAP AOR portal (web linked in reference section above) and other OCS
guidance as applicable. Service components and CSAs will be required to
conduct OCS planning in support of the GCC and may be required to submit
draft CSIPs to include appropriate Tabs and Appendices. The JFC level plan
must include OCS integration responsibilities not already captured in GCC
standard procedures and/or policies as well as lead OCS advisory
responsibilities. Service component and CSA plans should reflect similar OCS
integration and advisory responsibilities applicable to their subordinate
organizations. Finally, instructions to the lead Service responsible for theater
support contracting (if appointed) or JTSCC (if formed) must include direction
to publish mission specific theater acquisition instruction (e.g. standard
clauses, contract negotiation policy, pricing procedures, etc.), and
responsibility to coordinate guidance with OSD (if and when published).

d. Initial Guidance by Support Function. Identify major support functions

planned for commercial support sourcing. [This sub-paragraph along with
Annex W, Appendix 3, Tab A, Summary of Contractor Support Estimate,
outlines anticipated commercial support sourcing by joint capability area
and/or commodity. The information in the GCC and/or sub-JFC Annex W
should be linked to the appropriate Service component or CSA plan as well as
to Tab A to Appendix 3 Summary of Contractor Support Estimate which will
contain more detailed planning guidance. Specific guidance found in each
section below is based on GCC directed lead Service directives/CSA
responsibilities, JFC ANNEX W Concept of the Operations guidance, applicable
functional supportability analysis data, commercial business environment
analysis factors, risk assessment analysis and other operational factors. Each
individual section below should contain Service component command guidance
on suitability for contracted support to include specific restrictions and
contract venue guidance (e.g. external support vice theater support contract

type decision) by location and phase of operations as applicable and as directed
by the GCC. The requiring activities (e.g., the Service components) will be
responsible to develop contract statement of requirements (CSOR) that includes
a description, location, timing, and estimated amount) for the designated
supply or service. The outline below provides specific guidance on the types of
services that should be addressed in this paragraph.

disbursement arrangements. Also see Base Plan, Annex E Personnel, Appendix
3 Finance and Disbursing. [This sub-paragraph should specify who will
provide/perform financial management responsibilities (including resource
management, comptroller) along with information on who will provide funding
for administrative support and operations. Designate who and how deploying
funds certification and funds disbursement capabilities will support deploying
contracting capabilities.]

b. Contract/Fiscal Law Support. Specify who is responsible for providing

contract law support to facilitate OCS. Also see Base Plan, Annex E Personnel,
Appendix 4 Legal. [This sub-paragraph should describe specific contract and
fiscal law support arrangements.]

5. Command, Control and Contracting Authority.

a. Command and Control. Address the OCS C2 organizational construct.

[The GCC level plan or order must designate specific OCS C2 relationships and
how they fit into the overall JFC C2 arrangements. The GCC level plan must
specifically address any lead Service or JTSCC C2 relationships over attached
subordinate contracting organizations and if planned, how the OCS C2
organizational construct may change or evolve.]

b. Contracting Authority. Address theater support head of contracting
activity (HCA) authority to include linkages to in-theater contracting
organization(s) and, if applicable, theater business clearance authorities. [This

APPENDIX 2 TO ANNEX W TO US EUROPEAN COMMAND OPLAN 4999-12

CONTRACTOR MANAGEMENT PLAN (CMP)

References: See Annex W

1. Purpose. JFCs, service components, and CSA planners use Appendix 2 to

Annex W (Contractor Management Plan) of concept plans, operation plans and
operation orders to address deployment preparation, in-theater management
(to include legal jurisdiction and discipline matters), government furnished
support and redeployment of Contractors Authorized to Accompany the Force
(CAAF). The CMP may also address as appropriate contractor management
aspects for non-CAAF contracted employees who have an area of performance
on a U.S. military facility or within the vicinity.

2. General Instructions. CMP detail will be significantly different depending on

the overall plan level and by level of command.

3. Applicability. This paragraph states the applicability of this Appendix to all

CAAF and selected non-CAAF (e.g. those non-CAAF personnel who have an
area of performance on a US installation or who have an area of performance in
the vicinity of US forces. It may also be applicable to CAAF and non-CAAF
private security forces in support of DOD operations if utilized.

4. Definitions. Provide clarification to unique terms (e.g. the differences

between CAAF and non-CAAF using DODI 3020.41 since management
standards and requirements for both vary).

5. Situation. See Annex W.

6. Mission. See Annex W.

7. Execution.

a. Contractor Accountability. Explain requirements for all contractors, both

CAAF and (any designated) non-CAAF, to be listed in the DOD approved
contractor accountability database per DOD policy along with any specific
clarification guidance (include policy as reference or provide link to same). This
information should include the specified period of performance, obtaining a

Letter of Authorization (LOA) that outlines privileges & authorizations, and who
is responsible to update the database.

b. Government Furnished Support. The plan should address JOA-wide

guidance such as standards of support, personnel recovery eligibility, etc.
Service component and CSA plans should provide details on specific
government furnished support requirements and procedures. Reimbursement
of services provided should be addressed as applicable. Below are some key
areas to consider:

(1) Billeting.

(2) Medical/Dental Care.

(3) Medical Costs.

(4) Emergency Medical Care

(5) Primary/Routine Care.

(6) Quarantine/Restriction of Movement.

(7) Evacuation.

(8) Mortuary Affairs.

(9) Subsistence.

(10) Personnel Recovery.

(11) Signal Support.

(12) Other Government Furnished Support. (e.g. exchange &

commissary privileges, MWR facilities, religious support, mail support, and
legal assistance or absence thereof).

(13) Military clothing and protective gear. (e.g. Identify

authorized/required/prohibited clothing and protective gear.)

c. Equipment Requirements. Specify requirements for government

furnished equipment for CAAF in order to fulfill the terms of any contract (e.g.
CBRN and personal protective equipment). Details should be found in the
Service component plans.

d. Force Protection. Specify responsibilities of the government to provide
reasonable force protection to both CAAF and non-CAAF personnel operating in
the vicinity of US forces. JFC plans must provide conditions under which self-
protection is authorized along with the approval process for same.

e. Discipline and Laws Applicable to Contractors. When contingencies exist

outside US borders, specify exceptions to US Laws and/or USG Regulations for
CAAF and non-CAAF.

(1) Applicability of US Law. Specify applicability of Military

Extraterritorial Jurisdiction Act (MEJA) and Uniform Code of Military Justice
(UCMJ) to CAAF and non-CAAF personnel serving with or accompanying US
Forces in the contingency.

(2) Applicability of International Laws, Local Laws, and Host Nation

Agreements. Specify laws and/or agreements that may affect U.S. citizen and
third country national (TCN) contractors to include Status of Forces
Agreements (SOFAs).

f. CAAF Deployment, Training, Theater Entrance Requirements, In-Theater

Management, and Redeployment. Specify theater notification procedures,
entrance and deployment/training requirements CAAF must complete in order
to deploy. Some areas include:

(1) Country Entry Requirements. Reference requirements per the DOD

Foreign Clearance Manual, as well as specific GCC or US Diplomatic
requirements for groups and individuals and any alternative processes.

(2) Medical, Dental, Physical, and Psychological Requirements. Address

requirements, and whose responsibility it is, to ensure CAAF are medically and
psychologically fit for deployment, able to accomplish the tasks and duties
unique to a particular operation, and the ability to tolerate the environmental
and operational conditions of the deployed location.

(3) Deployment & Training. Specify force protection, safety or other

general military knowledge training requirements CAAF must complete prior to
deploying. Specify requirements for and location of designated CONUS or
OCONUS deployment centers for contractors. Describe the requirement for all
deploying contractors to obtain a contracting officer approved LOA.

(4) In-Theater Management. Specify requirements affecting day-to-day

management and control of contractor personnel while deployed in an
operational area. Also must include specific contractor accountability
responsibilities and reference appropriate business rules for contractors,
CORs, and contracting officers to input and validate/approve contractor

personnel in the DOD approved contractor accountability database prior to
deployment.

(5) Redeployment. Specify theater specific requirements CAAF must

complete prior to and during redeployment and contract termination (e.g.
transportation to point of entry, life support en route, CAAF roles in the reverse
RSO&I process, intelligence debriefing, medical, and retrieval of locally issued
ID cards and equipment.

g. Weapons and Arming of Contractors. JFC must specify the procedures

that allow individual contractors to possess firearms, including familiarization,
qualifications, and required briefings on the rules for the use of force. See
ANNEX C, Appendix 15, Tab B Force Protection, Exhibit 7, Contractor Security
Plan.)

h. Contractor Personnel for Private Security Services. Specify procedures

that allow contractor provided private security services for other than
inherently governmental functions. Specific private security services guidance
should be found in Appendix 15 Force Protection, Annex C Operations.
