1.ALL PHOTOGRAPHS and PORTRAITS CREATED BY AMANDA WILSON ARE

COPYRIGHT PROTECTED. It is a violation of federal copyright law to copy, scan or allow
photographs Amanda Wilson has created to be copied, scanned, modified, “photoshopped”, or
reproduced in any way without the direct written consent of Amanda Wilson. Any unauthorized
use will be punishable by law. The Client agrees to purchase portrait photography prints directly
from Amanda Wilson. Image copyright will remain the sole property of the
photographer._______

2. LIMITS OF LIABILITY: Failure to Perform. If the Photographer cannot perform this

Agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control
of the parties, or due to the Photographer’s illness, then the Photographer shall return any
deposit to the Client but shall have no further liability with respect to the Agreement. This
limitation on liability shall also apply in the event that photographic materials are damaged in
processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged
without fault on the part of the Photographer. In the event the Photographer fails to perform for
any other reason, the Photographer shall not be liable for any amount in excess of the retail
value of the Client’s order. _______

3. SERVICES PROVIDED:

My Baby Love Package

50% of session fee is due at the time of booking and is non-refundable.

Up to four hours of shooting (at photographer’s discretion)

Location is recommended to be in client’s home.

One month online proof gallery

4. PREVIEWS in the form of an online gallery will be ready about 14-21 days after the sitting
date. No products or prints will be turned over to client until all outstanding amounts are paid. If
someone else is to pick up prints, Amanda Wilson must receive notice from the signer of this
agreement that an alternate party is receiving the order.

5. PORTRAIT PRINT PRICING. Prices for additional portrait prints are agreed to and shown on
the price list. It is understood by the client that the print prices can change at any time without
notice. ______ Orders for prints should be combined and orders must be placed within 7 days
from the date the previews are ready. Print orders can take about 10 business days, but can
vary due to seasonal lab schedules. Any exceptions to this section must be written on this
contract and signed by both the photographer and the client.

6. PORTRAIT DELIVERY QUANTITY: Between 10 and 20 finished portraits will be delivered to

the online proofing website for the client. Photographer chooses the best of the best of the
images and does not retain any rejected or any other images not displayed to the client
regardless of the amount of photographs taken during the photo shoot.

7. THE SESSION FEE AGREED TO IS $75.00. A retainer fee of 50% is due at the time of
booking to reserve the services of the photographer, this retainer is non-refundable.

8. FULL PAYMENT OF THE REMAINDER BALANCE OF is due at the time of the session
before any photographs will be taken. Any further requested photographic services, such as
photographing friends or family, shall be subject to photographer’s hourly fee of $60 per hour
with a minimum of two hours. Any additional locations other than those agreed upon in advance
shall be subject to a $30 fee per location. ________

9a. CLIENT EXPECTATIONS: Newborn photography is often a wonderful experience for all
involved. However, sometimes baby does not want to cooperate and the session will need to be
rescheduled. Amanda Wilson will do everything in her abilities to get all the needed
photographs, but if baby is fussy or otherwise unable to be photographed, she must reschedule.
No rescheduling or additional sitting fees will be incurred.

It is requested that any siblings or relatives of the newborn being photographed are not in the
same room unless they are being photographed as well. It is understood that Amanda Wilson
will not be held liable for any injury, damage, or accident sustained from the knocking over of
lights or any other equipment by adults or children. Client also assumes financial responsibility
for any damage to equipment due to negligence._____ It is also understood Amanda Wilson is
only hired as a photographer and will not be disciplining children, but will be directing the
parents to deal with their own children if the need arises.______ If this request is not heeded
and other siblings are making photographing in any way difficult for the photographer, she has
the right to end the session immediately with no guarantee or promise of a reschedule. In that
event, Client may receive a lesser amount of finished proofs.________

9b.This session is all about the newborn. While it would be wonderful to have each family
member taking turns holding and posing with the child and having many whole-family portraits,
and Amanda is more than willing to book a family session for you as well. However, this is not
the focus of a newborn session. Photographer will use personal discretion on additional persons
in the photographs.

9c. No other photographing during the session is allowed.

10. MODEL RELEASE: By utilizing the photographic services of Amanda Wilson, the Client
releases all digital images with the client’s likeness to be used in marketing collateral materials,
magazine ads, and any other future promotion or publication purposes not specified here. Client
further grants the right and permission to use and/or publish said digital images, either in
original or computer‐altered format, in conjunction with client’s own or a fictitious name, in any
reproduction through any media for any purpose, forever. ___________ Clients release and
discharge Amanda Wilson, and/or her representatives and affiliates, in whole or in part, from
and against any liability and harm as a result of any use of said photos_________, or any
alteration which may occur intentionally or otherwise, in the reproduction of the finished product,
its publication or distribution. This copyright excludes anyone except Amanda Wilson from
making identical or substantially similar copies of the work, from creating adaptations or
derivatives of the original work, from re‐selling the work in any way, and from displaying the
work publicly or as a for‐profit marketing/advertising technique.
