Nepal Urban Governance and Infrastructure Project (P163418)

Terms of Reference for hiring a Technical Support Team for Project Preparation

A. Background

At the request of Government of Nepal, the World Bank is prepared a new lending operation with
Ministry of Urban Development (MoUD) to provide financial assistance of USD 150 million for
supporting investments in priority urban infrastructure requirements of cities as well as institutional
strengthening and capacity building of newly formed urban local governments. The Project
Development Objective (PDO) for the proposed Nepal Urban Governance and Infrastructure Project
(NUGIP) is to expand municipal infrastructure and strengthen the institutional & financial systems in
participating urban local governments in Nepal. In particular, NUGIP will aim at a) improving access
to core municipal services (includes expansion of coverage, and construction and rehabilitation of basic
infrastructure systems, e.g., urban roads & storm water drainage, wastewater collection and treatment,
water supply including consumer water meters in new networks, lake restoration, interstate bus
terminals, and municipal buildings) in participating urban local governments, b) strengthened planning,
budgeting and implementation systems for municipal service delivery and c) strengthening municipal
finances and financial management systems. The proposed NUGIP will support up to 15 cities in two
priority strategic urban clusters in eastern-terai region (Province 1 and 3) and central-hill region
(Province 4). The proposed NUGIP will comprise the following three components:

1. Component 1: Investment support for strategic city-wide municipal infrastructure


development and local/regional economic development projects. This component will provide
financial resources to participating ULGs for financing critical infrastructure requirements focusing on
(i) improving access and quality of core municipal services such as drinking water supply, municipal
roads, storm water drainage, street lights etc, and/or (ii) developing local infrastructure for boosting
local/regional economic development such as bus-terminals and shelters, markets, regional
connectivity, etc. The infrastructure requirements will be identified through detailed infrastructure and
service delivery need-gap assessment as well as intensive stakeholder consultation and community
engagement to ensure that the critical local needs and priorities are addressed in an effective manner.

2. Component 2: Capacity building and technical support for improved institutional and
financial systems. This component would provide capacity building support and technical assistance
to participating ULGs for targeted improvements in institutional and financial systems at the local level.
In the context of ongoing transition to federalism, the overall focus of the interventions under this
component would be to strengthen the systems and capacities of the local governments.

3. Component 3: Project management, co-ordination and monitoring. This component would


provide the technical support to the Ministry of Urban Development (MoUD) at the federal level and
the participating ULGs at the local level for project implementation, coordination, monitoring and
reporting.

B. Objective of this assignment


The objective of this assignment is to provide technical support to the World Bank and the Government
of Nepal for (i) establishing the design criteria, (ii) conducting technical review & quality assurance,
and (iii) coordination of design and preparation of municipal infrastructure investment sub-projects
worth approx. USD 40-50 million to be implemented in the first year of the project.

C. Scope of Work
The scope of work includes supporting the World Bank and Government of Nepal in establishing the
design criteria, providing technical review support, quality assurance and ensuring that the design
addresses the required environmental & social safeguard aspects as per WB guidelines and is resilient
to disasters (including earthquake, landslides, flash floods, etc) during the preparatory phase for
investments identified as part of NUGIP in core municipal services – municipal roads & storm water
drainage, drinking water supply and urban waste-water management. The majority of investments
proposed (USD 40-50 million) during the first year are expected to be in municipal roads & storm water
drainage sector. However, it is expected that a few investments across other sectors - drinking water
supply and waste-water management, may also be taken up in due course.

The detailed scope of work for this assignment is as follows –

1. Activity 1 - Preparation of technical guidance notes for infrastructure investments to be taken up


under proposed NUGIP:
Currently, the GON does not have adequate standard technical engineering codes,
standards/specifications and design guidelines for core municipal/urban infrastructure, though for
some specific infrastructure services there are some codes and design guidelines for specific
investments being undertaken at the local level. The consultants will be required to review the
existing codes, standards and design guidelines, criteria adopted for recent projects, assess the
adequacy as per the technical criteria required for the proposed investments and develop technical
guidance notes for municipal roads, storm water drainage, urban waste water management, and
urban water supply (clearly establishing the design criteria) in discussion with the World Bank and
GON that would need to be followed by the technical consultants hired by the Project Coordination
Office (PCO) for identification, detailed design and preparation of Feasibility reports and Detailed
Project Reports (DPRs). The guidance notes should include -
i. Design criteria/standards/guidelines for Municipal roads & storm water drainage water
supply and waste management to be followed for proposed investments.
ii. Design considerations for ensuring resilience to disaster (earthquake, floods, landslides)
iii. Advice on Technical surveys/studies (for instance geotechnical, traffic surveys for urban
roads and catchment analysis for storm water drainage projects) and detail out the
methodology to be followed while conducting these surveys/studies.

2. Activity 2 - Technical review of the feasibility reports/DPRs prepared by DPR Consultants and
investigation/ survey reports:
The consultants would be required to support the Bank’s task team in reviewing and ensuring the
technical quality of the proposed engineering designs at all stages (FR/DPR) and would include
providing -
iv. Detailed technical review of the project’s designs
v. Detailed review of the various technological and operational solutions as well as the
recommended option proposed by the technical consultants at the feasibility and DPR
preparation stages, including providing advice on additional/alternate efficient and more
resilient technological and operational solutions that could be used technically, operationally,
economically, environmentally and socially more effective.
vi. Detailed review and validation of material and equipment specifications proposed by DPR
consultants deployed by GoN, including doing primary market research to validate the
material and equipment specifications. This would also include recommending alternate

material/equipment specifications in case alternate materials/equipment are better for the
project conditions.
vii. Detailed review and validation of BOQs (Bill of Quantities) used in the project costing for
civil infrastructure and electro-mechanical/mechanical equipment. This would include cross
checking the BOQ items against the BOQs approved by the Municipalities/Government. For
the components which are not covered in the BOQs approved by Municipalities/Government,
the Consultants should do a primary market research to validate the cost of such components.
viii. Detailed review and approval of ready-for-construction Project drawings provided by the
DPR consultants,
ix. Review and validation of Operation & Maintenance (O&M) methodology.

3. Activity 3 - Field visits:


This would include conducting field visits independently/along with DPR consultants deployed
by PCO whenever needed for
i. Independent due diligence of the project site i.e. collecting sample data to assess the site
conditions as well as validate the data collected by DPR consultants,
ii. Review and validation of the design data, and outputs of other engineering/ technical
surveys/studies conducted by the Consultants already deployed by GoN,
iii. Validation of the proposed technical design solutions in accordance with the site conditions.
iv. Review and validation of various clearance needed for the project implementation
v. The consultants are expected to provide approx. 40% inputs onsite in Nepal including
working with technical consultants hired by PCO and conducting site visits

4. Activity 4 - Environmental and social safeguards incorporation in project design:


i. The Consultants shall ensure that quality of final DPRs meet the World Bank's requirements,
and that the project design incorporates the recommendations and mitigation measures
provided in ESIA/ESMPs on social and environmental safeguards, gender inclusion and
citizen engagement and are reflected in the costings - initial as well as recurring expenditure.
ii. This would also include recommending technical checks and balances during construction
and operational phases of the projects to ensure compliance with recommendations of
ESMFs/ESMPs.

5. Activity 5 - Project’s resilience to Disasters (earthquakes, floods, landslides)


i. The consultants should review and assess the disaster (earthquakes, floods, landslides)
resilience of structures proposed in the projects. This should also include project’s resilience
during Construction and Operational Phases and shall make recommendations in the Project’s
design, construction and operational plans to mitigate the risks.
ii. The Consultants should coordinate with PCO and DPR consultants to ensure that these
recommendations are captured in the DPRs and accordingly the disaster resistant designs and
implementation plans are proposed for the project.
iii. The consultants should also make recommendation to incorporate climate change mitigation
measures in project designs.

6. Activity 6 - Technical Inputs to Bid documents:


This would include -
i. Reviewing and validating the technical schedules for the Bid Documents, including guiding
DPR consultants for additional technical schedules incase they are missing,

ii. Providing technical inputs to the Bid Documents wherever necessary and ensuring technical
covenants are specified in the Bid Documents in line with the construction and operational
requirements of the project.

D. Deliverable, Timelines and Payment Terms


The Consultant will complete the entire assignment between September 1, 2018 and September 30,
2019. The indicative deliverables, timelines and payments terms for the following activities, which will
be a lump sum contract value, are as follows. The person months for are expected to be as follows:

E. Data, Local Services and Facilities to be provided by client


1. The following shall be made available to the consultants.
i. Any supporting documents like permits and licenses necessary for the completion of the
consultant's duties and more particularly in respect of visa requirements and assist in any
special arrangements to allow the consultants to enter in any restricted areas related to the
Project.
ii. Access to DPRs/feasibilities/reports prepared by Consultants already deployed by GoN.
iii. Assistance with arranging meetings with the concerned Ministry and Department of the
Government of Nepal, Municipalities, and other authorities as necessary during the course of
the consultant’s work.
2. The Consultants shall verify the correctness of the data/information provided by the Client and
satisfy them about the accuracy of data/information /material before these are used.

Data/information/material provided to the consultants shall remain the property of the
originating agency and shall be provided solely for the purpose of the work to be done under
this contract. All such borrowed material shall be returned to the Client upon completion of
the assignment. Apart from data/information provided by the Client and that which the
consultants could procure from other agencies, the consultants shall be responsible to collect
any other data/information required for the assignment, through field survey and investigations.

F. Firm’s experience and list of key positions for the assignment


The Consultants for the assignment should demonstrate the prior experience of working on assignments
with similar work of work with International Development Agencies (multilateral and/or bilateral) in
Nepal/South Asia Region at large. It is important for the consultants to demonstrate the institutional
experience in execution of delivery of assignments focusing on technical design and detailed technical
review work for city-wide urban infrastructure development projects, especially in disaster prone areas.
The consultants should also demonstrate the understanding of the Bank’s requirements on technical
engineering design aspects as well as environment safeguards, social safeguards, gender, citizen
engagement and urban resilience/disaster risk management aspects, and how these aspects influence the
technical design and planning of the infrastructure projects.

The consultants are also required to demonstrate their understanding of the current country context of
Nepal, especially the ongoing transition to federalist government system, and the local capacity
constraints/challenges at the local government level as well as geographical and demographical
challenges that would impact the design and implementation of the municipal infrastructure
development project – consultants with access to qualified and experienced local Nepali experts will
have an added advantage.

The consultant will be required to deploy the following key experts:

The consultant should propose a team which covers the necessary areas of expertise, including team
leader, with a mix of international and local (Nepali) experts to ensure that the team is well-versed with
local context and linguistic requirements for the assignment. The consultant will be required to
supplement with adequate support staff to ensure quality and timely output, as per the Bank’s
requirements. The consultants may propose alternate deployment schedule for the proposed team as per
their approach and methodology for the execution of this assignment with due justification. Proposed
team members cannot be replaced for any of the key positions mentioned above during the execution
of the assignment, without proper justification and prior written consent from the World Bank.

G. Reporting Requirements
1. The consultant will report to Ms. Yoonhee Kim, Senior Urban Economist/Task Team Leader,
World Bank and Mr. Harsh Goyal, Urban Development Specialist, World Bank for this assignment
and work closely with the core task team members (local and international) from the Bank.
2. The entire assignment shall be carried out under the overall guidance of the Bank. At all steps, the
consultant will be required to closely engage and seek inputs from the Bank team.
3. The Bank team will facilitate and lead the discussions with the Ministry of Urban Development
on the key milestones to seek their feedback and inputs.
4. The consultant will need to organize the meetings for data collection and stakeholder consultations
on their own. The Bank’s task team may join some of the consultation meetings.
