Plaintiffs, CELCOG, LLC DBA STRAWN'S EAT SHOP TOO, THE BRAIN TRAIN, LLC AND BEARING SERVICE & SUPPLY, INC., appeared in person and through their counsel of record, Glenn L. a Langley. Defendant, MAYOR ADRIAN PERKINS, appeared through his counsel of record, Nichole M. Buckle. Considering the argument of counsel, the briefs filed herein, the evidence presented, and facts of which judicial notice was requested and taken, the Court finds as follows: Defendant, Mayor Adrian Perkins, did not have authority to issue the Order dating July 8, 2020 mandating personal protective masks or face coverings within the City of Shreveport and purporting to establish penalties for violations of such requirements or prohibitions. Additionally, the Order dated July 8, 2020 is unconstitutional in that it violates separation of powers and Plaintiffs’ constitutional rights to due process of law. Alll other requirements for a preliminary injunction are satisfied. IT IS THEREFORE ORDERED that the previously-granted Temporary Restraining Order is converted to a preliminary injunction, Plaintiffs’ motion for which is hereby GRANTED without bond, and Mayor Perkins is hereby ENJOINED AND RESTRAINED from enforcing his Order dated July 8, 2020 including, without limitation, via any penalty.IT IS FURTHER ORDERED that, pursuant to La. Code of Civil Procedure Art. 3605, this Order shall be effective against Mayor Perkins and his officers, agents, employees, and counsel, and those persons in active concert or participation with them. IT IS FURTHER ORDERED that Mayor Perkins, in his official capacity as Mayor of the City of Shreveport, shall bear all costs of these proceedings IT IS FINALLY ORDERED that the issue of attorney's fees shall remain open and counsel for Plaintiffs may notify the Court of his intention to seek such fees.
