Group Assignment – Negotiation of the Collective Agreement – PROPOSAL WRITTING

Review the Clean Right Partners and Allied Service Union Canada collective agreement (pg 292
of textbook) and the background information provided in the text. Assume that you are
preparing to negotiate a renewal of the agreement.

Using the information provided in the collective agreement and included in Chapters 6, 7, and 8
complete the following:

For the Union:

Identify at least three (3) articles that you think that the union would like to have changed and list
why.

For the Employer:

Identify at least three (3) articles that management would like to have changed and list why.

For any article referred to, identify the existing provision, and briefly explain the changes the
union would want and / or the changes management might want.

For example, a union might want the number of days to file a grievance to be increased, and
management may want the number of days to be decreased. Discuss the items in the order they
are referred to in the current agreement. There may be articles that neither the union nor
management has any concerns with. There may articles that only one side has concerns with.
Refer to any changes in plain English; not contract language. Refer to only one item for each
main heading in the agreement for each side. Comment on the articles and the changes that you
think are the most significant.

Example: UNION PROPOSAL

Article 1.01 – Amend to read:

The Company recognizes the Union as the sole collective bargaining agent for all route persons
(route and mat drivers), dock attendants and porters of the Company in Anytown, Province save
and except supervisors, persons above the rank of supervisor, clerical and sales staff and persons
for whom any trade union held bargaining rights as of February 1, 2016.
By indicating a strike-through in this article, the union is proposing to remove the words clerical
and sales staff, subsequently giving the union bargaining rights to these employees. If
management agreed to this they would be voluntarily recognizing the union as representatives of
the both the clerical and sales staff.

Example: EMPLOYER PROPOSAL

Article 2.01 – Amend to read:

All employees who are presently employed by the Company must, as a condition of employment
become and/or maintain their Union membership in good standing. For the purpose of this
Collective Agreement, the sole definition of membership in good standing means they must pay
regular monthly Union dues, and periodic assessments uniformly required of all members in the
Bargaining Unit. Employees have the right to deny union representation in some
circumstances.

By indicating a strike-through in this article, the employer is proposing that union membership
is not a condition of employment. By adding clarification at the end of the article, the employer
is indicating they think there are some situations where employees are exempt from union
membership and it is not a condition of employment. If the union agrees to this, it loses
bargaining rights for some employees in the bargaining unit.
