Social Security Organization (SOCSO)

Background

Social Security Organisation (SOCSO) was formed under


the Employees' Social Security Act 1969 as a government
department of the Ministry of Labour and Manpower on 1
January 1971. It is entrusted with the administration of two
social security schemes, namely the Employment Injury
Scheme and the Invalidity Scheme

The objective of both schemes is to guarantee cash


payment and benefits in kinds to employees and their
dependants in the event of a contingency.

To social security protection to Insured Person and their dependants


through social security schemes, and to increase awareness of
occupational safety and health that will ultimately improve the Insured
Persons' social wellbeing .

Objective

To provide social security protection to all Insured Persons and their


dependants through social security schemes based on the concept of a
caring society in line with the National Development Policy and Vision
2020

Social Security Protection Principles

SOCSO was mandated to administer and enforce the


Employee Social Security Act 1969 and Employee Social
Security General Rules 1971. Through the Act and
Regulations, SOCSO is able to provide free medical
treatment, facility for physical or vocational rehabilitation, and
financial assistance to employees if they have loss their
abilities due to accidents or diseases that have reduced their
abilities to work or rendered them incapacitated. If an
employee has died, their dependants are provided for
financially through pensions

Act And Regulations


The Employees’ Social Security Act, 1969 and the Employees’
Social (General) Regulations, 1971 are applicable to all
industries having one or more employees.
Social Security Organization (SOCSO)

A. Employer

• Employers are categorised into two, namely principal employer and immediate employer.

1. Principal Employer

An employer who directly employs an employee under a contract of service or apprenticeship. All matters
relating to services and payment of wages are handled by them.

2. Immediate Employer

An employer who employs an employee by or through him to perform work under the supervision of a
principal employer. This includes a person who has a contract of service with an employee and temporarily
lends or lease the service of that employee to a principal employer.

• Employer’s Responsibility

Principal and immediate employers who employ one or more employees are responsible to register and pay
contributions to SOCSO.

The principal employers are also accountable to ensure the registration and payment of contributions for all
employees employed by the immediate employer.

The employer is obliged to report all work related accident that befalls their workers within 48 hours of
notification.

B. Employee

All eligible Malaysian citizens and permanent residents employees are compulsory to register.

Employee’s Eligibility

All employees who are employed under a contract of service or apprenticeship in the private sector and
contractual / temporary staff of Federal / State Government as well as Federal / State Statutory
Bodies need to be registered and insured under SOCSO. Contribution will be capped at monthly
remuneration of RM4,000.00.

Employees exempted from Employees’ Social Security Act 1969


coverage are as follows:

1.Federal and State Government permanent employees


2.Domestic servants
3.Self-employed
4.Sole proprietor or owners of partnership
5.Spouse/s of a sole proprietor or partners
6.Foreign workers

Contributions
Contributions
Employers are required to pay monthly contributions for each eligible employee according to the rate
specified under the Employees’ Social Security Act, 1969. These contributions are divided into two (2)
types, namely:

Contributions of the First Category


For employees who are less than 60 years of age, contributions payable by employers and employees
are for the Employment Injury Scheme and the Invalidity Scheme.

The rate of contribution under this category comprises 1.75% of employer’s share and 0.5% of
employees’ monthly wages according to the contribution schedule.

Note: All employees who have not reached the age of 60, must contribute under the First Category
except for those who have attained 55 years of age and have no prior contributions before they reach 55
due to non-eligibility under the Employees’ Social Security Act, 1969.

Contributions of the Second Category


The rate of contribution under this category is 1.25% of employees’ monthly wages, payable by the
employer, based on the contribution schedule. All employees who have reached the age of 60 must be
covered under this category for the Employment Injury Scheme only.

Self-Employed Employment Injury Scheme
The Self-Employed Employment Injury Scheme for self-employed taxi drivers or individuals carrying out
similar services took effect on 13 June 2017. This social protection was accorded under the provisions
of the Self Employment Social Security Act 2017.

The duration of protection is 12 months from the date and time the contribution is paid and validated by
the payment receipt.

SELF EMPLOYED EMPLOYMENT INJURY SCHEME


SOCSO provides protection scheme for self-employed taxi drivers or individuals carrying out similar
services under the Self Employment Social Security Scheme.

This Scheme provides protection to self-employed insured persons from employment injuries including
occupational diseases and accidents during work-related activities.

This Scheme also provides cash benefits to taxi drivers and their dependants besides providing medical
care, physical rehabilitation and vocational training.
