INTRODUCTION

In this case, it consists 2 part of situation. The first part of this situation is when Lisa wants to

take the advantage of six months maternity leave that offer by the company. It shows here that

company is willingly to give Lisa the six months maternity leave. Then, Lisa also definitely

coming back to the work and the company also promise to hold the job for her.

Then, the second part of this situation is occur when there is a posting for her job in company

website and also someone might fill her job. Besides that, the company also gets another post for

Lisa. But then they do not want Lisa to know about this. From here it shows that the company is

doing something wrong towards Lisa because why they do not want to tell Lisa about what

actually had happen.

BODY

First point-unequally treated

This case shows that Lisa has been treated unequally by the management of the company and it

lead to gender discrimination. Gender discrimination in workplace can arise in different contexts.

For instance an employee may be discriminated against by being asked discriminatory questions

during a job interview or because an employer did not hire, promote or wrongfully terminated an

employee based on his or her gender or employee received a pay unequally. The management

where Lisa work has breaks their promise because they find another replacement for her and also

get a new job for her. Besides that, it also leads to gender stereotyping.
Second point-discrimination

• Employment Act section 40(3) state that employer who dismiss a female employee from

her employment during the period in which she is entitled to maternity leave commits an

offence.

• Equal employment- supposedly the management should to give equal employment to all

employees without considered his or her gender.

• Extra maternity 30 days to overcome post natal blues- increase motivation.

• Appreciate female employee- they should appreciate female employee although they are

wife and mother

Third point-fairness

• Provide notice- if they want to terminated or get another post for Lisa, they should

prepare a notice for Lisa. So that Lisa aware about what actually happen.

• Inform/communicate-besides that, they also need to communicate with Lisa

Fourth point-shortened her leave

• Do not find another person to replace her, but told her to shortened her leave

• Reason: Lisa knows better about her job and if the company wanted to find a replacement

for her, Lisa might refuse about it.

• Manager must use company’s handbook as a guideline.

Fifth point-do work from home


• The company can ask Lisa to do her work from home.

• Can help company cut the cost.

• It helps Lisa to focus on her job and her baby as well.

• Lisa can interact with her colleague through several of technology.

• Focus on work life balance

Sixth point- nursery at office area

• Company can provide nursery in the office

• To increase employees’ productivity

• Female employees can focus on their job because they know that their children are in a

good care in the nursery.

MORAL PHILOSOPHY

 Utilitarianism

 Ethics of Duty- it is the duty for the company to find the solution so that they can run the

company smoothly although without Lisa

 Ethic of Justice-in decision making, company should consider the consequences that Lisa

will face.

COMMENTS
a) The company cannot shortened the maternity leave because it is breach contract of

service because it is fall under Employment Act and it is including weekend and public

holiday and if it’s the breach for contract, it fall under IRC.

b) Providing nursery is a part of corporate social responsibility (CSR) for the organization.

The company can enjoy corporate tax saving and give returns to the company. Besides

that, it does not mean that by having the nursery, the employees’ productivity will

increase.

c) Employer cannot ask their employees to work at home.
