1: BRIEF OF PROJECT:

Punjab Aab-e-Pak Authority was established under Punjab Aab-e-Pak Authority


Act (PAPA) promulgated in August-2019 with the mandate of “Provision of clean
drinking water to the people of Punjab”. So, in order to achieve the mandate, PAPA
intends to execute the following Projects:

i) “SUPPLY CONSTRUCTION, INSTALLATION AND O&M OF


DIRECT SUPPLY IN BHALWALPUR & MULTAN
DIVISION”

ii) “SUPPLY CONSTRUCTION, INSTALLATION AND O&M OF


DIRECT SUPPLY IN GUJRANWALA & SARGODHA
DIVISION”

Accordingly, well reputed and established construction companies / firms /


contractors registered with Pakistan Engineering Council (PEC) in the category “C-3 &
Above” and codes (CE-09 or 10) having required technical, financial and managerial
capabilities, and are not blacklisted, invited to participate in the prequalification process
for the afore-stated projects through submission of requisite, required in the
Prequalification Documents. Only prequalified firms / companies / contractors will be
eligible for further tendering processes (Technical & Financial Bid submission) in
accordance with Punjab Procurement Regulatory Authority, 2014.

Each applicant may apply in one or both projects subject to technically,


financially and managerially capable of executing/handling the work/s. It is mandatory to
submit a separate request for each project in case of applying for both projects.
Section I:
Instructions to Applicants
1. Instruction to Applicants

A. General

2. Scope of 2.1 In connection with the invitation for prequalification, indicated in


Application Section 2, Application Forms, the Employer’s Representative as
defined in the Application Forms, issues this Prequalification
Document to the Applicants interested in Pre-Qualification and
further Bidding for projects:

i) “SUPPLY CONSTRUCTION, INSTALLATION AND O&M


OF DIRECT SUPPLY IN BHALWALPUR & MULTAN
DIVISION”

ii) “SUPPLY CONSTRUCTION, INSTALLATION AND O&M


OF DIRECT SUPPLY IN GUJRANWALA & SARGODHA
DIVISION”

The scope includes but not limited to the Pre-Qualification of


Applicants for the afore-stated projects.
Punjab Aab-e-Pak Authority, Government of the Punjab is initiating
the procurement process to finalize / shortlist the firms / contractors
/ Companies for participation in bidding process under PPRA Rule,
2014.

3. Source of Funds 3.1 Government of Punjab


4. Corrupt 4.1 Standard Anticorruption Policy of the Government of Punjab
Practices including the Employer requires bidders, suppliers and
manufacturer under contracts to observe the highest standard of
ethics during the procurement and execution of such contracts. In
pursuance of this policy;
(a) for the purposes of this provision, the terms set forth below as
follows are defined as:
i. “corrupt practice” means the offering, giving, receiving, or soliciting,
directly or indirectly, anything of value to influence improperly the
actions of another party;
ii. “fraudulent practice” means any act or omission, including
misrepresentation, that knowingly or recklessly misleads, or
attempts to mislead, a party to obtain a financial or other benefits
or to avoid an obligation;
iii. “Coercive practice” means impairing or harming, or threatening to
impair or harm, directly or indirectly, any party or the property of
the party to influence improperly the actions of a party;
iv. “Collusive practice” means an arrangement between two or more
parties designed to achieve an improper purpose, including
influencing improperly the actions of another party.

(b) The Employer will reject a proposal / application from bidding


proceedings if it determines that the bidder recommended for
award has, directly or through an agent, engaged in corrupt,
fraudulent, collusive, or coercive practices in competing for the
Contract; and

(c) The Employer will sanction a party or its successor, including


declaring ineligible, either indefinitely or for a stated period of
time, to participate in bidding activities in Pakistan if it at any
time determines that the applicant has, directly or through an
agent, engaged in corrupt, fraudulent, collusive, or coercive
practices in competing for, or in executing contract.

5.Eligible 5.1 An Applicant shall be a registered contractor / firm / company in


Applicants PEC (Pakistan Engineering Council) with in the relevant category
and code as stated in brief of project.

5.2 An Applicant shall have the nationality of an eligible country. An


Applicant shall be deemed to have the nationality of a country if the
Applicant is a national of that country; or is constituted,
incorporated, or registered and operates in conformity with the
provisions of the laws of that country.

5.3 The above requirements shall apply to the determination of the


nationality of applicant.

5.4 Employer considers a conflict of interest to be a situation in which a


party has interests that could improperly influence that party’s
performance of official duties or responsibilities, contractual
obligations, or compliance with applicable laws and regulations.
The Employer will take appropriate actions to manage such
conflicts of interest which may include rejecting a proposal if it
determines that a conflict of interest has flawed the integrity of any
procurement process. At the time, applicant may be considered to
be in a conflict of interest with one or more parties if they, including
but not limited to participate as a consultant in the preparation of
the design or technical specifications of the works / goods that are
the subject of this prequalification.

5.5 Applicant that is under a declaration of ineligibility / blacklisting by


the Government of Pakistan / Government of Punjab / Any
International Agency / Any Public Sector Entity / Autonomous Body
including the Employer in accordance with ITA Clause 4, at the
date of submission of the application or thereafter, shall be
considered as disqualified.

5.6 Applicants shall provide such evidences of their continued


eligibility, satisfactory to the Employer as the Employer shall
reasonably request.

5.7 An Applicant shall submit only one application for one work in the
prequalification process. In case of applying for both projects, the
applicant must submit a separate request for each project. The
applicant must have technically, financially and managerially
capable of executing / handling the works in case of applying
for both projects. An Applicant who submits more than one
application for single a work thereby liable for disqualification of all
the applications.

6. Eligible 6.1 The materials, equipment and services must meet the eligible

7. Contents of 7.1 The Prequalification Documents consist of sections indicated below,
Prequalification and should be read in conjunction with any Addenda issued in

7.2 The “Invitation for Prequalification” issued by the Employer is a part
of the Prequalification Documents.
7.3 The Employer accepts no responsibility for the completeness of the
Prequalification Documents and its addenda unless they were
obtained directly from the Employer or downloaded from
www.ppra.punjab.gov.pk .
7.4 The Applicant is expected to examine all instructions, forms, and
terms in the Prequalification Documents and to furnish all
information or documentation required by the Prequalification
Documents.

8.Clarification of 8.1 A prospective Applicant requiring any clarification of the


Prequalification Prequalification Documents shall contact the Employer in writing
Documents at the Employer’s Representative address as shown in ITA. Sub-
Clause 8.2. The Employer will respond in writing to any request for
clarification provided that such request is received not later than
ten (10) days prior to the deadline for submission of Applications.
The Employer shall forward copies of its response to all Applicants
or upload the clarification / addendum on its website including a
description of the inquiry but without identifying its source. Should
the Employer deem it necessary to amend the Prequalification
Documents as a result of a request for clarification, it shall do so
following the procedure under ITA. Clause 9 and in accordance
with the provisions of ITA Sub-Clause 16.2.

9. Amendment of 9.1 Not later than Seven (07) days prior to the deadline for submission
Prequalification of Applications, the Employer may amend the Prequalification
Documents Documents by issuing addenda.

9.2 Any addendum issued shall be part of the Prequalification


Documents and shall be communicated in writing or uploaded on
its designated website.

9.3 To give prospective Applicants reasonable time in which to take an


addendum into account in preparing their Applications, the
Employer may, at its discretion, extend the deadline for the
submission of applications.

C. PREPARATION OF APPLICATIONS

10. Cost of 10.1 The Applicant shall bear all costs associated with the preparation
Applications and submission of its application, and the Employer shall in no
case be responsible or liable for those costs, regardless of the
conduct or outcome of the prequalification process.

11. Languages of 11.1 The application, as well as all correspondence and documents
Application relating to the prequalification exchanged by the Applicant and the
Employer, shall be written in the English language. Supporting
documents and printed literature that are part of the application
may be in another language, provided they are accompanied by
an accurate translation, duly authenticated by Embassy or
counsel, of the relevant passages into the English language, in
which case, for purposes of interpretation of the application, the
translation in English shall govern.

12.Documents 12.1 The Application shall comprise the following:

(b) Written confirmation authorizing the signatory of the application to

13.Application 13.1 The Applicant shall prepare an Application Submission Sheet


Submission Sheet using the form furnished in this document. This form must be
completed without any alteration to its format. The application
must be signed and stamped by authorized person of the
applicant having valid power of attorney or authorization letter.

14. Documents 14.1 To establish its eligibility in accordance with ITA Clause 5, the
Establishing Applicant shall complete the eligibility declarations in the
Application Submission Sheet and Forms included in, Application

15. Signing of the 15.1 The Applicant shall prepare one original of the documents

15.2 The Applicant shall submit one original along three (03) hard and
soft copies individually clearly marked as “ORIGINAL” and
“COPY” on the title page for one project or in case of applying in
more than one projects. In the event of any discrepancy between
the original and the copies, the original shall prevail.

15.3 The requirements regarding the legal instrument evidencing the


authorization to represent and sign on behalf of the Applicant shall
be a power of attorney duly notarized OR Authorization Letter in
original indicating that the person(s) signing the Application
has/(ve) the authority to sign the Application for Prequalification.

D. SUBMISSION OF APPLICATIONS
16. Sealing and 16.1 The Applicant shall enclose one original along with three (03) hard

submitted in a sealed envelope; which shall

(a) Bear the name and address of the Applicant;
(b) Be addressed to the Employer’s Representative, in accordance
with Sub-Clause ITA 8.2; and;
(c) Bear the specific identification of this prequalification document
indicated in the ITA Sub-Clause 2.1.
16.2 If the envelope is not sealed and marked as required, the
Employer will assume no responsibility for the misplacement of
the application.
16.3 The applicant should attach the detail of contents with page
numbers at the start and should properly flag / append the
relevant pages in the application.

17. Deadline for 17.1 Applications shall be submitted by the Applicant through courier /
Submission of express mail or by hand at the address indicated in the ITA Sub-
Applications Clause 8.2. However, applicant must ensure that the application
must reach not later than the following deadline:

28th July, 2020, 11:30 AM PST


Electronically submitted application shall not be entertained and treated
as rejected.

17.2 The Employer may, at its discretion, extend the deadline for the
submission of Applications by amending the Prequalification
Documents in accordance with ITA Clause 9, in which case all
rights and obligations of the Employer and the Applicants subject
to the previous deadline shall thereafter be subject to the deadline
as extended.
18. Late 18.1 The application received after the deadline will not be entertained
Applications and shall be considered as rejected.
19. Opening of 19.1 The Employer shall prepare a record of the opening of
Applications Applications that shall include, as a minimum, the name of the
Applicants.

E. EVALUATION OF APPLICATIONS

20.Confidentiality 20.1 Information relating to the evaluation of Applications, and


recommendation for prequalification, shall not be disclosed to
Applicants or any other persons not officially concerned with such
process until the notification of prequalification is made to all
Applicants.
20.2 From the deadline for submission of Applications to the time of
notification of the results of the prequalification in accordance with
ITA Clause 28, if any Applicant wishes to contact the Employer on
any matter related to the prequalification process, it may do so in
writing.

21.Clarification of 21.1 To assist in the evaluation of Applications, the Employer may, at


Applications its discretion, ask any Applicant for a clarification of its application
which shall be submitted within a stated reasonable period of
time. Any request for clarification and all clarifications shall be in
writing in English Language.

21.2 If an Applicant does not provide clarifications of the information


requested by the date and time set in the Employer’s request for
clarification, its Application may be rejected.

22.Responsiveness 22.1 The Employer may reject any Application which is not responsive
of Applications to the requirements of the Prequalification Documents.

22.2 The Employer reserves the right to waive minor deviations, if


these don’t materially affect the capability of an Applicant to
perform the contract. Subcontractor’s experience and resources
shall not be taken into account in determining the Applicant’s
compliance with the qualifying criteria.

F. PREQUALIFICATION OF APPLICANTS
23. Evaluation of 23.1 The Employer shall use the criteria and methods define in Section
Applications II, Prequalification Criteria to evaluate the qualifications of the
Applicants for every project.

23.2 As stipulated in ITA 2.1, this prequalification exercise shall be for


projects:
i) “SUPPLY CONSTRUCTION, INSTALLATION AND O&M
OF DIRECT SUPPLY IN BHALWALPUR & MULTAN
DIVISION”
ii) “SUPPLY CONSTRUCTION, INSTALLATION AND O&M
OF DIRECT SUPPLY IN GUJRANWALA &
SARGODHA DIVISION”

24. Employer’s 24.1 The Employer may reject all Bids or Proposals at any time prior to
Right to Accept the acceptance of the Bid or Proposal as provided in Rule 35 of
or Reject Punjab Procurement Rules, 2014.

25. Prequalification 25.1 All Applicants, whose applications have been determined to be
of Applicants responsive to the requirements of the Prequalification Documents
and who have met or exceeded the specified criteria (Passed)
shall be prequalified by the Employer.

26. Notification of 26.1 Once the Employer’s Representative has completed the
Prequalification evaluation of the Applications, it shall notify all Qualified &
disqualified Applicants in writing.

27. Invitation to Bid 27.1 Promptly after the notification of the results of the prequalification,
the Employer shall invite bids from all the Applicants that have
been prequalified.
27.2 Bidders may be required to provide bid security in the form of a
Call Deposit Receipt (CDR) for an amount as specified in the
bidding document.

28. Changes in 28.1 Any change in the prequalification status of an Applicant after
Qualification of being prequalified in accordance with ITA Clause 25 shall be
subject to the written approval of the Employer. Any such change

shall be submitted to the Employer not later than fourteen (14)
days after the date of the Invitation to Bid. Such approval shall be
denied if as a consequence of any change;

(a) The prequalified Applicant, after the change, no longer


substantially meets the prequalification criteria set forth in this
document.
Section II:
Prequalification Criteria
1. General
Pre-qualification will be based on the criteria given in the instant part of the
prequalification document regarding the Applicant’s Basic Eligibility, Experience Record,
Personnel Capabilities, Equipment Capabilities and Financial Soundness, and as
demonstrated by the Applicant’s responses in the forms attached to this letter. If the
applicant has worked as sub-contractor then the sub-contractor’s experience and
resources shall be taken into account in determining the applicant’s compliance with the
qualifying criteria and shall not be considered for the main contractor / firm’ experiences
and resources. Experience and resources of consortium or Association of firms and
Joint Venture experience & resources shall be considered jointly for evaluation.

2. Weightage /Marks
The weight age / distribution of the marks is as given below:

Note:-Prequalification status shall be determined on the Pass/Fail basis. The applicant
must score total 65 marks and at least 50% marks in each category, to qualify. If
applicant fails to score 50% marks in any of above mentioned categories, will be
considered disqualified.

2.1 Basic Eligibility

The firms fulfilling the following basic requirements shall only be considered for further
evaluation (relevant documents to be attached):

a. Renewed / Latest registration with PEC in the respective Category and


relevant code defined with the limit of construction cost of project. (Lead
Partner in case of JV at minimum).
b. Memorandum and Article of Association / Registration certificate of the Firm
with SECP (Security & Exchange Commission of Pakistan).
c. Renewed Income Tax registration certificate / NTN / PNTN Certificate and
PRA registration.
d. Affidavit of sole proprietorship duly attested by Oath Commissioner or
Partnership deed on (Judicial stamp paper) registered with sub registrar.
e. No Blacklisting / declared ineligible / litigation / conflict of interest affidavit on
judicial stamp paper duly certified by Notary Public / Oath Commissioner.
2.1.1 Note:-
In case of joint venture / consortium, all the firms have to fulfill the basic eligibility criteria
except condition a.
The applicant must submit JV agreement in case of projects completed as a partner of
JV clearly showing percentage share of all partners of JV, if the JV agreement showing
percentage of the partners is not attached, the submitted project will not be considered
during evaluation. The applicant must submit the JV agreement illustrating Lead and
other partner/s along with application if applying as JV. The lead partner must hold at
least 50% shares whereas other partner/s should hold not less than 25% shares. In
case of consortium between local and foreign company, the local company at the stage
of prequalification must meet the qualification requirement as per PEC category &
codes and thereafter, for award of project, the JV must be registered with PEC as per
PEC by –Laws.

3. Joint Venture (JV)

3.1 Joint Venture must comply with the following requirements:-

a) Following are minimum qualification requirements:-

i) The joint venture must collectively satisfy the criteria illustrated at points 2.2.1 to
2.2.4 for which purpose the relevant figures for each of the partners shall be added
together to arrive at the JV’s total capacity. Individual members must satisfy each of
the requirements of point 2.1.1, 5 and 6 heretofore.
b) Any change in a pre-qualified JV after prequalification, shall be subject to written
approval of employer prior to deadline for submission of bids. Such approval may be
denied if:-
(i) Partner (s) withdraw from a JV and remaining partners do not meet the qualifying
requirements.
(ii) The new partners to a JV are not qualified individually or as another JV.
(iii) In the opinion of employer, a substantial reduction in competition would result.

c) Bid shall be signed by all members in the JV so as to legally bind all partners, jointly
and severally, and bid shall be submitted with a copy of the JV agreement providing the
joint and several liabilities with respect to the contract.

d) The JV must submit the copy JV agreement clearly showing the percentage shares
of each member of JV along with the application.
3.2 The prequalification of a JV does not pre-qualify any of its partners individually or as
a partner in any other JV or association. In case of dissolution of JV or association,
each one of the constituent firms may pre-qualify if they meet all the prequalification
requirements and any partner of J.V has requested / shall request for the same and
then his prequalification shall be subject to the written approval of the Employer.

4. Conflict of Interest

4.1 The Applicant (including all members of a JV) must not be associated, nor have
been associated in the past, with the consultant or any other entity that has prepared
the design, specifications, and other prequalification and bidding documents for the
project, or was proposed as Engineer for the contract, over the last five years. Any such
association may result in disqualification of the applicant.

5. Updating Prequalification Information

5.1 Bidders shall be required to update the financial, personnel and equipment
information used for prequalification at the time of submitting their bids, to confirm their
continued compliance with the qualification criteria and verification of the information
provided at the time of prequalification. A bid shall be rejected if the Applicant’s
qualification thresholds are no longer met at the time of bidding.

6 Other Factors

6.1 Only firms and JVs that have been pre-qualified under this procedure shall be
invited to bid. A qualified firm or a member of a qualified JV may participate only in one
bid for the contract. If a firm submits more than one bid, singly or as a JV, all bids
including that bidder will be rejected. This rule will not apply in respect of bids which
include specialist sub-contractors who are used by more than one bidder.

6.2 The Employer reserves the right to:-


a) Amend the scope and value of any contract(s) to be bid, in which event the bidder(s)
will only bid among those pre-qualified bidders who meet the requirements of the
contract(s) as amended.
b) Reject or accept any application; and
c) Cancel the prequalification process and reject all applications.
d) The Employer shall neither be liable for any such actions nor be under any obligation
to inform the Applicant of the grounds for rejection, however, maybe debriefed if
solicited.
e) The employer shall inform the applicants who have not been pre-qualified.
