RE: NFL-NFLPA COVID-19 Testing Cadence Updates

As set forth in the NFL and NFLPA COVID-19 Protocols, the parties have continued to
consult with their respective experts to evaluate developments in science and in the progression of
the pandemic to assess whether adjustments to the protocols are warranted. Currently, the NFL-
NFLPA COVID-19 Testing Protocol requires daily testing of all players and Tier 1 and Tier 2
personnel throughout the first two weeks of NFL Training Camp. The parties agreed to evaluate
the testing cadence after the initial two-week period. Although the rate of positive tests for all
player and Tier 1 and Tier 2 personnel across the league during this period is below one percent
(and no individual club rate is greater than two percent) the parties, following consultation with
their respective medical experts, have elected to continue to require daily testing of all players and
Tier 1 and Tier 2 personnel until further notice. The daily testing requirement includes players’
mandatory days off.

The parties have also decided to exempt from testing a player or Tier 1 or Tier 2 personnel
diagnosed with coronavirus (as confirmed by the NFL-NFLPA Testing Protocol) until further
notice as well.

Finally, we are aware of several instances in which individuals other than players or Tiered
personnel (or other official Club visitors) have been using the BioReference trailers to provide
specimens for Covid-19 testing. We remind clubs that this practice, while not prohibited by the
Protocols, is strongly discouraged. Clubs should arrange for testing of players’ family members,
or of non-Tiered staff, at a local laboratory to avoid possible contamination of the trailer and/or
stressing of BioReference’s testing capabilities.
